RESOLUTION
ABANDONING A PORTION OF ALLEY TO
FATSVILLE ENTERPRISES, INC. AND
AUTHORIZING CONVEYANCE
WHEREAS, the Augusta-Richmond County Commission resolved
by Resolution dated November 19, 1996, that the two sections of an
alley located directly behind property located at Tax Map 45-2,
Parcel 342 and 344, as shown on a plat for Usry Land Company by
W.R. Toole Engineers, Inc., dated September 25, 1996, has ceased to
be used by the public to the extent that no substantial public
purpose is served by it;
WHEREAS, the adjoining property owners to the property
described above have been notified of the August 6,
1996
Resolution, and the request for abandonment; notice of the
Resolution has been published in the Augusta Chronicle once a week
for a period of two weeks, and a public hearing on the proposed
abandonment was conducted on March 31, 1997, with no objection
being raised as to the abandonment of one section of alley directly
behind property located at Tax, Map 45-2, Parcel 344;
WHEREAS, by virtue. of the events set forth above, the
property identified as one portion of alley directly behind
property located at Tax Map 45-2, Parcel 344 is deemed abandoned
and no longer a part of the Richmond- County road system;

WHEREAS, notice has been given to the owners of abutting
land holding title through the owner from whom Augusta-Richmond
County acquired the property of said owner's right to acquire the
land described above;
WHEREAS, Fatsville Enterprises, Inc. has communicated its
desire to exercise its right to acquire the above described
property at a price to be agreed upon; and
WHEREAS, the property in question has been appraised at
a value of $950.00 by appraiser Jack L. Minor, an appraisal
prepared at the request of Augusta-Richmond County and dated March
24, 1997;
NOW, THEREFORE, it is hereby resolved as follows:
1. It is hereby determined that all requirements of
Georgia law for the abandonment of a county roadway have been met
and that the section of alley referred to in the Augusta-Richmond
County Commission's November 19, 1996, Resolution, and described as
one section of alley directly behind property located at Tax Map
45-2, Parcel 344, is no longer a part of the Richmond County road
system.
2. Fatsville Enterprises, Inc. has properly exercised
its right to purchase the property described above.
3. It is further determined that upon receipt of $950.00
from Fatsville Enterprises, Inc., the Mayor of the Augusta-Richmond

County Commission, as successor to the Richmond Cohnty Board of
Commissioners, shall execute a Quit-Claim Deed and such other
documentation as may reasonably be required, in forms approved by
the County Attorney, conveying all of Richmond County.s interest ln
the property, which interest is subject to all easements of record
for utilities, to Fatsville Enterprises, Inc. All proceeds arising
from this sale shall be paid into and constitute a part of the
funds of Augusta-Richmond County.
This Resolut~on shall be recorded in the Minutes of the
Augusta-Richmond County Commission, accompanied by the exhibits
referred to herein.
