Based on case and statutory law, the Jail Administrator shall develop an institutional goal along with appropriate objectives, PROCEDURE : 1. Review of Case Law - The Jail Administrator for the Augusta City Jail shall review annually appropriate case law from the Georgia Supreme Court and the 11th Circuit Court of Appeals within the Federal Court System. The case law review shall be the basis for changes to the facility's policy statements and operating procedures. 2. Goal: The goal of the Augusta City Jail shall be to house inmates in a safe and constitutionally adequate environment while ensuring protection of the surrounding community through the operation of a secure facility. 3. Objectives: a. To use modern and progressive administrative practices to ensure legal and fiscally sound operation. b. To ensure that all inmates are processed into the facility in a consistent and humane manner. c. To establish and maintain an inmate classification system that will allow for safe and constitutional housing, d, To maintain security within the institution so as to ensure the safety of the surrounding community and the safety of the inmates. e, To ensure that all inmates are afforded opportunities to exercise their right to communicate with persons outside of the institution, Page 2 , ~ ~ .~ 1.01 - GOALS AND OBJECTIVES (CONTln) f. To provide adequate health care, food service and other inmate services as designated by the Jail Administrator. g. To establish and maintain inmate programs including recreation and religious services. h, To maintain grievance and discipline policy and procedures that are in concert with federal griev~nce standards. i. To maintain and rehearse emergency procedures which will allow for the safe evacuation of the facility and/or its' continued operation under adverse circumstances. j. Progress in attaining all objectives will be monitored monthly by the Jail Administrator to ensure that appropriate programs and procedures are in effect. Page 3 '" JAIL POLICY AND PROCEDURES OPERATIONAL AREA 1.02 WRITTEN POLICY AND PROCEDURE POLICY: It shall be the policy of the Augusta City Jail to establish and maintain a policy and procedures manual which will allow constitutional operation and the implementation of the facility's overall goal and objectives. PROCEDURE : 1. Persons Affected: All personnel employed by the Augusta City Jail will perform their assignments in compliance with the current policy and procedures manual, 2. Maintenance of Manual: All employees will be responsible for maintaining a current policy and procedures manual. The manual shall contain the following information: a. Policy statements for all sections of the manual; b. Procedures for all sections of the manual; c, All active general order issued; d. All active special orders issued; e. All supplements issued to policies and procedures. 3. Adherence to Policy and Procedures: All employees of the Augusta City Jail shall operate based on established written procedures, except in those circumstances listed below: a. When following a procedure could endanger the life employee or vistor; b. When a direct verbal or written order is issued by officer, or health of an inmate, , a supervisor or a ranking 4, Review of Policy and Procedures: Annually, a committee will be appointed by the Jail Administrator to review current policy and procedures taking into consideration new developments in: a. Case Law b. State or Federal Standards c. Facility needs d. The community's needs This committee shall report to the Jail Committee of the City Council within seventy-five (75) days, its' recommended changes, ~ an explanation of the need therefore, Page 4 \ ~ JAIL POLICY AND PROCEDURES or: OPERATIONAL AREA 1.03 PERSONNEL POCICY: It is the policy of this facility to hire the most qualified applicants, while ensuring appropriate minority representation, on the staff, The Jail Administrator shall review personnel policies and procedures annually to ensure that the facility's goals and objectives are being met, PROCEDURE: 1. Recruitment: New employees will be actively recruited. 2. Employment Criteria: All successful applicants must meet minimum standards of employment, The standards are: a. Completion of high school or Georgia Equivalency Diploma; b. No felony convictions; c. A complete background investigation; and d, Any other requirement of the Augusta City Personnel Department 3. Terms and Conditions of Employment: a, Salary - Starting salaries will be based on the City's established pay scale at time of employment. b. Fringe Benefits - All permanent, full-time employees receive fringe benefits as provided by the Augusta City Government to its general employees. c. Probationary Period - All new employees are con~idered probationary for the first twelve (12) months. At the end of this period, work performance will be reviewed by the Jail Administrator or his designee, who will determine if work performed has been satisfactory, the employee will be retained as a permanent employee of the facility, If an employee's work has not been satisfactory, employment will be terminated, d, Promotions - Advance in rank and position will be considered by length of service and performance rating, in addition to position specifications and requirements, Page 5 4 1.03 PERSONNEL (CONTID) 'r: 4. Personnel Rules and Regulations Manual: a. All new employees shall be issued a Personnel Rules and Regulations Manual, which details the following: - Equal Employment Opportunity Provisions Position Specifications (including Qualifictions, Descriptions and Responsibilities) Description of Fringe Benefits Leave Allowances Personnel Records Employee Evaluation Training Promotion Retirement, Resignation, and Termination Employee-Management Relations Physical Fitness Policy Hostage Policy Disciplinary and Grievance Procedures b, The.Personnel Rules and Regulations shall be maintained and kept up-to-date by the Augusta City Personnel Department. They shall immediately issue updated information to all employees, as changes occur. Page 6 ~ . tit POLICY AND PROCEDURE MANUAL OPERATIONAL AREA 1.03 PERSONNEL MEALTIMES/BREAKS POLICY: Shift Commanders & Assistant Shift Commanders will coordinate with the Cook on duty, and determine when your s'taff will eat in the Jail Dining Room. You are to rotate one (1) roving officer at each meal to tour the Jail, while the balance of the staff eats together. No more than twenty (20) minutes is to be taken for each meal, Breaks will be given by Shift Commander when time warrants. Page 6a - POLICY AND PRoCEDURE MANUAL OPERATIONAL AREA .,: 1.03 PERSONNEL RESIGNATION POLICY: There may come a time when you may wish to leave the department's service. If so, be sure to submit a resignation to your supervisor. You must give reasonable noticet which in most cases should be a minimum of two (2) weeks in advance of the time you wish to leave. A-02 - Falsification of an official report. A-03 - Communicating or giving information which may aid a person to escape arrest, or delay the apprehension of a criminal, or permit the removal of evidence. A-04 - Willful failure to report or act on illegal activity, A-OS - Willful disobedience of any reasonable order or lawful command, written or oral; insubordination. . A-06 - Intoxication on duty. VIOLATION CATEGORY B: B-Ol - Aiding or abetting the commission of any offense. B-02 - Commission of an illegal act, other than minor traffic offenses. VIOLATION CATEGORY C: C-01 - Unexcused absence from duty. C-02 - Asleep on duty. C-03 - Willfully damaging City Jail property or equipment. C-04 - Flagrant misuse, handling or display of firearms. C-05 - Use of unnecessary force resulting in injury of a person being questioned, apprehended or confined. C-06 - Consumption of intoxicant while on duty. C-07 - Conduct predjudicial to discipline, fellow employees or departmental operations. VIOLATION CATEGORY D: D-01 - Failure to comply with any order, directive or regulation; oral or written. D-02 - Failure to take appropriate action concerning illegal activity. D-03 - Failure to properly patrol assigned area, unauthorized absence from assignment, or failure to respond to radio call. D-04 -Failure to properly care. for assigned department equipment or vehicle, resulting. in loss or damage to same. D-05 - Unauthorized person in City vehicle. D-06 - Use of rude or insulting language or conduct offensive to the public. D-07 - Failure to properly supervise subordinates. D-08 - Failure to report as witness when duly notified or subpoenaed. Page 6d ~, te to .," JAIL POLICY AND PROCEDuRES OPERATIONS AREA 1.04 STAFF TRAINING AND FITNESS POLICY: It shall be the policy of the Augusta City Jail that training is an on-going process, and a designated training officer shall establish and monitor each employee's training and fitness to help ensure satisfactory performance. PROCEDURE: 1. Scope of Training: All Correctional personnel shall be required to undergo the following training: a. A sixteen (16) hour facility-orientation course, which shall include training .for non-certified officers in the following: - Security Procedures - Supervision of Inmates - Report Writing - Significant Legal Issues - Inmate Rules and Regulations - Grievance and Disciplinary Procedures - Rights and Responsibilities - Fire and Other Emergency Procedures - First Aid and Cardiopulmonary Resuscitation - Communications Skills - Special Needs of Minorities, Women, Juveniles, and Ex-Offenders - Interpersonal Relations - Receiving Health Screening - Needs of Special Inmate Classifications 2, Notification of Training Programs: A schedule of training programs shall be posted on the main bulletin board. It is the responsibility of all employees and their supervisors to become familiar with this schedule, 3, Compensation for Training: All employees shall be compensated at their regular pay rates while attending assigned training programs, Page 7 . ~ .., JAIL POLICY AND PROCEDURES OPERATIONAL AREA 1.05 . FISCAL MANAGEMENT, BONDING AND INSURANCE POLICY: It shall be the Policy of the Augusta City Council to establish an annual operating budget, which will allow for adequate staffing and operation of the facility. PROCEDURE: 1. Budget Description: The Augusta City Jail operates on annual appropriations from the Augusta City Council. 2. Budget Preparation Process: The Jail Administrator will prepare and present the proposed budget to the Augusta City Council and he shall request a meeting with the Budget Committee of the Augusta City Council to explain the budget proposals. JAIL POLICY AND PROCEDURES "~ OPERATIONAL AREA . 2.01 IDENTITY OF ESCORTING OFFICER. POLICY: No person shall be admitted into the custody of the facility unless the officer escorting the person is positively identified. PROCEDURE: 1. Request: If the escorting officer is not personally known to the Corrections Officer, he/she shall require the escorting officer to produce the following identification: a. A badge and photo I,D, for law enforcement officers, showing unit number and signature of agency head; b. Such other identification as the Corrections Officer deems necessary to establish positive identification. 2. Refusal: If the escorting officer cannot or does not produce proper identification, or if the identification produced does not conform to the officer's person, the Shift Commander shall refuse to accept custody. I 3. Reporting: If custody is refused, the facts and circumstances surrounding the refusal will be noted by the Shift Commander in the Daily Log. Page 10 .. '. JAIL POLICY. AND PROCEDURES .,: OPERATIONAL AREA 2.02 LEGALITY OF COMMITMENT DOCUMENTS POLICY: No person shall be accepted into the custody of the Augusta City Jail without clear and documented legal authority. PROCEDURE: 1. Request: Immediately following the review of the escorting officer's identification, the Shift Commander shall obtain from the escorting officer, the legal documents authorizing custody, 2, Review: The Shift Commander shall review the documents for proper execution. Such documents shall include at least one or more of the following: a. Writ or order issued by the court for execution of sentence; b. Bond forfeiture papers approved by the Clerk of Courts; Page 11 " " JAIL POLICY AND PROCEDURES . r~ OPERATIONAL AREA 2.03 CONDITION OF INMATE POLICY: No person shall be admitted to the facility in an unconscious state or with any evidence of injury or illness, requiring 'immediate medical care. PROCEDURE: 1. Observation: The Booking Officer shall carefully observe the physical condition and behavior of the inmate being admitted. 