A RESOLUTION OF THE AUGUST A-RICHMOND COUNTY COMMISSION, ALSO
KNOWN AS THE AUGUSTA COMMISSION, THE GOVERNING AUTHORITY OF
AUGUSTA, GEORGIA, ALSO KNOWN AS AUGUST A-RICHMOND COUNTY,
GEORGIA, A POLITICAL SUBDIVISION OF THE STATE OF GEORGIA BEING A
CONSOLIDATED COUNTY AND MUNICIPAL GOVERNMENT, TO REGULATE
AND PROVIDE FOR THE CALLING OF AN ELECTION TO DETERMINE THE
QUESTION OF RE-IMPOSITION EFFECTIVE JANUARY 1, 2006 OF A SPECIAL
DISTRICT l' AX IN A SPECIAL DISTRICT CORRESPONDING TO AND CO-
TERMINUS WITH THE LIMITS OF RICHMOND COUNTY, GEORGIA AS A ONE
PERCENT (1%) SALES AND USE TAX WITHIN SAID SPECIAL TAX DISTRICT; TO
PROVIDE FOR THE MAXIMUM AMOUNT OF NET REVENUE THAT IS TO BE
RAISED BY SAID TAX, TO WIT: $486,000,000.00; TO SEGREGATE THE
AUTHORIZA TION OF THE ONE PERCENT SALES AND USE TAX INTO FOUR
BALLOT QUESTIONS AND IF SO AUTHORIZED WITH RESPECT TO ANY
QUESTION io DESIGNA TE THE PURPOSES FOR WHICH THE PROCEEDS
RECEIVED FROM SUCH TAX SHALL BE USED, TO WIT: CAPITAL OUTLAY
PROJECTS FOR PUBLIC FACILITIES FOR THE USE AND BENEFIT OF THE
CITIZENS OF THE ENTIRE COUNTY CONSISTING OF A COUNTY COURTHOUSE,
ADMINISTRATIVE BUILDINGS, COUNTY LIBRARY, COUNTY JAIL, WHICH
SHALL INCLUDE NEW CONSTRUCTION AND IMPROVEMENTS TO EXISTING
COUNTY BUILDINGS AND FACILITIES AND APPURTENANT CAPITAL OUTLAYS
AS IS DEFINED IN O.C.G.A. 48-8-110; CAPITAL OUTLAY PROJECTS FOR
INFRASTRUCTURE AND EQUIPMENT FOR PUBLIC WORKS, TO INCLUDE ROAD,
STREET, AND BRIDGE IMPROVEMENTS FOR THE USE OF OR BENEFIT OF THE
CITIZENS OF RICHMOND COUNTY TO BE OWNED AND OPERATED OR BOTH
BY AUGUSTA, GEORGIA; CAPITAL OUTLAY PROJECTS TO IMPROVE THE
QUALITY OF LIFE IN AUGUSTA-RICHMOND COUNTY CONSISTING OF
RECREATIONAL, CULTURAL AND mSTORIC FACILITIES; CAPITAL OUTLAY
PROJECTS FOR COMMUNITY PROJECTS AND AGENCIES IN AUGUSTA-
RICHMOND COUNTY FOR ELIGIBLE FACILITIES; AND CAPITAL OUTLAY
PROJECTS TO BE OWNED AND OPERATED OR BOTH EITHER BY AUGUSTA,
GEORGIA, THE CITY OF HEPHZIBAH AND THE CITY OF BLYTHE IN RESPECT
TO WHICH AUGUSTA, GEORGIA HAS ON THE 2nd DAY OF SEPTEMBER, 2004
ENTERED INTO AN INTER-GOVERNMENTAL CONTRACT OR AGREEMENT AS
AUTHORIZED IN ARTICLE IX, SECTION III, OF THE CONSTITUTION OF THE
STATE OF GEORGIA FOR THE CONSTRUCTION OF ELIGIBLE EXPENDITURE
PROJECTS AS THE SAME ARE SET FORTH IN SAID INTER-GOVERNMENTAL
AGREEMENT; TO PROVIDE IN EACH BALLOT QUESTION THAT IF IMPOSITION
OF THE TAX IS APPROVED BY THE VOTERS, SUCH VOTE SHALL ALSO
CONSTITUTE APPROVAL OF THE ISSUANCE OF GENERAL OBLIGATION DEBT I
OF AUGUSTA, GEORGIA IN THE PRINCIPAL AMOUNT FOR THE PURPOSES SET

FORTH IN THE RELATED BALLOT QUESTION; TO PROVIDE FOR THE
SUBMISSION TO THE QUALIFIED VOTERS WITHIN RICHMOND COUNTY THE
QUESTION OF WHETHER OR NOT SUCH SPECIAL DISTRICT TAX SHALL BE
IMPOSED FOR SUCH PURPOSES; TO APPROVE THE FORM OF THE QUESTIONS
ON THE BALLOT TO BE USED IN SUCH ELECTIONS; TO PROVIDE FOR AN
AUDIT OF SAID PROJECTS; TO PROVIDE FOR AN ANNUAL REPORT FOR THE
PROJECTS AUTHORIZED BY THIS RESOLUTION AND FOR REPORTS ON ALL
SPECIAL PURPOSE LOCAL OPTION SALES TAX PROJECTS PREVIOUSL Y
APPROVED BY THE AUGUSTA COMMISSION ON BEHALF OF AUGUSTA-
RICHMOND COUNTY AND THE BOARD OF COMMISSIONERS OF RICHMOND
COUNTY, GEORGIA ON BEHALF OF THE CITIZENS OF RICHMOND COUNTY,
GEORGIA FOR ALL PREVIOUS PHASES OF THE SPECIAL PURPOSE LOCAL
OPTION SALES TAX PROGRAM; TO PROVIDE FOR THE NOTICE OF SUCH
ELECTION; AND FOR OTHER PURPOSES.

