RESOLUTION
FINDING A PORTION OF MONTE SANO EXTENSION AS HAVING CEASED
TO BE USED FOR PUBLIC PURPOSES AND FOR CLOSING OF SAME
WHEREAS, the Augusta-Richmond County Commission has been petitioned by
Westover Cemetery to consider the closing of a portion of Monte Sano Extension, beginning at
its conjunction with Allen Street and running North to its dead end at Westover Street, as shown
on the attached tax map;
WHEREAS, applicable law requires that there be a determination that closure of
a portion of Monte Sano Extension is in the interest of the health and general welfare; and
WHEREAS, the Augusta-Richmond County Commission has determined that
closure of this portion of Monte Sano to public traffic is in the interest of the health and general
welfare of the community in that said street is not used for public traffic, but affords a place for
trash to be deposited and as a potential gathering place;
NOW, THEREFORE, it is hereby resolved as follows:
1. It is hereby determined that the portion of Monte Sano Extension Avenue,
beginning at its conjunction with Allen Street and running North to its dead end
at Westover Street, as set forth on the attached tax map, has ceased to be
used by the public for a street to the extent that no substantial public purpose
is served by it; and
2. The property owners located on that portion of Monte Sano Extension, for
which closure is sought, shall be notified of such determination and request for
closure; notice of such determination of the cessation of public use as a street
and request for closure shall be published in the Augusta Chronicle, the
newspaper in which the Sheriffs advertisements for the County are published
once a week for a period of two weeks; and a public hearing on such issue

shall be conducted, such that a portion of Monte Sano Extension may be
deemed closed; and
3. Thereafter, a portion of Monte Sano Extension, for which closure is sought,
shall be retained by Augusta as a utility right-of-way.
This Resolution and applicable subsequent Resolutions relative to the closure of
a portion of Monte Sano Extension shall be recorded on the minutes of the Augusta-Richmond
County Commission, accompanied by the attached sketch.