2. Serious Injury: If the injury, illness, or emotional state of the inmate appea~s serious, the Booking Officer shall: a, Refuse acceptance of custody and recommend that the arresting officer seek medical attention for the inmate; b. Not accept custody until the arresting officer provides documentation of the inmate's medical treatment. NOTE: Also See Preliminary Health Screening. 3. Intoxication: If the inmate's behavior appears to be affected by the use of , drugs or alcohol, the Booking Officer shall follow the steps in Procedure 6.03 for emergency medical care. 4. Minor Injury: If the inmate's injury appears minor in nature: a, The Booking Officer will make note of the injury on the Preliminary Health Screeing form. b, The Booking Officer will carefully observe the inmate's injury(s) and notify his/her supervisor to determine the need to be taken to a physician or to call the local Emergency Medical Services Unit, Page 12 11 I, ". JAIL POLICY AND PROCEDURES OPERATIONAL AREA 2.04 FRISK SEARCH POLICY: Staff members of the Augusta City Jail shall make every reasonable effort to prevent the introduction of contraband into the facility while inspecting persons and property of persons being admitted. PROCEDURE: 1. Frisk Search: When an inmate has been accepted into custody, the admitting Booking Officer shall immediately conduct a frisk search of the inmate in the booking area before placing him in the general lock-up, to determine if any contraband articles are concealed on the inmate. 2, Conduct: The frisk search shall be performed in accordance with established procedures and with the greatest degree of dignity possible for the inmate. Under no circumstances shall an officer direct any personal remark to the inmate being frisk searched concerning his person, attire, or physical attributes. 3. Contraband: In the event contraband may be found on an inmate, the Booking Officer, in the presence of another Corrections Officer, shall immediately conduct a strip search (see Strip Search Procedure). NOTE: Provision should be made so that inmates are searched by detention personnel of the same sex, except in emergency situations, (SEE APPENDIX FOR RECOMMENDED PROCEDURE) Page 13 1.1 11 JAIL POLICY AND PROCEDURES . r: OPERATIONAL AREA 2.05 NOTIFICATION OF INCARCERATION BY INMATE POLICY: Staff members of the Augusta City Jail shall afford reasonable opportunity for newly admitted inmates to contact persons to secure release, seek legal counsel, and provide notificiation of incarceration to' family or friends. PROCEDURE: 1. Access: Following the frisk search, and before being placed into the regular inmate population, the newly admitted inmate will be allowed access to the telephone and the directory located in the booking area. *2. Calls: If after several attemps, the inmate fails to reach either of the called parties, the inmate will be allowed to repeat telephoning periodically, during the remainder of the admissions process until the called parties are reached or the admissions process is completed, whichever comes first, 4. Long Distance: The admitting Booking Officer will allow long distance calls by the inmate on phones designated for this purpose. 5. Subsequent Calls: If, after the completion of the admissions process, the inmate is unable to contact parties via telephone, the inmate will be allowed to place f additional calls as soon as practicable after being placed in assigned dormitory. 6. Recording: The admitting Booking Officer will note in the Daily Log, the fact that the inmate was unable to contact anyone during the admissions process. *The inmate shall be allowed a reasonable length of time for telephone conver- sation, normally three (3) minutes in duration, depending upon workload of officers and number of other inmates desiring the use of the telephones. JAIL POLICY AND PROCEDURES ': OPERATIONAL AREA 2.06 RECORDS AND REPORTS POLICY: Accurate and complete records will be maintained for all inmates to verify that all laws, standards and procedures have been followed, PROCEDURES: 1, Forms and Documents: Before toe inmate is removed from the booking or holding areas into the general jail population, the following records will be completed: a. Prisoner Property and Money Envelopes; b, The Municipal Court Ticket c. The Inmate I.D. Sheet; d, .Inmate Booking Sheet; e. The Preliminary Health Screening Form; . f. Any other documents dealing with inmate incarceration 2. Questioning: The Booking Officer will restrict questioning to the information necessary to complete the admissions records. Under no circumstances will the admitting officer question the inmate about the offense for which the inmate is being incarcerated. 3~ Possession: At no time during the admissions process will the inmate be allowed to have the booking documents in his/her possession. Throughout the process, all forms, documents, and other records will be in the sole possession of the admitting officer. 4, Verification: If the Booking Officer suspects that information given by the inmate is inaccurate, the officer will attempt to verify the information by .checking existing jail files. Page 15 ~ I 1>4 2.06 - RECORDS AND REPORTS (CONT'D) . r: 5. Storage: At the completion of the admissions process, the records and reports listed in Section 1 above, will be delived to Records. Records shall prepare a jacket on the inmate, print all necessary data pertaining to admission and follow procedures set forth for Corrections Officers. Page 16 . i .. .~ JAIL POLICY AND PROCEDURES or: OPERATIONAL AREA 2.07 CONFISCATION OF PERSONAL PROPERTY POLICY: The personal property of inmates will be respected by all Corrections Staff and will be handled with care to prevent loss or damage. PROCEDURES: 1. Confiscation: 'The Booking Officer will, during the frisk search, confiscate all personal property of the newly admitted inmate(s), including: a. money; b. belts, ties, hats, jackets, coats, and shoes; c. all contents of inmate's pockets, and; d, other items not part of the inmate's clothing (e,g., purses, backpacks, key chains, watches, jewelry, checkbooks). NOTE: Inmates will be allowed to keep (after inspection) cigarettes and a book of matches. 