RESOLUTION
RESOLUTION AUTHORIZING THE SETTLEMENT Olf ALL CLAIMS
IN A PERSONAL INURY CLAIM FOR JENNIFER AND BRIAN WOLF,
IN THE AGGREGATE AMOUNT OF $34,473.62; AUTHORIZING THE
COUNTY ADMINISTRATOR TO DISBURSE THE AMOUNT OF
$34,473.62; WAIVING AUGUSTA-RICHMOND COUNTY CODE OF
ORDINANCES SECTIONS IN CONFLICT FOR THIS INSTANCE
ONLY; AND FOR OTHER PURPOSES.
WHEREAS, On August 6, 2007, Sheriff Deputy David James collided with Claimant
Jennifer Wolf in a motor vehicle accident; and
WHEREAS, Claimant was driving her vehicle at the intersection of Eisenhower and
Camelot;
WHEREAS, Sheriff Deputy James failed to see Claimant's vehicle as he entered the
intersection and struck Claimant's vehicle; and
WHEREAS, Claimant's vehicle and the county vehicle were totaled, Claimant's arm was
cut and suffered other permanent injures; .
WHEREAS, Claimant and her husband lost wages, and amassed medical bills as a result
of the accident;
WHEREAS, Claimant has not filed a lawsuit and wants to consider settling her claim
prior to retaining an attorney;
WHEREAS, Claimant has agreed to settle all claims against Sheriff Deputy David James,
Augusta-Richmond County Sheriffs Department and Augusta-Richmond County for the sum of
$34,473.62;
WHEREAS, the General Counsel considers it to be in the best interests of Augusta-
Richmond County to resolve this matter and recorpmends that it pay the amount of $34,473.62 to
Claimant to settle all claims of Claimant against Augusta-Richmond County arising out of the
alleged facts;
WHEREAS, Augusta-Richmond County, Augusta-Richmond County Sheriffs Office,
Sheriffs Deputy David James admit no liability;
NOW, THEREFORE, BE IT RESOLVED by the Augusta-Richmond County
Commission
Section 1: The Augusta-Richmond County Commission will settle the claim of
Jennifer Wolf for the aggregate amount of thirty-four thousand, four
hundred seventy-three dollars and sixty-two cents ($34,473.62).
Section 2:
The County Administrator is authorized to pay a total sum of thirty-four
thousand, four hundred seventy-three dollars and sixty-two cents
($34,473.62) to Jennifer Wolf at the direction of the General Counsel from
the account of 6110152135523273. Payment shall be in the form of a
check payable to Jennifer and Brian Wolf.
Section 3: To the extent that any section of the AUGUSTA CODE IS In conflict
herewith, that subsection is waived for this instance only.

CERTIFICATION
The undersigned Clerk of Commission, Lena J. Bonner, hereby certifies that the
foregoing Resolution was duly adopted by the Augusta-Richmond County Commission on
, 2008 and that such Resolution has not been modified or rescinded as of
the date hereof and the undersigned further certifies that attached hereto is a true copy of the
Resolution which was 'approved and adopted in the foregoing meeting(s).