RECIT ALS
WHEREAS, the General Assembly of Georgia pursuant to the provisions of Title 48,
Chapter 8, Article 3 of the Code of Georgia, O. C. G.A. 48-8-110, effective July 1, 2004
authorizes the governing authority of any county in the state to impose within the county a
special district county one per cent (1 %) sales and use tax to raise in conjunction with the
issuance of general obligation debt under certain terms and conditions as provided in said statute
and in this resolution; and
WHEREAS, pursuant to an act of the General Assembly of the State of Georgia (Ga.
Laws 1995, page 3648), Richmond County, Georgia (the "County") as consolidated with the City
Council of Augusta (the City of Augusta) and has formed a consolidated political entity which
has succeeded to the powers of said municipality and said county; and
WHEREAS, pursuant to an act of the General Assembly of the State of Georgia (Ga.
Laws 1997, page 4024), such consolidated political entity has been designated as "Augusta,
Georgia" a body politic and corporate and a political subdivision of the State of Georgia having
all of the governmental and corporate powers, duties and functions previously held by and
invested in the City Council of Augusta, Georgia and the County, and such consolidated political
entity is governed by the Augusta-Richmond CoUnty Commission (the "Augusta Commission"),
and;
WHEREAS, the Augusta-Richmond County Commission has determined that there
exists necessary and essential projects for:
A. Capital outlay projects for PUBLIC FACILITIES for the use and benefit of the
citizens of the entire county consisting of a county courthouse, administrative buildings, county
library, county jail, which shall include new construction and improvements to existing county
buildings and facilities and appurtenant capital outlays as is defined in O.C.G.A. 48-8-110, as
shown on Exhibit A which is attached hereto and incorporated herein by reference;
B. Capital outlay projects for INFRASTRUCTURE AND EQUIPMENT for Public
Works to include, but not limited to, road, street and bridge improvements for the use of or
benefit of the citizens of Richmond County to be owned and operated or both by Augusta,
Georgia. See Exhibit B which is attached hereto and incorporated herein by reference;
C. Capital outlay projects TO IMPROVE THE QUALITY OF LIFE in Augusta-
Richmond County consisting of recreational, cultural and historic facilities as set forth on the list
attached hereto as Exhibit C and incorporated herein by reference;
D. Capital outlay projects for COMMUNITY PROJECTS AND AGENCIES in
Augusta-Richmond County for eligible facilities as set forth on the list attached hereto as Exhibit
D and incorporated herein by reference; and
E. Capital outlay projects to be owned and operated or both either by Augusta,
Georgia, the City of Hephzibah and the City of Blythe in respect to which Augusta, Georgia has

on September 2, 2004 entered into an INTER-GOVERNMENTAL CONTRACT OR
AGREEMENT as authorized in Article IX, Section III, of the Constitution of the State of
Georgia for the construction of eligible expenditure projects as the same are set forth in said
inter-governmental agreement, a copy of which is attached hereto as Exhibit E and incorporated
herein by reference; and
WHEREAS, the Augusta-Richmond County Commission has determined that
substantial revenues would be generated within Richmond County from the revenue of such
county special purpose one per cent (1 %) sales and use tax; and
WHEREAS, the Augusta-Richmond County Commission has determined that the most
feasible plan to finance the cost of the undertakings now contemplated for:
A. Capital outlay projects for PUBLIC FACILITIES for the use and benefit of the
citizens of the entire county consisting of a county courthouse, administrative buildings, county
library, county jail, which shall include new construction and improvements to existing county
buildings and facilities and appurtenant capital outlays as is defined in O.C.G.A. 48-8-110, as
shown on Exhibit A which is attached hereto and incorporated herein by reference;
B. Capital outlay projects for INFRASTRUCTURE AND EQUIPMENT for Public
Safety to include, but not limited to, road, street and bridge improvements for the use the of or
benefit of the citizens of Richmond County to be owned and operated or both by Augusta,
Georgia. See Exhibit B which is attached hereto and incorporated herein by reference;
C. Capital outlay projects TO IMPROVE THE QUALITY OF LIFE in Augusta-
Richmond County consisting of recreational, cultural and historic facilities as set forth on the list
attached hereto as Exhibit C and incorporated herein by reference;
D. Capital outlay project for COMMUNITY PROJECTS AND AGENCIES in
Augusta-Richmond County for eligible facilities as set forth on the list attached hereto as Exhibit
D and incorporated herein by reference; and
E. Capital outlay projects to be owned and operated or both either by Augusta,
Georgia, the City of Hephzibah and the City of Blythe in respect to which Augusta, Georgia has
on September 2, 2004 entered into an INTER-GOVERNMENTAL CONTRACT OR
AGREEMENT as authorized in Article IX, Section III, of the Constitution of the State of
Georgia for the construction of eligible expenditure projects as the same are set forth in said
inter-governmental agreement, a copy of which is attached hereto as Exhibit E and incorporated
herein by reference; and
is by the imposition of this tax and the debt issued in conjunction herewith as authorized under
Title 48, Chapter 8, Article 3 of the Code of Georgia; and
WHEREAS, pursuant to the authority given before-cited for the establishment of a
special district county 1 percent sales and use tax it is necessary to submit to the qualified voters

