RESOLUTION
WHEREAS, Augusta, Georgia has been requested to grant a Construction and
Maintenance Easement ~o the Department of Transportation for the construction of a road
,
between Davis Road and -20 ramps I & J as shown on the attached plat and colored orange,
which easement will in lude the right to construct and maintain slopes and utilities, as well as
the right to relocate and
slopes and utilities in the easement area.
NOW, THEREF RE, it is hereby resolved that the Mayor is granted the authority to
execute the Departmen of Transportation Construction and Maintenance Easement

Including Utilities.

INCLUDING UTILITIES

THIS CONVEy}\NCE made and executed the3 day Of. 2004.
WHEREAS, the Department of Transportation and Augusta, Georgia, a political
subdivision of the State of Georgia, desire to construct a road between Davis Road and 1-
20 Ramps I & J known as Proiect No. STP 7006(6) Columbia-Richmond; P.I. No.
250560.

NOW, THERE ORE, for value received, Augusta, Georgia, a political
subdivision of the S e of Georgia, does hereby grant to the Department of
Transportation the ri to execute certain construction over and upon the land of
Augusta, Georgia abu . g on and adjacent to the right of way in such manner as said
Department may deem roper to support or accommodate the improvement of said road,
including the right to co truct and maintain any required slopes and utilities, relocated or
added, within the easem t area shown colored orange on the attached plat, dated the IOIh
day of June, 2002; revis February I 1,2004.
THE FOLLOWING ~ARAGRAPH (lSj (IS NOT) APPLICABLE TO THIS
TRANSACTION
Grantor, in addition to the above, hereby expressly grants to the Department of
Transportation, its successors and assigns, the right to demolish and remove in their
entirety all buildings, wllils, fences, gates, signs, or any other improvements or structures
of any nature or descriptlion, lying wholly or partially situated within the easement area,
and the right to enter n the adjacent lands not included in said required easement for
the purpose of removing r demolishing such improvements.
For the same co ideration Augusta, Georgia hereby conveys and relinquishes to
the Department of T rtation all rights of access between the proposed highway and
approaches thereto on e above numbered highway project and its remaining real
property from which sai construction easement is taken as shown on the attached plat
prepared by the Departm t of Transportation.
This Agreement Is to be construed as a Covenant not to sue as well as a full
accord and satisfaction of any and all claims as set out above, and the conveyance
hereunder of all claims or rights shall be deemed to be in perpetuity.
The undersigned lIlereby warrants that it has the right to sell and convey said land
and bind itself, its successors and assigns forever to defend by virtue of these presents.
