EASEMENT DEED
THIS INDENTURE made and entered into this 6'day of , tee'r 6, -/ 2010, between
James R. Franklin and Cynthia Franklin, hereinafter referred to as OWNERS, and Augusta,
Georgia, a political subdivision under the laws of Georgia, hereinafter referred to as AUGUSTA;
WITNESSETH, that Owners, for and in consideration of the sum of ONE DOLLAR
($1.00) in hand and truly paid by Augusta at and before the sealing and delivery of these
presents, and other valuable consideration, the receipt whereof is hereby acknowledged, have
granted, bargained, sold, conveyed and confirmed, and by these presents do grant, bargain,
sell, convey and confirm unto Augusta, its successors and assigns, an exclusive access and
utility easement, in perpetuity under, across and through the hereinafter described parcel of
land.
Said perpetual easement consists of the area labeled as "New 20' Sanitary Sewer
Easement 3 ", as shown on a plat prepared by Cranston Engineering Group, P. C., dated April
20, 2004, revised April 29, 2004, June 1, 1010, and November 22, 2010, attached hereto and
made a part hereof, to which reference is made for a more accurate and complete description of

is for the purposes of accessing, laying, relaying, constructing, adding, expanding, installing,
reinstalling, extending, operating, .repairing and maintaining pipelines and appurtenances
transporting and carrying the utility services of Augusta, and the accessing, laying, relaying,
constructing, adding, expanding, installing, reinstalling, extending, operating, repairing, and
maintaining cables, fiber optics, and other communication equipment and devices belonging to
Augusta.
• Owners do agree that no other utility(ies) may be constructed within the aforesaid
permanent easement in perpetuity except by written pernnission of the Augusta Utilities

Department. Said permission will take the form of an Encroachment Agreement entered into by
Augusta and the requesting utility.
Owner do also grant, bargain, sell and convey unto Augusta, its successors and assigns,
the right, but not the duty, to clear and to keep clear, all trees, undergrowth and other
obstructions from said permanent easement, along with the free right of ingress and egress to
and from said permanent eaCement for this purpose and all other purposes set forth herein.

of this Project, shall have the right to use said parcel of land in any manner not inconsistent or
interfering with the rights herein granted, excluding, however, the right to plant thereon any trees
that may interfere with the purposes set forth, both implicit and explicit, within this document,
and further excluding the right to erect, construct or maintain thereon any buildings, structures,
or other permanent improvements.
TO HAVE AND TO HOLD the aforesaid rights, ways, easements, privileges and
appurtenances unto Augusta and its successors, in perpetuity.
And Owners, their heirs, successors, assigns and legal representatives shall and will
forever warrant and defend unto Augusta, its successors and assigns, the rights, ways,
easements privileges and appurtenances conveyed herein, against the claim of any person or
persons claiming under or through Owner.

RESOLUTION
RESOLUTION AUTHORIZING THE ABANDONMENT OF A PORTION
OF EXISTING EASEMENT LOCATED ON 3150 WEST AUGUSTA
PARKWAY AND THE ACCEPTANCE OF A NEW EASEMENT
LOCATED ON 3150 WEST AUGUSTA PARKWAY
WHEREAS, Augusta- Richmond County, (known hereinafter as "Augusta "), owns a
certain easement on the property known as 3150 West Augusta Parkway (PIN 041 -0- 077- 02 -0),
by and through a Deed of Dedication, from R & H Maxxon, Inc. to The City Council of Augusta,
dated March 26, 1992, and recorded in the Office of the Clerk of the Superior Court of
Richmond County, Georgia, in Realty Reel 388, Pages 1149 -1157; and
WHEREAS, James and Cynthia Franklin, the current owners of 3150 West Augusta
Parkway, have petitioned Augusta to abandon a portion of the existing easement, the portion in
question being labeled "Easement to be Abandoned ", on a plat prepared by Cranston
Engineering Group, P. C., dated April 20, 2004, revised April 29, 2004, June 1, 2010, and
November 22, 2010, attached hereto and made a part hereof, to which reference is made for a
more accurate and complete description of the metes, bounds and courses; and
WHEREAS, the Augusta- Richmond County Commission has determined it is in the best
interest of Augusta to grant said petition, contingent upon a new (replacement) easement being
deeded to Augusta; and
WHEREAS, James and Cynthia Franklin have agreed to Deed a new easement to
Augusta, the new easement being labeled "New 20' Sanitary Sewer Easement 3 ", on the
Cranston plat referenced above; and
WHEREAS, the Easement Deed for the new easement has been signed by James and
Cynthia Franklin and delivered to Augusta; and
WHEREAS, Augusta- Richmond County Commission has further determined that it is in
the best interest of Augusta to approve and accept the new Easement Deed; and
WHEREAS, it is necessary and appropriate for a resolution to be adopted authorizing
the Mayor and the Clerk of Commission execute the acceptance of the new Easement Deed;
NOW, THEREFORE, BE IT RESOLVED by the Augusta - Richmond County
Commission,
Section 1: Augusta shall abandon that portion of an existing easement, labeled
"Easement to be Abandoned ", on a plat prepared by Cranston
Engineering Group, P. C., dated April 20, 2004, revised April 29, 2004,
June 1, 1010, and November 22, 2010.
Section 2: Augusta shall accept an Easement Deed for a new replacement
easement labeled "New 20' Sanitary Sewer Easement 3 ", on said
Cranston plat.

Section 3: It being further resolved that the Mayor and Clerk of Commission of
Augusta are hereby authorized to execute such documentation as may
be reasonably required, in form approved by Interim General Counsel of
Augusta to accept such easement.
Section 4: This Resolution shall be recorded in the Minutes of the Augusta-
Richmond County Commission, accompanied by the exhibits referred to
herein.
Duly adopted by the Augusta - Richmond County Commission this 7 day of December ,
2010.
