RESOLUTION
WHEREAS, Hart County, Georgia and other counties and municipalities in the State of
Georgia have brought suit against Hotels.com and others similarly situated due to the failure of
said Hotels.com and other hotel reservation agents, to remit to Hart County and others the
appropriate taxes attaching to the procuring of hotel and motel accommodations in the State of
Georgia, namely the Local Option Hotel/Motel sales tax.
NOWTHEREFORE, the Augusta-Richmond County Commission as the governmg
authority for Augusta, Georgia, does hereby express its support for said litigation brought by
Hart County and others and agrees to join as a Plaintiff therein on the condition that it will not be
responsible for any advances of costs or expenses during the prosecution of said litigation and
will not have to pay attorney's fees from its own funds. Provided, however, that counsel for the
Plaintiffs including all counsel for Hart County and other counties and cities finally joined as
Plaintiffs, including Augusta, Georgia will have the opportunity to petition the Court for and
receive an award by the Court of attorney's fees provided the same are paid by the opposing
parties and not a Plaintiff including Augusta, Georgia.
