HomeMy WebLinkAboutRequest for Abandonment Augusta Richmond GA DOCUMENTNAME Xequ61 lor a bo.ncJon /'l'\Q,1'\- t DOCUMENTTYPE: 'PvZ5D I U +--I;n YEAR: 1 ~ 0{P BOX NUMBER: ;:2., FILE NUMBER: )!2 9J..D NUMBER OF PAGES: 3 ~ , RESOLUTION WHEREAS, the Augusta-Richmond County Commission resolved by Resolution dated August 20, 1996, that the fifteen foot alley between Parcels 297 and 299 on Map Sheet 45.02, has ceased to be used by the public to the extent that no substantial public purpose is served by it; WHEREAS, the adjoining property owners to the property described above have been notified of the August 20, 1996 Resolution, and the request for abandonment; notice of the Resolution has been published in the Augusta Chronicle once a week for a period of two weeks, and a public hearing on the proposed abandonment was conducted on October 23, 1996, with no objections being made; WHEREAS, by virtue of the events set forth above, the above identified property is deemed abandoned and no longer a part of the Augusta-Richmond County road system; WHEREAS, notice has been given to the owner of abutting land holding title through the owner from whom Richmond County acquired the property of said owner's right to acquire the .--~ property; WHEREAS, the property in question has been appraised at a value of $1.25 per square foot by appraiser Jack L. Minor, in an appraisal prepared at the request of Augusta-Richmond County, Georgia which is dated September 19, 1996; and ~ WHEREAS, said owner(s) Maurice Steinberg, James C. Cullum, Helen Owings have communicated their desire to exercise their rights to acquire the portions of the alleyway adjoining their property in the following dimensions: 7.5 feet x 85.1 feet, plus 15 feet x 77.8 feet, or a total of 1805.25 square feet, at the price of $1.25 per square foot for a total price of $2,256.56; and WHEREAS, said owner Boardman Petroleum has communicated its desire to exercise its rights to acquire 7.5 feet x 85.59 feet of the alleyway, or 641.93 square feet, at the price of $1.25 per square foot for a total price of $802.41. NOW, THEREFORE, it is hereby resolved as follows: 1. It is hereby determined that all requirements of Georgia law for the abandonment of a county roadway have been met and that the fifteen foot alleyway referred to in the Commission's August 20, 1996 Resolution and described above is no longer a part of the Richmond County road system. 2. Maurice Steinberg, James C. Cullum, Helen Owings and Boardman Petroleum have properly exercised their rights to purchase the property described above. 3. It is further determined that upon receipt of $2,256.56 from owners Maurice Steinberg, James C. Cullum and Helen Owings, and the receipt of $802.41 from Boardman Petroleum, the Mayor of Augusta-Richmond County and the Augusta-Richmond County ~ ~ ~ Administrator shall execute a Quit-Claim Deed and such other documentation as may reasonably be required, in forms approved by the County Attorney, conveying all of Augusta-Richmond County's interest in the property, which interest is subject to all easements of record for utilities, to Maurice Steinberg, James C. Cullum and Helen Owings, and Boardman Petroleum, respectively. All proceeds arising from this sale shall be paid into and constitute a part of the funds of Augusta-Richmond County. This Resolution shall be recorded on the Minutes of the Augusta-Richmond County Commission. Duly adopted by the Augusta-Richmond County Commission, this /~day of December, 1996. COMMISSION By:
