Plunkett 429 Walker St, Upper Level Augusta, Georgia 30901 STATE OF GEORGIA ) COUNTY OF RICHMOND ) QUIT - CLAIM DEED TO RELEASE REAL ESTATE MORTGAGE THIS INDENTURE, made this // day of November, 2010, between SCHURZ INVESTMENT MANAGEMENT, LLC, whose address is 1301 East Douglas Road, Mishawaka, Indiana 46545, Party of the First Part, and AUGUSTA, GEORGIA, a political subdivision of the State of Georgia, Party of the Second Part, WITNESSETH: That the said Party of the First Part, for and in consideration of the sum of ONE ($1.00) DOLLAR, and other good and valuable consideration in hand paid, the receipt whereof is acknowledged, has bargained, sold, and does by these presents bargain, sell, remise, release and forever QUIT -CLAIM to the said Party of the Second Part, its successors and assigns, all the right, title, interest, claim, or demand which the Party of the First Part has or may have in and to the following described property to wit: All that lot of land, together with improvements thereon, situate, lying and being in the City of Augusta, Richmond County, Georgia, between Reynolds Street and Jones Street being in the Northwest comer of Campbell (9 Street, and Jones Street and fronting 52.4 feet more or less on Campbell Street, and running back of even width in a westerly direction 80.5 feet more or less and then a width of 72.3 feet for 135 feet more or less to property now or formerly of Bertram, R.J., and G. C. Said property is known as 901 -911 Jones Street under the present system of street numbering in effect for the City of Augusta. A plat of the property herein conveyed is attached to a deed from C.C. Johnson, Jr., et al to Charles W. Bowen, Jr. and Dudley H. Bowen, dated September 24, 1942, and recorded in the Clerk's Office of said County in Realty Book 14 -S, pages 439 -440. The property herein conveyed begins at a point 52.4 feet more or less North of the Bowen, formerly C. C. Johnson, Jr. building property line on the Northwest corner of Campbell and Jones Streets and runs thence along Campbell Street in a general southerly direction 52.4 feet more or less, thence runs along Jones Street in a general westerly direction 215.5 feet more or less, thence in a general northerly direction 72.3 feet more or less, thence in a general easterly direction 135 feet more or less, thence in a general southerly direction 20 feet more or less, thence in a general easterly direction 80.5 feet more or less to the point of beginning. The purpose of this quit claim deed is to release the above described property from that certain Real Estate Mortgage (the "Security Deed ") dated October 1, 2002 from WAGT, Inc. to Schurz Investment Management, LLC and recorded September 24, 2003 in the Office of the Clerk of the Superior Court of Richmond County, Georgia in Deed Book 887, page 534. The Security Deed shall remain in full force and effect as to all of the property therein described, less and except the property released hereby and any property heretofore released, if any. TOGETHER WITH all the rights, members and appurtenances to the said described Property in anywise appertaining or belonging. TO HAVE AND TO HOLD the said described premises to the said Party of the Second Part, so that neither the said Party of the First Part nor its successors and assigns, nor any other person or persons claiming under it shall at any time, by any means or ways, have, claim or demand any right or title to the aforesaid described Property or its appurtenances, or any rights thereof. -2- .