of the county for their determination the question of whether or not such special county 1 percent
sales and use tax shall be imposed for the aforesaid purposes;
NOW THEREFORE BE IT RESOLVED by the Augusta-Richmond County
Commission and it is hereby resolved by the authority of same, that subject to the referenda
hereinafter referred to, special district county 1 percent sales and use tax ("Tax") is authorized to
be and the same is hereby imposed within Richmond County from January 1, 2006 and
continuing thereafter until net revenues of $486,000,000 or such lesser amount as approved by
voters have been raised with the tax herein imposed terminating in that calendar quarter when
said revenues are realized as provided in O.C.G.A. 48-8-12.
BE IT FURTHER RESOLVED by the authority aforesaid and is hereby resolved by
authority of the same that the purposes for which the proceeds of the tax are to be used will
include projects within the following categories:
A. Capital outlay projects for PUBLIC FACILITIES for the use and benefit of the
citizens of the entire county consisting of a county courthouse, administrative buildings, county
library, county jail, which shall include new construction and improvements to existing county
buildings and facilities and appurtenant capital outlays as is defined in O.c.G.A. 48-8-110, as
shown on Exhibit A which is attached hereto and incorporated herein by reference;
B. Capital outlay projects for INFRASTRUCTURE AND EQUIPMENT for Public
Works to include, but not limited to, road, street, and bridge improvements for the use of or
benefit of the citizens of Richmond County to be owned and operated or both by Augusta,
Georgia. See Exhibit B which is attached hereto and incorporated herein by reference;
C. Capital outlay projects TO IMPROVE THE QUALITY OF LIFE in Augusta-
Richmond County consisting of recreational, cultural and historic facilities as set forth on the list
attached hereto as Exhibit C and incorporated herein by reference;
D. Capital outlay projects for COMMUNITY PROJECTS AND AGENCIES in
Augusta-Richmond County for eligible facilities as set forth on the list attached hereto as Exhibit
D and incorporated herein by reference; and
E. Capital outlay projects to be owned and operated or both either by Augusta,
Georgia, the City of Hephzibah and the City of Blythe in respect to which Augusta, Georgia has
on September 2, 2004 entered into an INTER-GOVERNMENTAL CONTRACT OR
AGREEMENT as authorized in Article IX, Section III, of the Constitution of the State of
Georgia for the construction of eligible expenditure projects as the same are set forth in said
inter-governmental agreement, a copy of which is attached hereto as Exhibit E and incorporated
herein by reference.
The specific projects within the categories of purposes hereinbefore set forth in capital
project list adopted in final form by the Augusta-Richmond County Commission on September
2, 2004 and incorporated herein as Exhibits A, B, C, and D show the estimated maximum cost I
based on the estimated costs set forth in the list. The total amount of proceeds of the tax to be

spent on the projects in each of the categories of purposes as set forth above shall be in the total
amount specified in each category. However use of tax proceeds to pay costs of projects may be
shifted between projects as needs dictate and as the Augusta-Richmond County Commission in
its discretion shall determine. If not all of the tax proceeds allocated to a particular category are
expended for the completion of projects in that category, such surplus funds may be transferred
for use on projects in one or more of the other categories as the Augusta-Richmond County
Commission in its discretion shall determined. It is expressly provided, however, that the net
proceeds of the Tax received in any year shall not be used for any purpose until all debt service
requirements of the general obligation debt for that year has been first satisfied from the account
in which the proceeds of the Tax are placed.
The projects are proposed to be built over that period of time commencing on January 1,
2006 and extending thereafter until net revenues of the tax equal $486,000,000, or such lesser
amount as approved by the voters. Said net revenues may be used and applied by Augusta,
Georgia to finance the projects set forth herein in cash and/or by general obligation debt issued in
conjunction with this Phase V Special Purpose Local Option Sales Tax.
Conditions may change making a proposed project no longer feasible or increasing the
cost thereof to an amount exceeding the funds available. In any such event the Augusta-
Richmond County Commission may change the size, scope and/or site of such project to make
the project one which is feasible and the costs of which are within the funds available, or
eliminate the project and transfer the funds allocated to other projects within the same category
of projects if funds are needed for the remaining projects within such category and if not to
projects in one are more of the other categories.
Augusta-Richmond County shall cause an audit of said projects to be performed and an
annual report made for the projects authorized by this resolution and for all projects previously
approved by the Augusta Commission on behalf of Augusta-Richmond County and the Board of
Commissioners of Richmond County, Georgia on behalf of the citizens of Richmond County,
Georgia for all previous phases of the special purpose local option sales tax program.
Attached hereto and incorporated herein by reference as Exhibit E is the
Intergovernmental Agreement of Augusta, Hephzibah, and Blythe which identifies further capital
outlay projects which are authorized by this Resolution and applicable law.
BE IT FURTHER RESOLVED by the authority aforesaid and is hereby resolved by
authority of the same that the ballot to be used in said election shall have written or printed
thereon substantially the following four questions with respect to the approval of the special
purpose 1 percent sales and use tax:
QUESTION ONE
( ) YES
Shall a special I percent sales and use tax be imposed in the special district of
Richmond County for the raising of not more than $352,648,465 for the
purpose of constructing under authority of a certain Resolution of the Augusta
Commission adopted September 2, 2004 the following: (a) Capital outlay