2. Description: On the Inmate Property Envelope, the Booking Officer will list and describe all items confiscated. 3. Envelope: All items, except money, will be placed in the property envelope. If any item is too large to be placed in the property envelope, it will be listed and described on the envelope, and a property tag will be attached to the item. The prisoner's name and date of admission will be noted on the property tag, along with the docket number, 4, Money: The Booking Officer will count the inmate's money in the inmate's presence . and place the money in a separate envelope, noting the amount of money, the inmate's name and date of admission on the face of the envelope, 5. Storage: When Steps 5 and 6 have been completed, the Booking Officer will place all property in the inmate storage area. Money envelopes will be deposited in the safe anytime during the twenty-four (24) hours period. PROCEDURE: 1. Rules Sheet: The Booking Officer, upon request by the inmate, will give the inmate a copy of the Inmate Rules Sheet. The Booking Officer will also make available for the inmate review, a copy of the Policy & Procedures Manual, used at the Augusta City Jail, pointing out to the inmate, the sections on rules and priviledges. Page 19 " JAIL POLICY AND PROCEDURES OPERATIONAL AREA 2.09 FEMALE INMATES POLICY: Female inmates shall be separated from male inmates after. processing through the booking area, until the time of release. PROCEDURE : 1. Staff: When a female inmate is brought to the Augusta City Jail for admission, a female Corrections Officer will conduct the search after the admissions procedures for the female inmate have been performed by the Booking Officer on duty. 2. Separation: In the event that female and male inmates are brought to the facility at the same time, the male inmate will be secured in the booking area while the female inmate is processed. If a female Corrections Officer is not readily available for searching procedures, then the female inmate will be secured in the booking area pending the return of the femal officer and the male inmate will be processed first. Page 2() l.' .., JAIL POLICY AND PROCEDURES OPERATIONAL AREA 2.10 CONFISCATION OF INMATE CLOTHING POLICY: For the health, safety, and security of the facility and its inmates, inmates shall not be allowed to wear personal outer clothing while confined. The inmate will furnish his/her underwear, The facility shall furnish each inmate with pants, shirt, and a jacket, when necessary, depending upon the need. PROCEDURE: 1, Removal: The Booking Officer will escort the inmate to the Admissions Office and instruct the inmate to remove all items of personal clothing and place them on the table. 2. Inspection: The Booking Officer will inspect each separate item of clothing for contraband (if contraband is found, the procedures set forth in 4.02 are to be followed). 3, Tag: Upon request, all washable clothing, except underwear. will be marked for identification in an inconspicious location and placed in a plastic bag, labeled, and brought to the facility laundry for cleaning, Upon cleaning, they will be placed back in the bag and stored in the inmate storage area. 4. Signature: The inmate will be requested to sign the (bag), if the inmate refuses to sign, (see procedures set forth in 2,07). 5. Issuance: The Booking Officer will issue the inmate a complete uniform, Page 21 \t II JAIL POLICY AND PROCEDURES OPERATIONAL AREA 2.11 PREVENTION OF DISEASE POLICY: To prevent the introduction of disease and to promote a healthy environment, inmates suspected of being disease carriers or presently infected, will receive medical aid within a reasonable time. PROCEDURE: 1. Observation: The Booking Officer shall observe the inmate for any signs of injury (cuts or bruises). If signs of injury are observed, the procedures set forth in Procedure 2.16 shall be followed, 2. Questioning: Upon completion of information on the Receiving Screening Form, if applicable, the inmate will be placed on medical call. 3, Delousing: All inmates admitted will be deloused/deliced as per procedure outlined. 4. Housing: All inmates are encouraged to shower upon assignment to the cell area. Page 22 ..' .. ~ JAIL POLICY AND PROCEDURES OPERATIONAL AREA 2.12 STRIP SEARCH POLICY: Strip searches are a necessary procedure for the maintenance of security. The strip search shall be done with the greatest degree of dignity possible for the inmate and only by an officer of the same sex. No personal remarks shall ever be made regarding the inmate's personal or physical characteristics. PROCEDURE : 1, Determination: The Booking Officer will review the inmate's record to determine if a strip search is warranted, 1 (a) All inmates whose present or past charges include drug or weapon related charges will be strip searched before they go into the general population. 2. Instructions: Upon determination, the Booking Officer will instruct the inmate to step into the strip search room. (Booking Bathroom), 3. Explanation: The strip search procedure will be explained to the inmate so that the inmate is apprised in advance of the necessity for the search and how it will proceed, 4, Conduct: The Booking Officer will conduct the strip search according to the exact procedure as set forth in the Appendix, 5. Refusal: If the inmate refuses to submit to a strip serach, the Booking Officer will attempt to verbally persuade the inmate and, failing that, the Booking Officer will: a, Notify the Shift Commander on duty; b, Note the incident in the Daily Log; . c, Provide for increased surveillance of the inmate, and; d, Prepare an incident report. 