HomeMy WebLinkAboutORD 7145 CHANGING THE ZONING FROM ZONE B-1 (NEIGHBORHOOD BUSINESS) AND ZONE R-MH (MANUFACTURED HOME RESIDENTIAL) TO ZONE B-2 (GENERAL BUSINESS WINDEMERE DRIVE '. ~ , ORDINANCE NO. 7145 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta- Richmond County Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta-Richmond County Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by changing the zoning from Zone B-1 (Neighborhood Business) and Zone R-MH ( Manufactured Home Residential) to Zone B-2 (General Business) affecting property located on two tracts; Tract 1 located where the southeast right-of-way line of Old U. S. Hwy. 1, intersects the southwest right-of-way line of Windermere Drive and Tract 2 located where the southeast right-of-way line of Old U.S. Hwy. 1 intersects the northeast right-of-way line of Windermere Drive;; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA-RICHMOND COUNTY COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map from Zone B-1 (Neighborhood Business) and Zone R - MH (Manufactured Home Residential) to Zone B-2 (General Business) affecting property as follows: Tract 1 Beginning at a point located where the southeast right-of-way line of Old U. S. Hwy. 1, intersects the southwest right-of-way line of Windermere Drive; thence, in a southeasterly direction a distance of 25 feet, more or less; thence, in a northeasterly direction a distance of 50 feet, more or less, to a point located on the southwest right- of-way line of Windermere Drive; thence, in a southeasterly direction along the southwest right-of-way line of Windermere Drive a distance of 315 feet, more or less, to a point; thence, in a southwesterly direction a distance of 139 feet, more or less, to a point; thence, in a northwesterly direction a distance of 388 feet, more or 'ess, to a point located on the southeast right-of-way line of Old U. S. Hwy. 1 thence, a northeasterly direction a distance of 159 feet, more or less, to the point of beginning. Tract 1 contains 1.31 acres and is known as 2820 Old U.S. Hwy. 1. (Tax Map 118-0-009-02-0) Tract 2 Beginning at a point located where the southeast right-of-way line of Old U.S. Hwy. 1 intersects the northeast right-of-way line of Windermere Drive; thence, in a northeasterly direction along the southeast right-of-way line of Old U. S. Hwy. 1 and the southwest right-of-way line of Wyevale Road a distance of 800 feet, more or less, to a point; thence, in a southwesterly direction a distance 0 662 feet, more or less, to a point located on the northeast right-of-way line of Windermere Drive a distance of 294 feet, more or less, to the point of beginning. Tract 2 contains 3.84 acres and is known as 2802 Old U.S. Hwy 1 (Tax Map 118-0-008-00-0) SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta Richmond County is subject to the following stipulations: 1) the use of the property be limited to hotels or those uses allowed in a B-1 (Neighborhood Business) Zone SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. Done in Open Meeting under the Common Seal thereof this 1~ day of Sept ,2009. APPROVED THlS Sept 15 ,2009.
