RESOLUTION
RESOLUTION IN OPPOSITION OF 2008 GEORGIA HOUSE BILL 938.
WHEREAS, House Bill 938 would amend Title 26 of the Official Code of Georgia
Annotated to provide for substantial limitations on Augusta-Richmond County's authority and
power by regarding a franchise fee as a franchise tax;
WHEREAS, House Bill 938 would provide for substantial limitations on Augusta-
Richmond County's authority and power to grant franchises and collect franchise fees associated
with cable television systems;
WHEREAS, House Bill 938 would unduly burden Augusta-Richmond County by
requiring two public hearings relating to franchise fees and requiring burdensome accounting and
itemization requirements;
WHEREAS, House Bill 938 could substantially reduce Augusta-Richmond County's
ability to collect franchise fees by prohibiting the collection of franchise fees in the base rates of
public utilities;
WHEREAS, it is the desire of the Augusta-Richmond County Commission to continue to
have all of the authority and power provided by Title 26 of the Official Code of Georgia
Annotated; and
WHEREAS, it is the desire of the Augusta-Richmond County Commission to make
known to the Georgia State Legislators and the public, its strong opposition to the passage of
House Bill 938.
NOW, THEREFORE, BE IT RESOLVED by the Augusta-Richmond County
Commission that the passage of Georgia House Bill 938 is strictly opposed by the Augusta-
Richmond County Commission.
