RESOLUTION
"
ABANDONING ALLEYS BETWEEN
TELFAIR STREET, WEST FORD STREET
. AND WALKER STREET
WHEREAS, the Augusta-Richmond County Commission resolved by
Resolution dated May 20, 2003, that the following street segment in Richmond County,
Georgia, has ceased to be used by the public to the extent that no substantial public
purpose is served by it: that the alleys, located on Tax Map 47-1, between Telfair St., W.
Ford 51. and Walker St. and containing approximately 0.07 acres, as shown on attached
plat;
WHEREAS, the adjoining property owners to the property described above
have been notified of the May 20, 2003 Resolution; notice of the proposed abandonment
has been published in the Augusta Chronicle once a week for a period of two weeks; and
a public hearing on the proposed abandonment has been conducted on May 25, 2004, with
no objections being raised as to the abandonment of the street segment described above;
WHEREAS, by virtue of the events set forth above, the property identified as
the alleys, located on Tax Map 47-1, between Telfair St., W. Ford S1. and Walker St. and
containing approximately 0.07 acres, as shown on attached plat. is deemed abandoned
and no longer a part of the Richmond County road system;
WHEREAS, notice has been given to ~he owners of abutting land holding title
through the owners from whom Augusta, Georgia acquired the property of said owners'
right to acquire the land described above; and
WHEREAS,an adjoining property owner has communicated its desire to
exercise its right to acquire the above described property;
NOW, THEREFORE, it is hereby resolved as follows:
1. It is hereby determined that all reqUirements of Georgia law for the
abandonment of a county roadway have been met and that the alleys referred to in the
Augusta-Richmond County Commission's May 20, 2003, and described as the alleys,
located on Tax Map 47-', between Telfair St., W. Ford St. and Walker St. and containing

approximately 0.07 acres, as shown on attached plat, is no longer a part of the Richmond
County road system.
2. It is further determined that the Mayor of the Augusta, Georgia shall
execute a Quit-Claim Deed and such other documentation as may reasonably be required,
in forms approved by the Attorney for Augusta, Georgia. releasing said property from the
Richmond County road system and confirming fee simple. unencumbered interest in the
property.
This Resolution shall be recorded in the Minutes of the Augusta.Richmond
County Commission, accompanied by the exhibits referred to herein.

RESOLUTION
FINDING THE ALLEYS AS HAVING CEASED TO BE USED
FOR PUBLIC PURPOSES AND FOR ABANDONMENT OF
. SAME
WHEREAS,the Augusta-Richmond County Commission has been petitioned
to consider the abandonment of the alleys located on Tex Map 47-1, between Telfair St.,
W. Ford St. and Walker St. and containing approximately 0.07 acres, 'as shown on the
attached plat;
WHEREAS, applicable law setting forth the procedure for SUch abandonment
first requires that there be a determination that the Alleys for which abandonment is sought
hav8, for any Mason, ceased to be used by the public to the extent that no substantial
public, purpose is served by it, and the Augusta-Richmond County Commission has so
determined;
NOW, THEREFORE, it is hereby resolved a6 follows:
1. It is hereby determined that the Alleys, Irlcated on Tax Map 47-1, between
Telfair St., W. Ford St. and Walker St. and containing approxImately 0.07 acres, 89 Bat
forth on the attached plat, havSl ceased to be used by th.e publiC to the extent that no
substantial public purpoee is served by ttJem;
2. The property owners located on either side of the Alleys for which
abandonmont is sought shall be notified of such determination and request for
abandonment;
.3. Notice of suet') determination of the cessation of pUblic USB and request
for abandonment shall be published in the Augusts ChroniCle, the newspaper in which the

Sheriffs advertisements for the County are published, once a week for a period of two
weeks; and
4. A publiC hearing on suc:n issue shall be conducted, such that the said
AlleyS may be deemed abandoned and thereafter disposed of In accordance with the
applicable provisions of Georgia law.
This Resolution. and applicable subsequent Resolutions relative to the
abandonment of the Alleys, located on Tax MBp47"1, between Telfair St., W. Ford St. and
Walker St. and containing approximately 0.07 acres shall be recorded on the minutes of
the Augusta-Richmond County Commission, accompanied by the attached, plat.
