RESOLUTION
RESOLUTION REQUESTING THE RICHMOND
COUNTY LEGISLA TIVE DELEGATION TO
AMEND OFFICIAL CODE OF GEORGIA
ANNOTATED ~16-11-127.1 TO INCLUDE PARKING
LOTS OF PUBLIC BUILDINGS IN THE
DEFINITION AS TO PUBLIC GATHERINGS.
WHEREAS, state laws creates a criminal offense for the carrying of
weapons at public gatherings; and
WHEREAS, state laws defines "public gatherings" to include public
owned or operated buildings; and
WHEREAS, the current definition of public gathering is ambiguous as to
whether parking lots of public buildings or personal vehicles parked therein are a
part of a public gathering; and
WHEREAS, the Georgia Court of Appeals has ruled that public buildings
include parking lots; and
WHEREAS, Augusta believes the Official Code of Georgia as Annotated
(O.C.G.A.) SI6-11-127.1 should be amended to specifically include parking lots
of public owned or operated buildings for clarity; and
WHEREAS, Augusta believes the proposed amendment of this section is
necessary for security measures for public agencies; and
WHEREAS, Augusta further believes the amendment of O.c.G.A. S16-
11-127.1 will help law enforcement officer and prosecutors in performance of the
duties.

NOW, THEREFORE, BE IT RESOLVED THAT THE AUGUSTA-
RICHMOND COUNTY COMMISSION expresses its support of amending the
O.C.G.A. 916-11-127.1 so that public gathering include parking lots of public
buildings and personal vehicles parked in parking lots of public buildings.
BE IT FURTHER RESOLVED that the Richmond County Legislative
Delegation is encouraged to support legislation amending O.C.G.A. 916-11-127
so that so that public gathering include parking lots of public buildings and
personal vehicles parked in parking lots of public buildings.
