RESOLUTION
FINDING THE AUGUSTA AVENUE TRACT AS HAVING
CEASED TO BE USED FOR PUBLIC PURPOSES AND FOR
ABANDONMENT OF SAME
WHEREAS, the Augusta-Richmond County Commission resolved by Resolution
dated December 19, 2006, that the following street in Richmond County, Georgia, has
ceased to be used by the public to the extent that no substantial public purpose is served
by it: a 0.07 acre tract of Augusta Avenue, measuring 23.24 feet by 140.69 feet, being
designated as the "Augusta Avenue Tract," and as shown on the plat attached hereto as
Exhibit A;
WHEREAS, there is only one adjoining property owner, identified as Macuch
Steel Products, Inc., and that adjoining property owner has been notified of the December
19, 2006 Resolution; notice of the proposed abandonment has been published in the
Augusta Chronicle once a week for a period of two weeks; and, a public hearing on the
proposed abandonment has been conducted on February 12, 2007, with no objections
being raised as to the abandonment of the Augusta Avenue Tract;
WHEREAS, by virtue of the events set forth above, the property identified as the
Augusta A venue Tract, as shown on the attached plat, is deemed abandoned and no
longer a part of the Richmond County road system;
WHEREAS, pursuant to O.C.G.A S 32-7-4, notice has been given to the abutting
land owner of its right to acquire the land described above; and
WHERES, the adjoining property owner has communicated its desire to exercise
its right to acquire the Augusta A venue Tract;
NOW, THEREFORE, it is hereby resolved as follows:
1. It is hereby determined that all requirements of Georgia law for the
abandonment of a county roadway have been met and that the street referred to in the
Augusta-Richmond County Commission's December 19, 2006 Resolution, and described
as a tract measuring 23.24 feet by 140.69 feet, and as shown on the map attached as
Exhibit "A", is no longer a part ofthe Richmond County Road System.
2. The adjoining property owner has properly exercised its right to acquire
the property described above for its payment to Augusta, Georgia, of One Thousand
Dollars and 00/1 00 ($1,000.00).
3. It is further determined that the Mayor of Augusta, Georgia, shall execute
a Quit-Claim Deed and such other documentation as may reasonably be required, in
forms approved by the County Attorney, conveying all of Augusta, Georgia's interest in
the property to the adjoining property owner, which interest is subject to all easements of
record for utilities.
This Resolution shall be recorded in the Minutes of the Augusta-Richmond
County Commission, accompanied by the exhibit referred to herein.
Duly adopted by the Augusta-Richmond County Commission, Georgia this 15th
day of May, 2007.
