WHEREAS, the General Assembly of Georgia, pursuant to the provision of Title 48, Chapter 8, Article 3 of the Code of Georgia, authorized the governing authority of any county in the state to impose within the county a special county one per cent (1 %) sales and use tax for a limited period of time under certain terms and conditions; and . WHEREAS, pursuant to an Act of the General Assembly of the State of Georgia (Ga. Laws 1995, p. 3648), Richmond County, Georgia (the "County") has consolidated with the City of Augusta and has formed a consolidated political entity which has succeeded to the powers of the County; and WHEREAS, pursuant to an Act of the General Assembly of the State of Georgia 1 PROJECT LIST 08/07/00-SPECIFIC C_ATEGORIES . i . .~ J 08/07/00 (Ga. Laws 1997, p. 4024), such consolidated political entity has been designated as "Augusta, Georgia," a body politic and corporate, and political subdivision of the State of Georgia, having all of the governmental and corporate powers, duties and functions previously held by and vested in the City of Augusta, Georgia and the County, and such consolidated political entity is governed by the Augusta-Richmond County Commission; and WHEREAS, the Augusta-Richmond County Commission has determined that there exists necessary and essential projects for road, street and bridge purposes, and surface water drainage related thereto; for capital outlay projects for the use of and benefit of the citizens of the entire county consisting of a county courthouse administrative buildings, a county jail, library buildings and major equipment and capital improvements related thereto; for capital outlay projects which will be for the use of or benefit the citizens within Richmond County; for capital outlay projects to be owned and operated or both either by Augusta, Georgia or one or more municipalities in Richmond County to which Augusta, Georgia has previously entered into a contract or agreement; for capital outlay projects consisting of recreational, cultural, and historic facilities; and for capital outlay projects consisting of public safety facilities and related capital equipment; and WHEREAS, the Augusta-Richmond County Commission has determined that substantial revenues would be generated within Richmond County from the levy of such special county one per cent (1 %) sales and use tax; and WHEREAS, the Augusta-Richmond County Commission has detem1ined that the most feasible plan to finance the cost of the undertaking now contemplated for road, street and bridge purposes, and surface water drainage related thereto; for capital outlay projects for the use of and benefit of the citizens of the entire county consisting of a county courthouse administrative buildings, a county jail, library buildings and major equipment and capital improvements related thereto; for capital outlay projects which will be for the use of or benefit of the citizens within Richmond County; for capital outlay projects to be owned and operated or both either by Augusta, Georgia or the City of Hephzibah or the City of Blythe with which Augusta, Georgia has previously entered into a contract or agreement; for capital outlay projects consisting of recreational, cultural, and historic facilities; and for capital outlay projects consisting of public safety facilities and related capital equipment, is by the imposition of a special tax, as authorized under Title 48, Chapter 8, Article 3 of the Code of Georgia, of a county one per cent (1 %) sales and use tax; and WHEREAS, pursuant to the special county one per cent (1 %) sales and use tax, it is necessary to submit to the qualified voters of the county for their detem1ination the question of whether or not such special county one per cent (1 %) sales and use tax shall be imposed for the aforesaid purposes and for the period of time such tax would be imposed. NOW, THEREFORE, BE IT RESOLVED by the Augusta-Richmond County Commission, and it is hereby resolved by the authority of same, that, subject to the referendum hereinafter referred to, the special county one per cent (1 %) sales and use tax ("Tax") to be and the same is hereby imposed within Richmond County from January 1,2001 through December 31, 2005. 2 PROJECT LIST 08/07/00-SPECIFIC C...ATEGORIES . I ,- j 08/07/00 BE IT FURTHER RESOLVED by the authority aforesaid, and it is hereby resolved by the authority of the same, that the purposes for which the proceeds of the tax are to be used will include the following: (a) Road, street and bridge purposes which shall include acquisition of right- of- way for, construction of, and renovation and improvement of, including relocation of utilities for and improvement of surface water drainage from, roads, streets and bridges and an estimated maximum cost for these purposes of$75,873,952.00; (b) Capital outlay proj ects for the use of or benefit of the citizens of the entire County consisting of a County courthouse, administrative buildings, a cow1ty jail, library buildings, which shall include the construction