the entire county consisting of a county courthouse, administrative buildings,
county library, county jail, which shall include new construction and
improvements to existing county buildings and facilities and appurtenant
capital outlays; (b) Capital outlay projects for INFRASTRUCTURE AND
EQUIPMENT for Public Works including, but not limited to, roads, street and
bridge improvements; (c) Capital outlay projects TO IMPROVE THE
QUALITY OF LIFE in Augusta-Richmond County consisting of recreational,
cultural and historic facilities, excluding the performing arts theater,
amphitheater and entertainment and sports arena specified in QUESTION
TWO, QUESTION THREE and QUESTION FOUR; (d) Capital outlay
projects for COMMUNITY PROJECTS AND AGENCIES; and (e) Capital
outlay projects to be owned and operated or both either by Augusta-Richmond
County, Georgia, the City of Hephzibah and the City of Blythe in respect to
which Augusta-Richmond County, Georgia has on September 2,2004 entered
into an INTERGOVERNMENTAL CONTRACT OR AGREEMENT as
authorized in Article IX, Section III, of the Constitution of the State of
Georgia; and if imposition of the tax is approved by the voters, such vote shall
also constitute approval of the issuance of general obligation debt of Augusta-
Richmond County in the principal amount of $14,200,000 for public
facilities?
QUESTION TWO
Shall a special 1 percent sales and use tax be imposed in the special district of
Richmond County for the raising of not more than $18,000,000 for the
purpose of constructing under authority of a certain Resolution of the Augusta
Commission adopted September 2, 2004 a capital outlay project consisting of
a performing arts theater?
QUESTION THREE
Shall a special 1 percent sales and use tax be imposed in the special district of
Richmond County for the raising of not more than $33,927,245 for the
purpose of constructing under authority of a certain Resolution of the Augusta
Commission adopted September 2, 2004 a capital outlay project consisting of
an amphitheater at the Diamond Lakes Regional Park; and if imposition of the
tax is approved by the voters, such vote shall also constitute approval of the
issuance of general obligation debt of Augusta-Richmond County in the
principal amount of$24,575,000 for the amphitheater?
QUESTION FOUR
Shall a special 1 percent sales and use tax be imposed in the special district of
Richmond County for the raising of a total of not more than $54,000,000
(representing project costs) plus $27,424,290 (representing not to exceed

financing costs) for the purpose of constructing under authority of a certain
Resolution of the Augusta Commission adopted September 2, 2004 a capital
outlay project consisting of an entertainment and sports arena at the Regency
Mall site; and if imposition of the tax is approved by the voters, such vote
shall also constitute approval of the issuance of general obligation debt of
Augusta-Richmond County in the principal amount of $58,980,000 for the
entertainment and sports arena?
()NO
Notice to Voters: If all of the above questions are approved by the voters,
a total of not more than $486,000,000 ($352,648,465 plus $18,000,000 plus
$33,927,245 plus $81,424,290) will be raised from the special 1 percent
sales and use tax. If QUESTION ONE is not approved by the voters, then
QUESTION TWO, QUESTION THREE and QUESTION FOUR will be
deemed not approved. If QUESTION ONE is approved by the voters,
then the amount to be raised under any approved question shall be
limited to the amount listed in the question approved. In addition, the
City of Hephzibah shall be entitled to receive no more than 1.17 percent
and the City of Blythe shall be entitled to receive no more than .5 percent
of the total amount approved by the voters to be raised by this special
1 percent sales and use tax, which proceeds will be paid from the sales tax
collected under QUESTION ONE.
Voters desiring to vote for the imposition of the special 1 percent sales and use tax (the
"Tax") for the purposes set forth in Question One shall do so by voting "YES" and voters
desiring to vote against the imposition of the Tax for the purposes set forth in Question One shall
do so by voting "NO". Voters desiring to vote for the imposition of the Tax for the purposes set
forth in Question Two shall do so by voting "YES" and voters desiring to vote against the
imposition of the Tax for the purposes set forth in Question Two shall do so by voting "NO".
V oters desiring to vote for the imposition of the Tax for the purposes set forth in Question Three
shall do so by voting "YES" and voters desiring to vote against the imposition of the Tax for the
purposes set forth in Question Three shall do so by voting "NO". If QUESTION ONE is not
approved by the voters, then QUESTION TWO, QUESTION THREE and QUESTION FOUR
will also be deemed to not be approved. If QUESTION ONE is approved by the voters, then the
amount to be raised under any approved question shall be limited to the amount listed in the
question approved. If the voters approve the imposition of the Tax in accordance with this
paragraph, then the Tax shall be imposed for the purposes stated in the questions(s) so approved
beginning January 1, 2006. Otherwise, the Tax shall not be imposed and the question of
imposing the Tax will not again be submitted to the voters of Richmond County, Georgia until
after 12 months immediately following the month in which the election is to be held.
If all three questions are approved by the voters, there will be raised by the special county
1 percent sales and use tax a maximum of $486,000,000 for the purpose of constructing eligible
facilities and improvements under authority of O.c.G.A. 48-8-110 et. seq., and the Resolution.
In addition, the City of Hephzibah shall be entitled to receive no more than 1.17 percent and the
City of Blythe shall be entitled to receive no more than .5 percent of the total amount approved
by the voters to be raised by this special 1 percent sales and use tax, which proceeds will be paid