6, Contraband: If during the strip search the Booking Officer discovers contraband on the inmate's person, the Booking Officer will: Page 23 ,I I) .," 2.12 - STRIP SEARCH (CONT'D) a. Remove the contraband and secure it; b. Issue the facility inmate uniform (see Procedure 2.15); c. Call the Shift Commander on duty and prepare a written report; d. Continuation: If the inmate consents to the strip search and if no contraband is found, the Booking Officer will continue with the admissions procedure, as outlined in 2.15. AND HYGIENE ITEMS POLICY: To maintain a healthful environment and to protect the personal property of inmates, all inmates who are to be housed with the general facility population will be required to wear a uniform issued by the Augusta City Jail. PROCEDURE: 1. Sequence: The Booking Officer will: a. Return the inmate's personal underwear to him/her and; b. Obtain a clean facility uniform of the appropriate size (S,M,L,XL) from the Laundry. 2. Instruction: The Booking Officer will instruct the inmate to put the uniform on. 3. Bedding and Linens: The Booking Officer will obtain and give to the inmate the following: a. Two (2) sheets b. One (1) towel c. One (1) blanket (during the colder months) d. One (1) mattress e. One (1) wash cloth Note: The bedding linens must have been cleaned prior to their re-issue. 4. Personal Hygiene Items: The Booking Officer will obtain and issue to each inmate the following items: a. Toothbrush b. Toothpaste c. Soap d. Feminine hygiene items (as appropriate) e. Shampoo (as needed) Page 25 I' I, JAIL POLICY AND PROCEDURES OPERATIONAL AREA 2.14 PRELIMINARY HEALTH SCREENING POLICY: Each newly admitted inmate shall undergo a preliminary health screening by the Booking Officer (Nurse). Such screening is designed to identify those inmates whose condition may represent a threat to the health of the facility staff and inmates or a threat to the health' of the new inmate. PROCEDURE: 1. Interview: After the inmate has put on the inmate uniform, the officer will return the inmate from the admissions room to the booking counter. There the Booking Officer will interview the inmate concerning the inmate's medical history and current condition. 2. Recording: The inmate's answers to the questions will be recorded on the Preliminary Health Screening Form. 3. Records: The completed Preliminary Health Screening Form will be placed in a separate file to begin a medical record for the inmate, for use by the Staff Nurse, Staff Physician and will be stored in the Medical Department. 4. Referral: If after the screening, there is reason to suspect that the inmate suffers from any communicable disease or condition which may require further examination, the Booking Officer will: a. Secure the inmate in the booking area separate from all others, and then; b. Notify the Shift Commander on duty. Nurse or hospital emergency room and or place the inmate in a holding cell The Shift Commander will contact the take the appropriate steps. 5. 'Medical Records: Any medical records received by the Booking Officer will be placed in the inmate's medical file, and will be considered as "confidential information". Evidence of Suicidal Tendency 2. Classification Code: The Booking Officer will then assign a classification code, in the order listed below: a. Sex = "1" (male) or "2" (female) b. Age = "A" (adult) c. Violence = "V" (potentially violent) or "N" (non-violent) "s" (Suicidal) "M" (Mentally Retarded) d. Handicap = "H" (physical handicap) 3. Example: For example, a female adult with no physical or emotional handicap, would be assigned the classification code "2AN". Inmates placed in administrative segregation will receive all privileges granted to inmates in the general population (with the exception that certain materials or activities which may constitute a threat to the inmate's own safety 'or the safety of others may be withheld). Depending on the reason for separation, inmates in administrative segregation may require increased surveillance. PROCEDURE : 1. Criteria: Administrative segregation shall be employed to separate from the general population inmates who: a. Cannot adjust to the general population; b. Pose a serious threat to themselves and/or others; c. Present a valid need for protection from other inmates as determined by the Jail Administrator (e.g., former law enforcement personnel); d. Have a communicable disease; e. Are witnesses. 2. Identification: The recommendation to administratively segregate an inmate shall be referred to the Jail Administrator in the event that immediate isolation is required, referral will be made to the Shift Commander. Identification of such inmates shall be made as follows: a. Each officer has the responsibility to observe the behavior of each inmate and identify those who meet the criteria in Section 1 above. b. The Staff Physician or Nurse shall identify those needing to be isolated for medical/mental reasns. c. The Municipal Court Judge may order the segregation of witnesses or other special inmates being housed at the facility. Page 31 " I, 3.03 - ADMINISTRATIVE SEGREGATION (CONT'D) 3. Decision: The decision to place an inmate in administrative segregation will be made by the Jail Administrator, who will notify the Shift Commander on duty, based on the following: a. A request for segregation by the inmate. writing, signed, and dated by the. inmate. b. Observations or reports from staff of persistently disruptive or disruptive behavior, or abnormal behavior which requires removal from the general inmate population; c. A report from the examining physician; d. Apparent need for protection, or; e. Recommendation of Judge, City Attorney. or arresting Officer. Such a request shall be made in potentially of the inmate 4. Housing Assignment: The Jail Administrator shall determine to which cells inmates in need of administrative segregation will be assigned (see Procedure 3.02). In emergency situations, the Shift Commander on duty. shall assign such inmates to isolation cells. 5. Increased Surveillance: The Jail Administrator shall determine at what interval persons in administrative segregation will be visually observed by staff. Such decisions will be made on an individual basis. All surveillance checks will be recorded in the Daily Log for that housing area (to be checked no less than once every fifteen (15) munutes, at staggered intervals). 