of new facilities and additions to or improvements of the existing County buildings and facilities, and major equipment and capital improvements related thereto with an estimated maximum cost of these purposes of$38,472,448.00; (c) Capital outlay projects for the use of or benefit of the citizens to be owned and operated or both by Augusta, Georgia with an estimated maximum cost of these purposes of $3,752,000.00; (d) Capital outlay projects to be owned and operated or both either by Augusta, Georgia, the City of Hephzibah and the City of Blythe in respect to which Augusta, Georgia has on August 7, 2000 entered into contracts or agreements, as authorized in Article IX, Section III of the Constitution of the State of Georgia, for the construction of water and sewer, transportation and related storm drainage improvements, recreation, cultural, historical, administrative and public safety facilities with an estimated maximum cost of these purposes of $1 ,698,200.00; ( e) Capital outlay projects consisting of recreational, cultural, and historic facilities with an estimated maximum cost of these purposes of $17, 181,920.00; and (f) Capital outlay projects consisting of public safety facilities and related capital equipment with an estimated maximum cost of these purposes of $24,662,400.00. The specific projects within these categories of purposes are set forth in a Capital Projects List adopted in final form by the Augusta-Richmond County Commission on August 7, 2000 (the "List"). The estimated maximum costs set forth above are based on the estimated costs set forth in the List. The total amount of proceeds of the Tax to be spent on the projects in each of the categories of purposes set forth above shall be in the total amounts specified for each such category. However, use of Tax proceeds to pay costs of projects may be shifted between projects as needs dictate and as the Augusta-Richmond County Commission in its discretion shall determine. If not all of the Tax proceeds allocated to a particular category are expended for the completion of projects in that category, such surplus funds may be transferred for use on projects in one or more of the other categories as the Augusta-Richmond County Commission in its discretion shall 3 PROJECT LIST 08/07/0a-SPECIFIC S~TEGORIES . I 08/07/00 determine. The projects as proposed are to be built over a period of time extending for at least five years. Conditions may change making a proposed project no longer feasible or increasing the cost thereof to an amount exceeding the funds available. In any such event, the Augusta-Richmond County Commission may change the size and scope of such project to make the project one which is feasible and the costs of which are within the funds available or eliminate the project and transfer the funds allocated thereto to other projects within the same category of projects if funds are needed for the remaining projects within such category and if not, to projects in one or more of the other categories. Voters desiring to vote for the imposition of the Tax for the aforesaid purposes shall do so by voting "YES" and voters desiring to vote against the imposition of the Tax for the aforesaid purposes shall do so by voting "NO" as to the question propounded substantially as follows: "Shall a special one per cent (1 %) sales and use tax be imposed in Richmond County for a period of time not to exceed five years for the raising of not more than $85,766,968.00 for the purpose of constructing (a) new facilities or building additions and improvements to existing facilities including a County courthouse, administrative buildings, a jail, library buildings, and major improvements and capital equipment related thereto, (b) capital outlay projects for the use of and benefit of the citizens of the entire county, (c) facilities specified under contracts between Augusta, Georgia, and the City ofHephzibah and the City of Blythe dated August 7, 2000 for the construction of water and sewer, transportation and related storm drainage improvements, recreation, cultural, historic, administrative and public safety facilities, (d) recreational, cultural and historic facilities, and (e) capital outlay projects consisting of public safety facilities and related capital equipment; AND for road, street and bridge purposes for a period of time not to exceed five years and the raising of not more than $75,873,952.00?" BE IT FURTHER RESOLVED that the Board of Elections of Richmond County shall set the date of the referendum for September 19, 2000, same being the earliest possible date therefor permissible under a.c.G.A. ~ 21-2-540 in order that the question of whether or not such tax shall be imposed and be submitted to the qualified voters of Richmond County. BE IT FURTHER RESOLVED by the authority aforesaid, and it is hereby resolved by the authority of the same, that ballot to be used in said election shall have written or printed thereon substantially the following: ( ) YES ( ) NO Shall a special one per cent (1 %) sales and use tax be imposed in Richmond County for a period of time not to exceed five years for the raising of not more than $85,766,968.00 for the purpose of constructing (a) new facilities or building additions and improvements to existing facilities including a County courthouse, administrative buildings, a jail, library buildings, and major improvements and capital equipment related thereto, (b) capital outlay projects for the use of and benefit 4 PROJECT LIST 08/07/00---SPECIFlC G.