HomeMy WebLinkAboutCURRAN STREET JWS PROPERTIES INVESTMENT LLC " RESOLUTION FINDING THE ALLEY OFF OF CURRAN STREET AS HAVING CEASED TO BE USED FOR PUBLIC PURPOSES AND FOR ABANDONMENT OF SAME WHEREAS, the Augusta-Richmond County Commission has been petitioned to consider the abandonment of the alley off of Curran Street, a 0.08 acre tract of land beginning approximately 106 feet east of Moore Avenue and running north approximately 197 feet from Curran Street, as shown on the plat attached hereto as Exhibit A; WHEREAS, O.C.G.A. ~ 32-7-2 setting forth the procedure for such abandonment first requires that there be a determination that the alley off Curran Street for which abandonment is sought has, for any reason, ceased to be used by the public to the extent that no substantial public purpose is served by it, and the Augusta-Richmond County Commission has so determined; NOW, THEREFORE, it is hereby resolved as follows: 1. It is hereby determined that the alley off of Curran Street, a 0.08 acre tract of land beginning approximately 106 feet east of Moore Avenue and. running north approximately 197 feet from Curran Street, as shown on the map attached as Exhibit "A", will cease to be used by the public to the extent that no substantial public purpose is served by it; 2. The property owner located on the alley off of Curran Avenue for which abandonment is sought shall be notified of such determination and request for abandonment, pursuant to O.C.G.A. ~ 32-7-2(b)(1); - , 3. Notice of such determination of the proposed cessation of public use and request for abandonment shall be published in the Augusta Chronicle, the newspaper in which the Sheriffs advertisements for the County are published, once a week for a period of two weeks, pursuant to O.C.G.A. ~ 32-7-2(b)(1); and 4. A public hearing on such issue shall be conducted at 10:00 a.m. in the Chambers of the Augusta-Richmond County Commission on December 11, 2006. This Resolution and applicable subsequent Resolutions relative to the abandonment of the alley off of Curran Street, a 0.08 acre tract of land beginning approximately 106 feet east of Moore Avenue and running north approximately 197 feet. from Curran Street, shall be recorded on the minutes of the Augusta-Richmond County Commission, accompanied by the attached map.