6. Notification: Administrator conditions of hearing. Prior to placing an inmate in administrative segregation, the Jail or Shift Commander will fully explain to the inmate the nature and the new status, and notify him/her of the right to a due process 7. Due Process: If the inmate subsequently objects to the placement in administrative segregation, or requests a hearing. the procedures for due process as outlined in Procedure 9.03 shall be followed. Records: Upon removal of the inmate from administrative segregation and re-assignment to a regular housing. unit, the Shift Commander will record the action in the Daily Log. 10. Review of the Inmates Assigned to Segregation: When an inmate is assigned to adminstrative segregation, his or her status shall be reviewed at least every seven .(7) days for the first two (2) months. and at every thirty (30) days, thereafter, to determine if return to normal detention is possible. The Jail Commander shall consider the following factors in the review: a. Whether or not the conditions or circumstances which led to segregation still exist; b. Officers observations of the inmate's behavior, attitude and physical condition during segregation; c. Change in the risk present to the inmate by placement in the general popu- lation; and d. The presence or absence of continued risk to the general population if the inmate is removed from segregation. 11. Documentation: Each time a review is conducted, the process and the results of that review will be written on the due process form and placed in the inmate's file. PROCEDURE: 1. Cell searches (Shakedowns): a. Special: Any officer with the approval of the Jail Administrator or Shift Commander on duty, shall conduct a dormitory cell search, whenever he or she has reason, (e.g., via informants, personal observation of inmates. _ unaccounted for utensils, tools, or other supplies) to believe that contraband may have been introduced into the housing area. b. Routine: At varied times, but not less frequently than twice per month, the Shift Commander shall order a systematic cell search and shall assign Officers accordingly. c. Removal: Inmates will be removed to the recreational area, weather permitting, or an unoccupied cell area during special and routine searches. , d. Contraband: If contraband is found during special or routine cell searches, the procedure set forth in 4.02 will be followed. 2. Inspections: The Jail Administrator or his designee will inspect or assign officers to inspect weekly the security and safety equipment. That inspection will include: a. All locks b. All doors to the cells. cell areas, and the security perimeter c. All video and audio monitoring devices d. First aid kits & breathing apparatus e. Fire extinguishers and hoses f. Reporting: If, during dormitory cell searches, surveillance tours or weekly or monthly security inspections, any irregularities in safety or security are discovered (such' as inoperable locks, damaged equipment, evidence of tampering), each such irregularity will be noted in the Daily Log and reported as soon as possible to the Jail Administrator or his designee. An incident report of the irregularity shall be made. Dates and times of all cell searches and monthly inspections shall be recorded in the Daily Log by the Shift Commander. PROCEDURE: 1. Regular Surveillance: Two Corrections Officers will be on duty at all times and will conduct a tour of each cell area (or other area where inmates are present) checking each inmate at least one every hour on an irregular schedule. 2. Special Surveillance: Me~tally or emotionally disturbed inmates, inmates identified as escape risks, inmates identified as suicide risks. and all inmates housed in the disciplinary isolation, will be observed more frequently, at least once every fifteen (15) minutes. 3. Observation: During a surveillance tour the housing officer will observe inmate's behavior and appearance for unusual or questionable situations (e.g., bruises or cuts on inmates' faces or arms, expressions of hostility. signs of depression). 4. Spot Checks: During one or more of the tours required above. the officer will also spot check the security devices (locks, doors, bars, lights). Any irreg- ularities discovered will be reported as outlined in Procedure 4.03). 5. Records: The Corrections Officer(s) will note in each housing unit's Daily Log any and all significant or unusual events occurring during the shift. The times when each surveillance tour is conducted and the area(s) checked, will be noted in the Daily Log. 6. Change of Shift: When the relieving officer(s) reports for duty, the officer(s) being relieved will direct the attention of the relief housing officer to any significant entries in the log during the shift change briefings. (muster). NOTE: GEORGIA LAW REQUIRES 24 HOUR SUPERVISION OF INMATES BY A PERSON WHO CAN RESPOND IN THE EVENT OF AN EMERGENCY. Page 40 .' ., JAIL POLICY AND PROCEDURES. r: OPERATIONAL AREA 4.05 INMATE COUNTS POLICY: To prevent escapes and to ensure that inmates are accounted for at all times, the Corrections Officer(s) on duty must make frequent and accurate counts. PROCEDURE : 1. Inmate Count: Before an inmate can be regarded as present, the officer conducting the count must see the inmate in the flesh. 2. Schedule: At shift change, the Corrections Officer(s) and the relieving officer together will verify the number of inmates present in each housing unit. Counts will also be verified during the service of meals by the Corrections Officer(s) on duty. 3. Recording: The count will be recorded in the Daily Log and the inmate accounting form and signed by the Shift Commander on duty following the head count. 4. Re-Count: If, after all counts are relayed. the Shift Commander finds that the count does not agree with the previous shift's count, and any subsequent recorded movement of inmates, the Shift Commander will order a lock-do~ and re-count. (Also see Procedures on Escape, 11.03). 