from the sales tax approved under QUESTION ONE. The levy of the Tax will commence upon
the termination of the special purpose sales and use tax now in effect in Richmond County and
continue for that period of time required to raise the sum of sales tax revenues in the amount of
$486,000,000 (or such lesser amount as approved by the voters) and terminating as provided by
law.
The purposes under QUESTION ONE for which the proceeds of the Tax are to be used
will include the acquisition, construction and equipping of the following:
A. Capital outlay projects for PUBLIC FACILITIES for the use and benefit of the
citizens of the entire county consisting of a county courthouse, administrative buildings,
county library, county jail, which shall include new construction and improvements to
existing county buildings and facilities and appurtenant capital outlays;
B. Capital outlay projects for INFRASTRUCTURE AND EQUIPMENT for Public
Works including, but not limited to, road, street and bridge improvements for the use of
or benefit of the citizens of Richmond County to be owned and operated or both by
Augusta-Richmond County, Georgia;
C. Capital outlay projects TO IMPROVE THE QUALITY OF LIFE in Augusta-
Richmond County consisting of recreational, cultural and historic facilities, excluding the
performing arts theater, the amphitheater and the entertainment and sports arena specified
in QUESTION TWO, QUESTION THREE and QUESTION FOUR;
D. Capital outlay projects for COMMUNITY PROJECTS AND AGENCIES III
Augusta-Richmond County for eligible facilities; and
E. Capital outlay projects to be owned and operated or both either by Augusta-
Richmond County, Georgia, the City of Hephzibah and the City of Blythe in respect to
which Augusta-Richmond County, Georgia has on September 2, 2004 entered into an
INTER-GOVERNMENTAL CONTRACT OR AGREEMENT as authorized in Article
IX, Section III, of the Constitution of the State of Georgia for the construction of eligible
expenditure projects as the same are set forth in said inter-governmental agreement.
If the qualified voters of Augusta, Georgia approve QUESTION ONE such vote shall
constitute approval of the issuance of general obligation debt of Augusta-Richmond County in
the principal amount of$14,200,000 for the purposes set forth in QUESTION ONE.
Such debt, if authorized, shall be dated not later than the issuance and delivery thereof,
bearing interest from date at a rate or rates not exceeding four and three quarter percent (4.75%)
per annum, all interest payable semiannually on January 1 and July 1, and principal maturing on
January 1 in the following years in an amount not to exceed the amounts set forth in the
following table:

The purposes under QUESTION TWO for which the proceeds of the Tax are to be used
~ill include the acquisition, construction and equipping of a performing arts theater.

Notice to Voters: If all of the above questions are approved by the voters,
a total of not more than $486,000,000 ($352,648,465 plus $18,000,000 plus
$33,927,245 plus $81,424,290) will be raised from the special 1 percent
sales and use tax. If QUESTION ONE is not approved by the voters, then
QUESTION TWO, QUESTION THREE and QUESTION FOUR will be
deemed not approved. If QUESTION ONE is approved by the voters,
then the amount to be raised under any approved question shall be
limited to the amount listed in the question approved. In addition, the
City of Blythe shall be entitled to receive no more than .5 percent and the
City of Hephzibah shall be entitled to receive no more than 1.17 percent
of the total amount approved by the voters to be raised by this special
1 percent sales and use tax, which proceeds will be paid from the sales tax

Voters desiring to vote for the imposition of the special 1 percent sales and use tax (the
"Tax") for the purposes set forth in Question One shall do so by voting ''YES'' and voters

do so by voting "NO". Voters desiring to vote for the imposition of the Tax for the purposes set

under any approved question shall be limited to the amount listed in the question approved. If
the voters approve the imposition of the Tax in accordance with this paragraph, then the Tax
shall be imposed for the purposes stated in the questions( s) so approved beginning January 1,
2006. Otherwise, the Tax shall not be imposed and the question of imposing the Tax will not
again be submitted to the voters of Richmond County, Georgia until after 12 months
immediately following the month in which the election is to be held.
If all four questions are approved by the voters, there will be raised by the special county
1 percent sales and use tax a maximum of $486,000,000 for the purpose of constructing eligible
facilities and improvements under authority of O.c.G.A. 48-8-110 et. seq., and the Resolution.
In addition, the City of Hephzibah shall be entitled to receive no more than 1.17 percent and the
City of Blythe shall be entitled to receive no more than .5 percent of the total amount approved
by the voters to be raised by this special 1 percent sales and use tax, which proceeds will be paid
from the sales tax approved under QUESTION ONE. The levy of the Tax will commence on
January 1, 2006 and continue for that period of time required to raise the sum of sales tax
revenues in the amount of $486,000,000 (or such lesser amount as approved by the voters) and
terminating as provided by law.

The specific projects within these categories of purposes set forth in QUESTIONS ONE,
TWO, THREE and FOUR are set forth in a Capital Improvements List, adopted in final form by
the Augusta-Richmond County Commission on September 2, 2004 (the "List"). The estimated
maximum costs set forth above are based on the estimated costs set forth in the List. The total
amount of proceeds of the Tax to be spent on the projects in each of the categories of purposes
set forth above shall be in the total amounts specified for each such category. However, use of
Tax proceeds to pay costs of projects within a category may be shifted between projects within
that category as needs dictate and as the Augusta-Richmond County Commission in its discretion'
shall determine. If not all of the Tax proceeds allocated to a particular category are expended for I
the completion of projects in that category, such surplus funds may be transferred for use on
projects in one or more of the other categories as the Augusta-Richmond County Commission in
its discretion shall determine. It is expressly provided, however, that the net proceeds of the Tax
received in any year shall not be used for any purpose until all debt service requirements of the
general obligation debt for that year has been first satisfied from the account in which the
proceeds of the Tax are placed.

The projects as proposed are to be built over a period of time extending for
approximately twelve and one-half (l2~) years. Conditions may change making a proposed
project no longer feasible or increasing the cost thereof to an amount exceeding the funds
available, in any such event, the Augusta-Richmond County Commission may change the size,
scope and/or site of such project to make the project one which is feasible and the costs of which
are within the funds available or eliminate the project and transfer the funds allocated thereto to
other projects within the same category of projects if funds are needed for the remaining projects
within such category and if not, to proj ects in one or more of the other categories.
The several places for holding said election shall be the regular and established election
districts within the County, and the polls shall be open from 7:00 o'clock A.M. to 7:00 o'clock
P.M. on said date fixed for the election.
Those residents within the County qualified to vote in said election shall be determined in
all respects in accordance with the election laws of the State of Georgia. Anyone desiring to vote
in said referendum who is not a qualified voter of said County must register no later than
October 4, 2004, at any of the approved voter registration sites in Richmond County, Georgia in
order to be eligible to vote. Inquiries regarding voter registration may be directed to the Board of
Elections Office, Room 104, City-County Building, Augusta, Georgia, or by calling (706) 821-
2340.

