APPROVING LETTER OF INTENT
AND QUIT -CLAIM
WHEREAS, the Augusta-Richmond County Commission has been petitioned to
consider approving a Letter of Intent and a Quit-Claim Deed to Marguerite S. Rece of
certain property interests shown on the attached plat as "Tract A";
WHEREAS, the Augusta-Richmond County Commission has elected to approve
the Letter oflntent and the Quit-Claim Deed;
WHEREAS, it is appropriate for assent by the Augusta-Richmond County
Commission be shown on the face of the Letter oflntent and Quit-Claim Deed.
NOW, THEREFORE, it is hereby resolved as follows:
1. The Augusta-Richmond County Commission does hereby approve the
Letter of Intent and Quit-Claim Deed to its interest in the property shown as "Tract A" on
the attached plat.
2. It is further determined that the Mayor of Augusta, Georgia shall execute
the Letter oflntent and the Quit-Claim Deed.
This Resolution shall be recorded in the Minutes of the Augusta-Richmond
County Commission, accompanied by the exhibits referred to herein.
Duly adopted by the Augusta-Richmond County Commission, this U~y of

Dear Mrs. Rece:
This letter represents the agreement reached between the Augusta Utilities
Department (AUD) and you, as the property owner. The following items will be
performed by AUD at no charge to the property owner:
1. On, or about, Monday, September 27,2004, AUD will commence construction of
a new manhole and section of sanitary sewer line, shown as "Tract e" on the
attached Exhibit.
2, Upon the completion of said manhole and sanitary sewer line, the existing
sanitary sewer line, shown as "Tract A" on the attached Exhibit, will be cut,
capped, and the portion going under the house will be filled with flowable fill.
3. A tap will be made for the dwelling on this property in the manhole at the rear of
this property, and the rear portion of "Tract A", from the dwelling to the manhole
located on the rear of this property, will become the service line for the dwelling.
4. By Quit-Claim Deed, AUD will abandon any interest it has to the sanitary sewer
line shown as "Tract A" on the attached Exhibit, to Marguerite S. Rece, with the
following two exceptions:
a. The manhole located at the rear of this property, along with a ten foot
pennanent utility and maintenance easement on all sides of said manhole,
shown as "Tract B" on the attached Exhibit
b. The sanitary sewer line running from said manhole in a Northeast
direction, as shown on the attached Exhibit, along with a permanent
utility and maintenance easement ten feet on both sides of the center line
of said sanitary sewer line.
5. Any abandoned line will be abandoned in place, and upon doing same, Augusta,
Georgia and AUD shall have no further obligation or responsibility for such line.
6. AUD, its successors and assigns, will also retain the right to clear, and keep clear,
all trees, undergrowth and other obstructions from said permanent utility and
maintenance easement, along with the free right of ingress and egress to and from
said easement for this purpose.
7. This Agreement shall survive the closing and execution of the quit claim deed
contemplated herein.

QUIT CLAIM DEED
STATE OF GEORGIA
COUNTY OF RICHMOND
THIS INDENTURE, made the 28' day of SEPT in the year two thousand and
four, between AUGUSTA, GEORGIA, a political subdivision under the laws of Georgia,
hereinafter referred to as Party of the First Part and MARGUERITE S. RECE, hereinafter referred
to as Party of the Second Part;
WITNESSETH, that the Party of the First Part, for and in consideration of ONE DOLLAR
($1.00) in hand and truly paid by the Party of the Second Part at and before the sealing and
delivery of these presents, and other valuable consideration, the receipt whereof is hereby
acknowledged, has granted, bargained, sold, conveyed and confirmed, and by these presents
does remise, release and forever quit-claim to the Party of the Second Part all the right, title,
interest, claim or demand which the Party of the First Part has, or may have had, in and to the
following described real property, and the Party of the Second Part has agreed to accept said
described real property, to wit:
A sanitary sewer line, which will be abandoned in place with no further obligation to
Augusta, Georgia or the Augusta Utilities Department, shown as "Tract AU on a plat
prepared for Augusta, Georgia, dated September 28, 2004, attached hereto and
made a part hereof, to which reference is made for a more accurate and complete
description of the metes, bounds and courses, with the following exceptions:
The following rights, title, interest, claim and demand will be retained by the Party of
the First Part, its successors and assigns:
a. The manhole located at the rear of this property, along with a ten foot
permanent utility and maintenance easement on all sides of said manhole,
and sanitary sewer line as shown as "Tract BU on said plat.
b. The right to clear, and keep clear, all trees, undergrowth and other obstructions
from said permanent utility and maintenance easement, along with the free right
of ingress and egress to and from said easement for this purpose.
Together with all the rights, members and appurtenances to the said described premises
in anywise appertaining or belonging.
TO HAVE AND TO HOLD the said described premises unto the Party of the
Second Part, so that neither the said Party of the First Part, nor any other person or
persons claiming under the Party of the First Part will at any time claim or demand any
right, title or interest to the aforesaid described premises or its appurtenances.
IN WITNESS WHEREOF, the Party of the First Part and the Party of the Second
Part have signed and sealed this deed the day and year first above written.