^ TEGORIES ~. J 08/07/00 of the citizens of the entire county, ( c) facilities specified under contracts between Augusta, Georgia and the City of Hephzibah and the City of Blythe dated August 7, 2000 for the construction of water and sewer, transportation and related storm drainage improvements, recreation, cultural, historic, administrative and public safety facilities, (d) recreational, cultural and historic facilities, and (e) capital outlay projects consisting of public safety facilities and related capital equipment; AND for road, street and bridge purposes for a period of time not to exceed five years and the raising of not more than $75,873,952.00? BE IT FURTHER RESOLVED that the referendum shall be held in accordance and in conformity with the laws of the State of Georgia and that the Board of Elections shall cause the date and purpose of the referendum to be published once a week for four weeks immediately preceding the date of such election in the official organ of Richmond County, and the notice of election shall be in substantially the following form, to wit: 5 PROJECT LIST 08/07/00-SPECIFIC CATEGORIES .' I 08/07/00 NOTICE OF CALL FOR SPECIAL ELECTION TO THE QUALIFIED VOTERS WITHIN RICHMOND COUNTY, GEORGIA TO CONSIDER THE IMPOSITION OF SPECIAL COUNTY ONE PERCENT SALES AND USE TAX NOTICE is hereby given that on the 19th day of September, 2000, an election will be held in all of the election districts of Richmond County, Georgia (the "County") at which time there will be submitted to the qualified voters within the county for their determination, the question of whether or not there should be imposed within Richmond County, a special county one per cent (1 %) sales and use tax for a maximum period of five years, commencing upon the termination of the special sales and use tax now in effect in Richmond County. The purposes for which the proceeds of the tax are to be used will include the following: (a) Road, street and bridge purposes which shall include acquisition of right- of- way for, construction of, and renovation and improvement of, including relocation of utilities for and improvement of surface water drainage from, roads, streets and bridges within the County with an estimated maximum cost for these purposes of $75,873,952.00; (b) Capital outlay proj ects for the use of or benefit of the citizens of the entire County consisting of a County courthouse, administrative buildings, a jail, library buildings, and major improvements and equipment related thereto, which shall include the construction of new facilities and additions to or improvements of the existing County buildings and facilities with an estimated maximum cost of these purposes of $38,472,448.00; (c) Capital outlay projects for the use and benefit of the citizens to be owned and operated, or both, by Augusta, Georgia with an estimated maximum cost of these purposes of $3,752,000.00; (d) Capital outlay projects to be owned and operated or both either by Augusta, Georgia, the City of Hephzibah or the City of Blythe in respect to which Augusta, Georgia, has on August 7, 2000 entered into contracts or agreements, as authorized in Article IX, Section III of the Constitution of the State of Georgia, for the construction of water and sewer, transportation, recreation, cultural, historic, administrative and public safety facilities with an estimated maximum cost of these purposes of$I,698,200.00; (e) Capital outlay projects consIstmg of recreational, cultural and historic facilities with an estimated maximum cost of these purposes of$17,181,920.00; (f) Capital outlay projects consisting of public safety facilities and related capital equipment. The estimated maximum cost of these purposes is $24,662,400.00. The estimated maximum costs set forth above are based on the estimated costs set forth in the List. The several places for holding said election shall be the regular and established election districts within the County, and the polls shall be open from 7:00 o'clock A.M. to 7:00 o'clock P.M. on said date fixed for the election. 7 PROJECT LIST 08/07/00-SPECIFIC C/\ TEGORIES '.1 08/1010007/00 Those residents within the County qualified to vote in said election shall be determined in all respects in accordance with the election laws of the State of Georgia. Anyone desiring to vote in said referendum and is not a qualified voter of said County must register no later than Monday, August 21,2000, at any of the approved voter registration sites in Richmond County, Georgia in order to be eligible to vote.
