RESOLUTION OF THE BOARD OF COMMISSIONERS
OF RICHMOND COUNTY, GEORGIA TO ABANDON MCCARTHY DRIVE AS A
PART OF THE ROAD SYSTEM OF RICHMOND COUNTY AND TO QUITCLAIM
THE PROPERTY TO THE ADJOINING LANDOWNER
THIS RESOLUTION adopted by the Board of Commissioners of Richmond County,
Georgia (the "Board").
WHEREAS, it has been proposed that the Board make a determination that the 50.5 foot
right-of-way known as McCarthy Drive (hereinafter the "Right-of-Way"), described on Exhibit
A attached hereto, and further described on that right-of-way plat attached hereto as Exhibit "B,"
has ceased to be used by the public to the extent that no substantial public purpose is served by it
and that the Right-of- Way should be abandoned as part of the Richmond County road system;
and
WHEREAS, it has been Richmond County's policy in recent years to try and reduce the
number of roads in Richmond County that are not utilized or useful to the public and to abandon
such roads in order to reduce the maintenance costs that must be borne by Richmond County;
WHEREAS, a public hearing was held before the Board of Commissioners, on
----:5~7' 2008 at J: 'f~ p.m. at Augusta-Richmond County Municipal
Building, Room 803,530 Greene Street, Augusta Georgia; and
WHEREAS, notice of such public hearing was published in The Augusta Chronicle, the
newspaper in which Sheriff s advertisements for Richmond County are published, on August
14, 2008 and August iI, 2008 and that the adjacent property owners received notice of the
public hearing;
WHEREAS, the results of the public hearing were reported to the Board of

Commissioners and considered thereby;

WHEREAS, O.~.G.A. S32-7-4(a)(1) additionally states that if the tract of land from
which a county originallJ acquired the land is subsequently sold, the owner of the adjoining land
shall be entitled to purchlse the land in an amount not to be less than that paid by the county; and
WHEREAS, recbrds reflect that the subject property was donated to Richmond County
subject to a reversionary clause in which ownership of the road is to revert back to the original
grantor's successor in interest upon abandonment of its use as a road;

NOW, THEREFORE, be it resolved by the Board and it is hereby resolved by

the authority of same as follows:

1. The Right-of-Wa~ known as McCarthy Drive shall be abandoned by Richmond County,
Georgia; I'
2. The land formerly comprising the Right-of-Way shall be quitclaimed to the adjoining
I
property owner; and
I
3. This Resolution shall become effective immediately upon its adoption.

EXHIBIT A
DESCRIPTION OF McCARTHY DRIVE
A roadway fronting on the South side of Heath Drive and of the width 50.5 ft. and extending
back between parallelline~ in a Southernly direction, and then in a Southwesternly direction a distance
on its Western boundary olf 453 ft. and on its Eastern boundary a distance of 465.5 ft. The said road is

bounded on the North by Heath Drive; on the West by lots Nos. 1, 2 and 3 of Block "B" of the plat
I
recorded at Realty Book 19 D's, Page 409 in the Office of the Clerk of Superior Court of Richmond
County, Georgia; on the dst by lots Nos. 9,10,11 and 12 of Block "A" of the aforesaid plat; on the
South by J. O. Jones SubdiJision. Said road is known and designated as McCarthy Drive. For a more
specific description as to t~e metes and bounds of said road reference is made to the aforesaid plat of
Berckman Heights Subdivi~ion and by this reference said plat is made a part and parcel of this deed.