.INTER-GOVERNMENT AL AGREEMENT FOR DISTRlBUTION OF
.SPECIALPURPOSE LOCAL OPTION SALES TAX V
PROCEEDS BY A1\TD BETWEEN
AUGUSTA-RICHMOND COUNTY, GEORGIA (AUGUSTA, GEORGIA),
. THE CITY OF HEPHZIBAH AND THE CITY OF BL YTRE
WHEREAS, Augusta, Georgia .desires .tore-impose the SPECIAL PURPOSE LOCAL
OPTION SALES TAX (herein after referred to as "SPLOST") effective January 1, 2006 by a
. referendum election to be submitted to the qualified voters of Richmond County on Nqvember 2,
2004; and .
WHEREAS, saidSPLOST is authorized by O.C.G.A. 48-8-110 et. seq. (effective July 1,
2004); and .
WHEREAS, Augusta~Ri61unond County has called a meeting of qualified municipalities.
the Cities ofHephzibah and Blythe, in compliance with O.C.G.A, 48~8-1l1;and
WHEREAS, said meeting was called to order on Au~t 2,2004; and
WHEREAS, the Augusta:..Richmond County Commission has voted to cap the SPLOST
amount at $486,000,000.00; and
NOW THEREFORE, the governing authorities of Augusta~Richmond CotUlty,
Hephzibah and Blythe agree to the following division of the net proceeds of the SPLOST tax for
the funding of capital projects authorized for SPLOST funding:
1. The City of Hephzibah shall have included in said SPLOST project list the
. following projects shown on Exhibit F hereto which is incorporated herein by reference and
which have an esti.m.ated cost of $4,544,000.00; and such additional revenues as may be realized.
2. The City of Blythe shall have included in said SPLOST project list the following
projects See Exhibit E hereto incorporated herein by reference and which have an estimated cost
of$1,900,000,OO; and suoh additional revenues as may be realized,
3. In addition to the funding of the projects hereinbefore enumerated for Hephzibah
and Blythe, Augusta~Richmond County shall be entitled to proceeds of the SPLOST V
(estimated to be $477,883;800.00).for use in funding its authorized projects shown on Exhibit A,
B, C and D hereto, which is incorporated herein by reference; and
(A) Any funds collected in excess of the estimated amounts shall be
distributed according to the percentages specified in this Inter~Governmental Agreement at
. Paragraph 5a(c).

4. Deductions for'the Administrative expenses to said SPLOST shall be paid as
required by law by Hephzibah, Blythe . and Augusta-Richmond County in. proportion to the
amount of gross proceeds to be received by each as herein before set out.
5, Augusta-Richmond County shall make appropriate disbursements to Cities of
Hephzibah and Blythe to fulfill the above listed allocations of tax proceeds in compliance. with
O,C.G.A. 48-S-115(b)(1) and in consideration of the allocation it shall designate for its own
projects and in consideration of the issuance of any general obligation debt issued in connection
with SPLOST V and the appropriate phasing and construction of its capital projects; and
Sa, Pursuant to O,C.G.A. 48-8-115 b(1) Augusti. and the cities of HephZibah and
Blythe do. fu.rther agree as follows:
. (A) The specific capital outlay project or projects to be funded pursuant to this
agreement are for Augusta as described on Exhibits A, B, C and D; for Blythe:
Exhibit E and Hephzibah: ' Exhibit F.
(B) The estimated or projected dollar amounts allocated for each project from tax
.proceeds from the tax authorized by this part are as shown on said Exhibits A, B, C,
D, E and F, which are incorporated herein by reference.
(C) The procedures for distributing proceeds from the tax authorized by the aforesaid
statute shall be administered by Augusta as follows: a 1.17% share of the tax
proceeds shall be distributed to City ofHephzibah; a.5% share to City of Blythe and .
the balance, a 98.33% share to Augusta
(D) Proceeds from the tIP' authorized by this statute to qualified municipalities shall
be distributed monthly. Said municipalities shall schedule the priority or order in
which their projects will be fully or P811:ially funded which projects are described on
the attached Exhibit E for Blythe and Exhibit F for Hephzibah.
(E) All capital outlay projects for each local government inoluded in the agreement
shall be funded from proceeds from the tax authorized by the Special Purpose Local
Option Sales Tax statute except as otherwise provided in the resolution of each local
government that is a party hereto.
(F) Proceeds from the tax authorized by this part shall be maintained in separate
aCcounts and utilized exclusively for the specified purposes set forth in the
respective resolutions of each local government that is a party hereto.
(0) The disposition of any e~cess proceeds shall be in confonnity to O.C,Q,A. 48-
8~ 121 (g)(2),
6. Any and all agreements or other documents ancillary to this Inter-Governmental
Agreement for compliance with the provisions of the SPLOST statute shall be promptly executed
by Augusta~Ricbmond County, Hephzibah and Blythe in order to call and hold the SPLOST V I'
referendum election on November 2,2004.

