RESOLUTION
A RESOLUTION AUTHORIZING
RESTRICTION ON ACCESS TO
FRONTING ON TOBACCO ROAD.
RELEASE OF
PROPERTIES
WHEREAS, ln the acquisition of the rights -of -way for
improvements
to
Tobacco
Road
in
1991,
a
Department
of
Transportation right-of-way deed which contained a restriction on
rights of access was utilized to acquire property rights, with such
deeds arguably indicating that Tobacco Road is a limited access
highway; and
WHEREAS, it was not intended for Tobacco Road to be a
limited access highway; and
WHEREAS, property owners are having to bring to the
Commission requests for release of the access restriction contained
in said deeds upon conveyance of the property; and
WHEREAS, Public Works has determined that there should be
no restriction on access along that portion of Tobacco Road
included in DOT Project No. FR-207-2(3); and
WHEREAS, it is the desire of the Augusta-Richmond County
Commission to authorize the Mayor and Clerk to execute such
instruments as are approved by the City Attorney to release the
restriction on access, without the necessity of bringing each
individual property before the Commission;

NOW, THEREFORE, BE IT RESOLVED BY THE AUGUSTA-RICHMOND
COUNTY COMMISSION that the Mayor and Clerk are authorized to
execute such instruments as are deemed appropriate by the City
Attorney to release the restriction on access contained in right-
of-way deeds utilized in acquiring rights-of-way for the Tobacco
Road Project No. FR-207-2(3).
