RESOLUTION
RESOLUTION OF THE AUGUSTA-RICHMOND
COUNTY COMMISSION IN SUPPORT OF THE
CLOSURE OF A POND LOCATED AT 2721 WILLIS
FOREMAN ROAD, HEPHZIBAH, GEORGIA
WHEREAS, there is a pond located at the residence of James Fishmon,
2721 Willis Foreman Road, Hephzibah, Georgia which was permitted by the U.S.
Army Corps of Engineers without notice to Augusta, Georgia and designed by the
U.S. Soil Conservation Service; and
WHEREAS, the pond is located in a residential subdivision; and
WHEREAS, the existence of the pond creates conditions which foster the
breeding of flies, mosquitoes and rodents; and
WHEREAS, the pond poses a threat to the safety and health of the
residents of the neighborhood as well as the public; and
WHERAS, the pond is an annoyance and an inconvenience to the public;
and
WHEREAS, the Augusta-Richmond County Commission promotes a safe
and healthy environment for the citizens of Augusta.
NOW, THEREFORE, BE IT RESOLVED by the Augusta-Richmond
County Conunission, that residential pond at 2721 Willis Foreman Road is a
danger and detriment to human life and health and should be closed.
BE IT FURTHER RESOLVED by the Augusta-Richmond County
Commission, that Richmond County Board of Health is requested to investigate
the pond and its conditions to determine whether the pond is a public nuisance in
violation of Nuisance Ordinance, HO-98-1, and that the Board of Health take such
action as appropriate to abate such nuisance.

BE IT FURTHER RESOLVED that a copy of this resolution. be
transmitted to the United States Congressional Delegation representing Augusta,
Georgia.