7. Augusta.Richrnond County and the Cities of Hephzibah and Blythe shall submit

RECITALS
WBEREi)$, the General Assembly of Georgia pursuant to the provisions of Title 48,
Chapter 8, Article'L of the Code of Georgia, O.c.G.A. 48-8-110, effective July 1, 2004 authorizes
the governing authority of any county in the state to impose within the county a special district county
one per cent (1 %) sales and use tax to raise in conjunction with the issuance of general obligation
debt not more than $387,000,000.00 in revenue under certain tenns and conditions as provided in
said statute and in this resolution; and
WHEREAS, pursuant to an act of the General Assembly of the State of Georgi a (GA Laws
1995, page 3648), Richmond County, Georgia (the "County") as consolidated with the City Council
of Augusta (the City of Augusta) and has formed a consolidated political entity which has succeeded
to the powers of said municipality and said county; and
WHEREAS, pursuant to an act of the General Assembly of the State of Georgia (GA. Laws
1997, page 4024), such consolidated political entity has been designated as "Augusta, Georgia" a
body politic and corporate and a political subdivision of the State of Georgia having all of the
governmental and corporate powers, duties and functions previously held by and invested in the City
Council of Augusta, Georgia and the County, and such consolidated political entity is governed by
the Augusta-Richmond County Conunission (the Augusta Commission), and;
WHEREAS, the Augusta-Riclunond County Commission has detennined that there exists
necessary and essential projects for:
A. Capital outlay projects for PUBLIC FACILITIES for the use and benefit of the
citizens of the entire county consisting of a county courthouse, administrative buildings, county
library, county jail. which shall include new construction and improvements to existing county
buildings and facilities and appurtenant capital outlays as is defined in O.C.G.A. 48-8-110, as shown
on Exhibit A which is attached hereto and incorporated herein by reference;
B. Capital outlay projects for INFRASTRUCTURE AND EQUIPMENT for Public
Works to include road, street and bridge improvements for the use of or benefit of the citizens of
Richmond County to be owned and operated or both by Augusta, Georgia, See Exhibit B which is
attached hereto and incorporated herein by reference;
C. Capital outlay projects TO IMPROVE THE QUALITY OF LIFE in Augusta-
Richmond County consisting of recreational, cultural and historic facilities as set forth on the list
attached hereto as Exhibit C and incorporated herein by reference;
D. Capital outlay project for COMMUNITY PROJECTS AND AGENCIES in Augusta-
Richmond County for eligible facilities as set forth on the list attached hereto as Exhibit D and
incorporated herein by reference; and
E. Capital outlay projects to be oWned and operated or both either by Augusta, Georgia,
the City ofHephzibah and the City of Blythe in respecfto which Augusta, Georgia has on the 27th

day of August, 2004 entered into an INTER-GOVERNMENTAL CONTRACT OR AGREEMENT
as authorized in Article IX, Section ill, of the Constitution of the State of Georgia for the
construction of eligible expenditure projects as the same are set forth in said inter -governmental
agreement, a copy of which is attached hereto as Exhibit E and incorporated herein by reference; and
WHEREAS, the Augusta-Richmond County Commission has determined that substantial
revenues would be generated within Ricfunond County from the revenue of such special district
county one per cent (I %) sales and use tax; and
WHEREAS, the Augusta-Ricfunond County Commission has determined that the most
feasible plan to finance the cost of the undertakings now contemplated for:
A Capital outlay projects for PUBLIC FACILITIES for the use and benefit of the
citizens of the entire county consisting of a county courthouse, administrative buildings, county
library, county jail, which shall include new construction and improvements to existing county
buildings and facilities and appurtenant capital outlays as is defined in O.C.G.A 48-8-110, as shown
on Exhibit A which is attached hereto and incorporated herein by reference;
B. Capital outlay projects for INFRASTRUCTURE AND EQUIPMENT for Public
Safety for the use of or benefit ofthe citizens of Richmond County to be owned and operated or both
by Augusta, Georgia. See Exhibit B which is attached hereto and incorporated herein by reference;
C. Capital outlay projects TO IMPROVE THE QUALITY OF LIFE in Augusta-
Richmond County consisting of recreational, cultural and historic facilities as set forth on the list
attached hereto as Exhibit C and incorporated herein by reference;
D. Capital outlay project for COMMUNlTYPROJECTS AND AGENCIES in Augusta-
Richmond County for eligible facilities as set forth on the list attached hereto as Exhibit D and
incorporated herein by reference; and
E. Capital outlay projects to be owned and operated or both either by Augusta, Georgia,
the City ofHephzibah and the City of Blythe in respect to which Augusta, Georgia has on the_
day of August, 2004 entered into an INTER-GOVERNMENTAL CONTRACT OR AGREEMENT
as authorized in Article IX., Section III, of the Constitution of the State of Georgia for the
construction of eligible expenditure projects as the same are set forth in said inter-governmental
agreement, a copy of which is attached hereto as Exhibit E and incorporated herein by reference; and
is by the imposition of this tax and the debt issued in conjunction herewith as authorized under
Title 48, Chapter 8, Article 3 of the Code ofGeorgia~
WHEREAS, pursuant to the authority given before-cited for the establishment of a special
district county 1 percent sales and use tax it is necessary to submit to the qualified voters of the
county for their determination the question of whether or not such special county 1 percent sales and
use tax shall be imposed for the aforesaid purposes;

WHEREAS, the City ofHephzibah wishes to join in the approval and implementation of the
Special Purpose Local Option Sales Tax with approval by the electorate.
NOW THEREFORE, BE IT RESOLVED that the City of Hephzibah joins in the Inter-
government Agreement for Distribution of Special Purpose Local Option Sales Tax Proceeds by and
between Augusta-Richmond County, Georgia (Augusta, Georgia), the City ofHephzibah and City
of Blythe and Commissioner Chairman D. B. Atkins is authorized to sign said agreement on behalf
of the City ofHephzibah, a copy of which is attached hereto, as Exhibit B.
As further; the projects as authorized and prioritized are the projects to receive funding from
the Special Purpose Local Option Sales Tax are incorporated by reference and attached hereto, as
Exhibit A.

