HomeMy WebLinkAboutORD 7121 FLOWING WELLS ROAD ,. , ORDINANCE NO. 7121 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta- Richmond County Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta-Richmond County Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by modifying of conditions on a 2008 rezoning case (Z-08-46) that was zoned R-3B (Multiple-family Residential) affecting property located on the northeast right-of-way line of Flowing Wells Road, 147 feet, more or less, north of Elm Avenue; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA-RICHMOND COUNTY COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map by modifying of conditions on a 2008 rezoning case (Z-08- 46) that was zoned R-3B (Multiple-family Residential)affecting property as follows: 2: . () ~ -- Ie; , '. ~ , Beginning at a point located on the northeast right-of- way line of Flowing Wells Road, 147 feet, more or less, north of Elm Avenue; thence, N 35020'06" W along the northeast right-of-way line of Flowing Wells Road a distance of 1,146 feet, more or less, to a point; thence, in a southeasterly direction a distance of 677 feet, more or less, to a point; thence, in a northeasterly direction a distance of 1,614 feet, more or less, to a point located on the southwest right-of- way line of Interstate Parkway; thence, in an easterly direction along the southwest right-of-way line of Interstate Parkway a distance of 152 feet, more or less, to a point; thence, S 12005'24" W a distance of 152.73 feet to a point; thence, in an easterly direction a distance of 163 feet, more or less, to a point; thence, in a southerly direction a distance 1,946 feet, more or less, to a point; thence, in a westerly direction a distance of 834 feet, more or less, to the point of beginning. This property contains approximately 34 acres. (Part of Tax Map 029-0-045-00-0) SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta-Richmond County is subject to the following stipulations: 1. The only development other than uses allowed in the A (Agriculture) zone is to be a luxury apartment or condominium complex 2. If the clients of the petitioner do not close on the property within one year of zoning approval, than the zoning classification shall revert to Zone A (Agriculture). 3. The development shall meet or exceed the requirements of the Augusta-Richmond County Tree Ordinance and contain all amenities expected of a luxury apartment complex in this area. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. Done in Open Meeting under the Common Seal thereof this 21_ day of April 9 ,2000.
