RESOLUTION
ABANDONING A PORTION OF JONES
STREET AND AUTHORIZING CONVEYANCE
WHEREAS, the Augusta-Richmond County Commission resolved by
Resolution dated May 21, 1996, that the following street segment in Richmond County,
Georgia, has ceased to be used by the public to the extent that no substantial public purpose
is served by them: that portion of Jones Street, beginning at its conjunction with Macartan
Street, and ending at its conjunction with Tenth Street (Cumming), as shown on attached
plat;
WHEREAS, the adjoining property owners to the property described above
have been notified of the May 21, 1996, Resolution; notice of the proposed abandonment
has been published in the Augusta Chronicle once a week for a period of two weeks; and
a public hearing on the proposed abandonment has been conducted on December 3, 1997,
with no objections being raised as to the abandonment of the street segment described
above;
WHEREAS, by virtue of the events set forth above, the property identified as
that portion of that portion of Jones Street, beginning at its conjunction with Macartan Street,
and ending at its conjunction with Tenth Street (Cumming), as shown on attached plat, is
deemed abandoned and no longer a part of the Richmond County road system;
WHEREAS, notice has been given to the owners of abutting land holding title
through the owner from whom Augusta-Richmond County acquired the property of said
owner's right to acquire the land described above; and
WHEREAS, the SouthTrust Sank has communicated its desire to exercise its
right to acquire the above described property.
WHEREAS, the property in question has been appraised at a
value of $
NOW, THEREFORE, it is hereby resolved as follows:
1. It is hereby determined that all requirements of Georgia law for the
abandonment of a county roadway have been met and that the street segment referred to

in the Augusta-Richmond County Commission's May 21,1996, Resolution, and described
as that portion of that portion of Jones Street beginning at its conjunction with Macartan
Street, and ending at its conjunction with Tenth Street (Cumming), as shown on attached
plat, is no longer a part of the Richmond County road system.
2. The SouthTrust Bank has properly exercised its right to acquire the property
described above.
3. It is further determined that upon receipt of $ from
SouthTrust Bank, the Mayor of the Augusta-Richmond County Commission, as successor
to The City Council of Augusta, shall execute a Quit-Claim Deed and such other
documentation as may reasonably be required, in forms approved by the County Attorney,
conveying all of Augusta's interest in the property, which interest is subject to all
easements of record for utilities, to SouthTrust Bank. All proceeds arising from this sale
shall be paid into and constitute a part of the funds of Augusta-Richmond County.
This Resolution shall be recorded in the Minutes of the Augusta-Richmond
County Commission, accompanied by the exhibits referred to herein.