INTER-GOVERNMENT AI.. AGREEMENT FOR DISTRIBUTION OF
SPECIAL PURPOSE LOCAL OPTION SALES TAX V
PROCEEDS BY AND BETWEEN
AUGUST A-RICHMOND COUNTY, GEORGIA (AUGUST ~ GEORGIA),
THE CITY OF HEPHZffiAH AND THE CITY OF BLYTHE
WHEREAS, Augusta, Georgia desires to re-impose the SPECIAL PURPOSE LOCAL
OPTION SALES TAX (herein after referred to as "SPLOSTfI) effective January 1, 2006 by a
referendum election to be submitted to the qualified voters of Richmond County on November 2,
2004; and
WHEREAS, said SPLOST is authorized by O.C.G.A. 48-8-110 et. seq. (effective July 1,
2004); and
WHEREAS, Augusta-Richmond County has called a meeting of qualified municipalities, the
Cities ofHephzibah and Blythe, in compliance with O.C.G.A. 48-8-111; and
WHEREAS, said meeting was called to order on August 2,2004; and
WHEREAS, the Augusta-Richmond County Commission has voted to cap the SPLOST
amount at $387,000,000.00; and
NOW THEREFORE, the governing authorities of Augusta-Richmond County, Hephzibah
and Blythe agree to the following division ofthe net proceeds of the SPLOST tax for the funding of
capital projects authorized for SPLOSTfunding:
1. The City ofHephzibah shall have included in said SPLOST project list the following
projects shown on ExhibitF hereto which is incorporated herein by reference and which have an
estimated cost of $4,544,000; and
2. The City of Blythe shall have included in said SPLOST project list the following
projects See Exhibit E hereto incorporated herein by reference and which have an estimated cost of
$1,900,000; and
3. In addition to the funding of the projects hereinbefore enumerated for Hephzibah and
Blythe, Augusta-Richmond County shall be entitled to proceeds of the SPLOST V (estimated to be
$380,000,000) for use in funding its authorized projects shown on Exhibit ~ B, C and D hereto,
which is incorporated herein by reference; and
(A) Any funds collected in excess of the estimated amounts shall be distributed
according to the percentages specified in this Inter-Governmental Agreement at Paragraph 5arQ).

4. Deductions for the Administrative expenses to said SPLOST shall be paid as required
by law by Hephzibah, Blythe and Augusta-Riclunond County in proportion to the amount of gross
proceeds to be received by each as herein before set out.
5. Augusta-Richmond County shall make appropriate disbursements to Cities of
Hephzibah and Blythe to fulfill the above listed allocations of tax proceeds in compliance with
O.C.G.A. 48-8-115(b)(1) and in consideration of the allocation it shall designate for its own projects
and in consideration of the issuance of any general obligation debt issued in connection with SPLOST
V and the appropriate phasing and construction of its capital projects; and
5a. Pursuant to O.C,G.A 48-8-115 bel) Augusta and the cities ofHephzibah and Blythe
do further agree as follows:
(A) The specific capital outlay project or projects to be funded pursuant to tbis
agreement are for Augusta as described on Exhibits A, B, C and D; for Blythe:
Exhibit E and Hephzibah: Exhibit F.
(B) The estimated or projected dollar amounts allocated for each project from tax
proceeds from the tax authorized by this part are as shown on said Exhibits A, B, C,
D, E and F, which are incorporated herein by reference.
(C) The procedures for distributing proceeds from the tax authorized by the aforesaid
statute shall be administered by Augusta as follows: a 1.17% share ofthe tax proceeds
shall be distributed to City of Hephzibah; a .5% share to City of Blythe and the
balance, a 98.33% share to Augusta.
(D) Proceeds from the tax authorized by this statute to qualified municipalities shall
be distributed montWy. Said municipalities shall schedule the priority or order in
which their projects will be fully or partially funded which projects are described on
the attached Exhibit E for Blythe and Exhibit F for Hephzibah.
(E) All capital outlay projects for each local government included in the agreement
shall be funded from proceeds from the tax authorized by the Special Purpose Local
Option Sales Tax statute except as otherwise provided in the resolution of each local
government that is a party hereto.
(F) Proceeds from the tax authorized by this part shall be maintained in separate
accounts and utilized exclusively for the specified purposes set forth in the respective
resolutions of each local government that is a party hereto.
(G) The disposition of any excess proceeds shall be in conformity to O,c.G.A. 48-8-
121 (g)(2).
6. Any and all agreements or other documents ancillary to this Inter-Governmental
Agreement for compliance with the provisions of the SPLOST statute shall be promptly executed by
Augusta-Richmond County, Hephzibah and Blythe in order to call and hold the SPLOST V
referendum election on November 2,2004.

7. Augusta-Richmond County and the Cities ofHephzibah and Blythe shall submit this
agreement for approval by the Augusta Commission and Councils of each said municipality
respectively to comply with the schedule derived from said SPLOST statute for the calling of said
referendum election on November 2, 2004~ and
WHEREFORE, the governing authority of Augusta-Richmond County, Georgia and the cities
of Hephzibah and Blythe have caused this agreement to be executed by the authorized officials of
each said govermnent and have caused the seal of each local government to be affixed hereto this
day of .2004.