5. Upkeep of Records: All admissions to and removals from each housing area will be recorded in the Daily Log. Page 41 " " '-4 JAIL POLICY AND PROCEDURES OPERATIONAL AREA ": 4.06 KEY CONTROL POLICY: The control and accounting of keys is crucial to the maintenance of the facility's security. At no time shall any inmate be allowed to possess any key. The Corrections Officer has the responsibility for the control of and the return of the keys. PROCEDURE: 1. Key Cabinet: All keys for locks within the security perimeter, when not in use, will be kept in the key cabinet in Central Control. 2. Officers will be assigned all keys by the Shift Commander and logged. The backup keys will be maintained in the Administration Office. Keys shall be tagged for easy identification for the area that they control. 3. Back-Up Keys: a. Locations: One complete set of keys to the confinement area will be maintained in the key storage area in the Administration Office. b. Lost or Damaged Keys or Locks: The loss or damage of a key or lock will be reported in writing immediately to the Shift Commander on duty. If the loss appears to have occurred within the security perimeter. the Jail Administrator or his designee will be immediately notified, and the Shift Commander will order a lock-down and conduct a search for the missing key. 4. Key Tracking Log: The Daily Log will act as a key tracking log and will be maintained in Central Control. This log will indicate who is in possession of each key at any given time. All keys must be signed in and out by the Shift .Commander on duty. Page 42 -, , . I, JAIL POLICY AND PROCEDURES OPERATIONAL AREA ". 4.07 CONTROL OF TOOLS AND HAZARDOUS MATERIALS POLICY: No inmates except those on trustee status, shall be given or have access to any tools or hazardous agents (e.g., toxic ~l~aning fluids, drain cleaner, pressurized aerosol cans, or any substance labelled poisonus). The Trustees are to be under the direct and complete control of the Corrections Officer. PROCEDURE : 1. Supervision: Trustees who are assigned certain duties involving the use of tools or hazardous or toxic agents, will only use them under direct supervision of an officer. (See Procedure 7/01/3-5 for further reference). 2. Inventory: The officer who supervises the trustees will be responsible for accounting for all tools and supplies when the work is completed. 3. Discipline: If there is any misuse or attempted misuse of tools or hazardous materials, the officer will prepare a written recommendation to the Jail Admin- istrator to remove the inmate in question from trustee status and to take possible disciplinary action where warranted. JAIL POLICY AND PROCEDURES OPERATIONAL AREA ": 4.08 USE OF FORCE POLICY: Only that amount of physical force necessary to maintain or regain control of an inmate will be used by the staff of the facility. Physical force may be used only when an attack by an inmate(s) on a facility employee(s), visitor(s), or other inmate(s) is actually occurring, is clearly imminent, or when other lesser means have failed to achieve a legitimate and necessary objective. Physical punishment of an inmate by an officer shall 'not be permitted under any circumstances. PROCEDURE : The following procedural guidelines are designed to illustrate that officers have . a number of choices in handling violent or potentially violent situations~ In order" to give an inmate every opportunity to cease his/her disruptive or assaultive activiity and cooperate with the officer, the following steps should be followed whenever possible in sequence: 1. Uncooperative inmate: The officer who encounters an uncooperative inmate (e.g., refuses to enter cell, refuses frisk search, refuses to be removed from cell) will take the following actions: a. Verbal persuasion: Attempt to verbally convince the inmate to cooperate. b. Verbal warnings: If verbal persuasion fails, warn the inmate of the con- sequences of non-ccoperation (use of force, disciplinary sanctions). c. Show of force: If warnings are not effective, call for back-up personnel in an attempt to intimidate the inmate through a show of force. d. Control holds: If a show of force is insufficient, (or impossible), the officer(s) shall attempt to use the physical holds designed to gain control of the inmate (no blows will be struck by the officer, unless the resisting inmate becomes an attacker). Attacking Prisoner: If at any point in the above process, an inmate attempts to physically attack a staff member, a visitor, another inmate, or any other person(s), the following steps shall be taken: a. Back-up: Call for back-up personnel (if not already present). b. Blocks: Block the blows or kicks .of the inmate, giving the i~mate opportunity to reconsider and clearly establishing that the inmate is in fact the aggressor. c. Take-down: If, after the inmate's initial blows or kicks have been blocked, the inmate persists, the officer will attempt to take the inmate down by using minimal force. d. Blows and kicks: If the Officers strength and agility are such that the take- down techniques are not effective (of if the physical setting renders their . pse ineffective), only then may the officer resort to kicks or blows. The . following blows are to be avoided categorically, unless an officer's life or the life of another person is clearly in danger: (1) knuckle blows to the temple; (2) Base of hand blows to the nose; (3) Cupped-hand blows to the ears; (4) Kicks to the groin or head areas, and; (5) Blows or gouges to the eyes; (6) Choke holds When an officer resorts to blows or kicks, only the type and number sufficient to bring the inmate under control shall be used. Such tactics may not be used to inflict unnecessary or permanent injury (thus, the prohibition of 1 through 6 above), but mliy to temporarily disable and only after other means have failed. e. Retreat: Officers may. if all else fails, and if an escape route is open to the officer(s) and if no other persons are or would be open to attack from the inmate, retreat from the scene and obtain a baton and chemical irritant spray (from the Shift Commander). It has lead to a lessening of complaints against officers and of charges of police brutality. The spray of the Cap-Stun'M may be used in any situation where you would be justified in the use of force continuum to subdue a violent subject. The