HomeMy WebLinkAboutPENDLETON KING DOG PARK RESOLUTION RESOLUTION RESOLUTION TO APPROVE THE PENDLETON KING DOG PARK; TO APPROVE PENDLETON KING DOG PARK RULES PURSUANT TO AUGUSTA-RICHMOND COUNTY, GEORGIA CODE SECTIONS 4-1-16 AND 4-1-34; TO PROVIDE FOR AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, in 1956 the trustees of the King Family Estate offered the city a $1 per year lease on sixty-four beautiful acres to be used as a city park and bird sanctuary; WHEREAS, this property became Pendleton King Park which is presently maintained by the Augusta Public Services Trees and Landscaping Department, which works closely with the Pendleton King Park Foundation, a private non-profit organization; WHEREAS, the Pendleton King Park Foundation desires to further serve the citizens of Augusta by providing a Dog Park facility for public use and enjoyment of the Pendleton King Park; WHEREAS, Augusta Richmond-County Code Sections 4-1-16, 4-1-21, 4-1-23 and 4-1-34, as modified by Ordinance No. 7041 on April 1, 2008, authorizes the establishment of Dog Parks in Augusta- Richmond County and sets forth rules governing such Dog Parks; ~ WHEREAS, Augusta Richmond-County Code Section 4-1-16 states that a Dog Park is "recognized and operated as a secure place where dogs are allowed to play without a leash, so long as handlers of such dogs comply with Dog Park Rules"; WHEREAS, Augusta Richmond-County Code Section 4-1-34 states that anyone using any Augusta-Richmond County Dog Park "must comply with the Dog Park Rules provided in this code section as well as any other Dog Park Rules posted at a particular Dog Park facility"; WHEREAS, Pendleton King Park has created a Dog Park facility that complies with the Augusta Code regarding Dog Parks and has developed its own Dog Park Rules for use at the Pendleton King Dog Park (such rules are set forth in Exhibit "A"); WHEREAS, the Augusta-Richmond County Commission is in support of outdoor recreational activities and the benefits of having a Dog Park at the Pendleton King Park; NOW, THEREFORE, BE IT RESOLVED by the Augusta-Richmond County Commission that, effective on the date of the passage of this Resolution, the Pendleton King Dog Park is approved as an Augusta-Richmond County Dog Park and the Pendleton King Dog Park Rules (as set forth in Exhibit "A") are approved and are applicable to the Pendleton King Dog Park. Adopted this I -g , day of November, 2008. fi?~~ r- As its Mayor EXHIBIT A Pendleton King Park Dog Park Rules Users ofthe Pendleton King Park Dog Park ("PKP Dog Park") do so at their own risk. Augusta- Richmond County and the Pendleton King Park Foundation Board of Directors disclaim all liability for property damage and injuries caused by and to dogs or individuals at the park. Any person entering the dog park assumes full responsibility for his/her actions inside the dog park, as well as those of his/her dog(s) and anyone entering the dog park under his/her supervision. Usage ofthis dog park constitutes acknowledgement ofthis disclaimer. Communities with established dog parks report that compliance with the rules is the key to success. The success of the PKP Dog Park will largely depend on the self-monitoring and cooperation of the dog owners and handlers. 1. In addition to the Rules listed below, the PKP Dog Park is governed by AUGUSTA, GA CODESS 4-1-16, 4-1-21, 4-1-23 and 4-1-34. 2. The PKP Dog Park is subject to patrol by law enforcement, Animal Services and PKP employees. 3. PKP does not guarantee that the park is escape proof. You assume the risk that your dog may escape the enclosed area. 4. Handlers (individuals bringing a dog to the dog park) and dog owners are jointly and severally liable and personally responsible for all damages and injuries caused by their dogs. 5. Dogs must have current rabies vaccinations and wear current tags. 6. Puppies under four months of age are not permitted in the dog park. 7. Female dogs "in heat" are not permitted in the dog park. 8. All persons entering the park must keep the dog park gates closed at all times. 9. All spike collars must be removed prior to entry into the park. 10. No animals other than dogs are permitted in the dog park. 11. Dogs must be leashed when entering and exiting the dog park. Handlers must carry a leash at all times while in the park. Handlers unleash their dogs at their own risk and may do so only inside the dog park. 12. Handlers must be at least 18 years old. 13. Children under 16 years of age must be accompanied by an adult and the adult is responsible for their safety. Babies and toddlers are not recommended and no strollers are allowed in the park. 14. Children should not run with the dogs or chase them because doing so can be dangerous. 15. Handlers must remain in the dog park, monitor their dog's behavior and stay within view and voice command at all times. 16. Each adult handler may bring or have a maximum of two dogs into the park at the same time. 17. Aggressive dog behavior is not allowed. Any dog exhibiting aggressive behavior toward people and other dogs is to be immediately leashed and removed from the park. 18. Handlers MUST clean up after their dog and properly dispose of waste. Waste stations are available at PKP Dog Park. 19. Handlers must immediately stop their dogs from digging and fill in all holes made by their dog. 20. Handlers are prohibited from allowing dogs over 30 pounds to enter the area of the dog park designated for "Small Dogs". 21. Smoking, alcoholic beverages and glass containers are prohibited in the dog park. 22. Except for small training treats, all food (human and dog) is prohibited. 23. To keep PKP Dog Park clean, the grooming of dogs at the park is prohibited. 24. Handlers are only permitted to use PKP Dog Park during normal hours of operation as posted. The PKP Dog Park is NOT a safe place for children. Therefore, it is strongly urged that small children not be brought into the dog park. The dog park was created as a place for people to enjoy their dogs off-leash. There are very nice new playgrounds available at PKP where children can safely play and socialize. Anyone who fails to comply with these rules is subject to removal and suspension from the dog park and shall also be subject to the penalties provided by AUGUSTA, GA CODE SI-6-1, including imprisonment not exceeding sixty (60) and/or a fine not exceeding $1,000.