Cap-Stun'. will spray a cone shaped pattern of mist for up to ten feet in still air. In the models equipped with a protective cap, remove the cap before use. B. The spray may be used at any distance under ten feet, the closer to the subject's face, Ihe more effective and faster the results. Use short bursts rather than a prolonged spray and only the amount needed to bring the subject under control. In over a decade of field experience, there has never been a report of adverse reaction to the spray by any subject with respiratory illnesses, heart problems or poor reflexes. The spray has been determined to be effective against drug abusers, psychotics and subjects under the influence of alcohol. C. Spray directly into the subject's face, the closer, the more effective. The spray should be directed toward the subject's eyes, nose and mouth. The spray is v.ery . effective on dogs and other animals. Attack dogs can be effectively subdued with a short burst toward the eyes, nose and mouth. Since the Cap-StunTM spray causes '; no lasting damage, it can be used to control any high stress situation, even if bystanders may be affected by the spray, 1/1. FOLLOW.UP PROCEDURE A. TJ'le effect of the spray on a subject is instantaneous. He can be expected to drop whatever might be in his hands and immediately go for his face with his hands. The active spray ingredient causes acute inflammation of the eyes and all other mucous membranes, resulting in immediate blindness. coughing, choking and nausea with extreme discomfort for up to thirty minutes. B. When the subject has been secured and resistance has ceased, the office'rs should make every reasonable effort to relieve the discomfort of the subject and any affected bystanders. If conditions permit, clear water will relieve the eye inflamma- tion in about four minutes. Moving air and natural body action will remove all other symptoms in thirty minutes or less with no atter effects. No reports have ever been received that medical treatment was ever required to relieve the effects of the spray. Area contamination will be found to be negligible. Hands should be washed to prevent any possible residue from being rubbed in the eyes or before going 10 the restroom. Any residue otherwise remaining on clothing or skin should not be expected to cause problems. C. Following use of the spray in a high stress situation. the canister should be replaced if its total weight is less than the indicated net weight. The pressure will remain fairly constant until almost empty. First. use the baton to block the inmate's blows or kicks, giving the inmate the oppor- tunity to desist and surrender. Second, use the baton to strike the inmate below the neck, in a manner designed only to temporarily disable and gain control, not cause permanent injury. g. Use of chemical irritants: If chemical irritant spray is used. it shall be used only in that amount necessary.to gain control and to cause the inmate to desist. It should never be sprayed directly into the face at close range. The Augusta City Jail uses Cap-Stun). 3. Multiple Prisoners: See Procedure il.Ol. "Riot or Disorder". 4. Medical Examination: Persons involved in a use of force incident who sustain injuries will receive medical attention as follows: a. Prisoners will be treated in accordance with the facility's Medical Emergency Health Care Plan NOTE: Inmates not re~ or receiving immediate medical attention will be scheduled to see a physician during the next sick call. b. All staff persons will be required to receive immediate medical attention and provide documentation of treatment. Also. if injured, staff personnel must fill out a workman's compensation form. c. All other persons will be requested to seek immediate medical attention. 5. Increased Surveillance: Following a use of force incident. the Corrections Officer will observe the inmate at least every fifteen (15) minutes for the next twenty-four (24) hours to detect any noticable change in the inmate's behavior or physcial condition. Investigation: The Jail Administrator or his designee will initiate an investigation of the incident (apart from any investigation for disciplinary charges against the inmates if: a. The inmate alleges an excessive use of force; or b. The Jail Administrator determines from the report(s) that an investigation is warranted. 7. Reporting: After every incident in which an officer(s) or staff member(s) has used physical force, the officer(s) or staff member(s) involved, will immediately file a full report of the incident, citing the reasons for the degree of force used and the results of its use. The report will be transmitted'to the Jail Adminstrator. Use of Force Report will also be signed by the Shift Commander on duty. They will be used only for the prevention of escape, the protection of a prisoner from self-injury or to prevent an inmate from injuring others, or to prevent damage to the facility. PROCEDURE: 1. Protection from Self-Harm: a. Isolation Cell: When an inmate's behavior indicates a potential for an actual attempt at injury to him or herself, the inmate will be removed to an isolation cell. b. Restraints: If, after placement in an isolation cell. the inmate's behavior is still directed toward or indicative of self-harm, the inmate will have physical restraints applied and be assessed for possible transfer to the hospital's mental health unit. When restraints are used in such a manner, they will be used to restrict the movement of the inmate only to the degree necessary and will be affixed in such a way as to cause minimal discomfort f and avoid their injuring the inmate. c. Surveillance: Inmates placed in restraints will be subjected to more frequent observation by the officer(s) assigned to the housing unit. They will observe the inmate at least every fifteen (15) minutes. d. Physician: No inmate will remain in restraint for more than four (4) hours without an examination by a physician or the physician designee. e. Reporting: The removal of an inmate to isolation and the placement of the inmate in restraints for self-protection will be reported immediately to the Jail Administrator or the Shift Commander.
