HomeMy WebLinkAboutORD 7082 AUGUSTA NATIONAL AMEND CITY CODE SECTION 3-5-86 TO ADD CERTAIN STREETS Ordinance No. 7082 AN ORDINANCE TO AMEND TITLE THREE OF THE AUGUSTA-RICHMOND COUNTY, GEORGIA CODE TO ADD CERTAIN STREETS TO SECTION 3-5-86, TO REPEAL ALL ORDINANCES IN CONFLICT' HEREWITH, TO PROVIDE AN EFFECTIVE DATE AND FOR OTHER PURPOSES. WHEREAS, The Augusta National Golf Club (hereinafter "Augusta National") now owns ninety-five (95%) of the land located West of Berckmans Road from the intersection ofthe 2700 block of Washington Road to the 400 block ofBerckmans Road, WHEREAS, the Augusta National is unable to utilize motorized carts to travel on public streets and roads within their property lines impedes its employees in the performance of their duties relating to the maintenance and upkeep of Augusta National Golf Club and from having expedient access to its property; WHEREAS, A designated alternative route for the operation of golf and motorized carts will further interfere with the timely and orderly operation of the Augusta National Golf Club and The Masters Tournaments, WHEREAS, Augusta-Richmond County has a public interest in the safety of Augusta-Richmond County residents and visitors and in the successful and safe execution of The Masters Tournament, THE AUGUSTA-RICHMOND COUNTY COMMISSION hereby ordains as follows: SECTION 1. Augusta Richmond-County Code Section 93-5-86 as set forth in Ordinance No. 6436, enacted November 19, 2002 and as amended in Ordinance No. 6991, enacted July 10, 2007, is hereby amended by adding subsection (b)(3) relating to use of motorized carts on public streets, West of Berckmans Road as set forth in "Exhibit A" hereto. SECTION 2. This ordinance shall become effective upon its adoption in accordance with applicable laws. SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed. (a) No person shall operate any motorized cart upon a street, road, or public highway in /.ugusta Richmond County, except as specifically pro'lided herein. Further, no person shall operate any motorized cart on pri'/ate property vlithout the permission of the owner of such private property. (b) Pursuant to O.C.G."'\.. ~ 1 6 331, the follo',ving public streets and portions thereof arc hereby designated for the combined l:lse of motorized carts and regular vehicular traffic, l:lpon the conditions hereinafter set forth: (I) J. Dcvley Gray Circlc, Wainbrook, Devore Place, and that section of Interstate Parkway lying between the intersection of Wainbrook and De':ore Place, are hereby designated for the combined use of motor ized carts and regular vehicular traffie as provided herein; and, (2) /.ll that portion of Tenth Street located between Broad Street and the Savannah River, provided that such l:lse may occur only on the "First Friday" of each month, behveen the hours of 5:00pm and 8:00pm, or at such other time(s) authorized by the Mayor of /..ugusta. (c) Appropriate signs giving notice of the combined use of motorized carts and regular '/ehicular traffic shall be posted on said roads as directed by the Traffic Engineer. (d) No motorized carts shall operate on said strects except between the hours of 30 minutes follo"ving sunrise and 3 0 minutes prior to sunset, except as othenyise provided herein. (e) All motorized carts shall be equipped with headlights, brake lights, a yellow caution light mounted on top of such motorized cart, and a caution sign. (f) "'\.ll such motorized earts shall be registered ",lith the Richmond County Sheriffs Office for a fee of Fifteen Dollars ($15.00), with the license for same to remain permanently v:ith such cart unless such cart is sold, at '.vhich time the license shall be destroyed. (g) i\ll motorized carts shall obey all rules of the road governing vehicular traffic on said publiG fGaG&.. Sec. 3-5-86. Opera tin!! a motorized cart on a public street. road or hi!!hwav. Further, no person shall operate any motorized cart on private property without the permission of the owner of such private property. (b) Pursuant to O.C.G.A. & 40-6-33 L the following public streets and portions thereof are hereby designated for the combined use of motorized carts and regular vehicular traffic, upon the conditions hereinafter set forth: , \ .. (1) J. Dewey Gray Circle. Wainbrook. Devore Place. and that section ofInterstate Parkway lying between the intersection of Wain brook and Devore Place. are hereby designated for the combined use of motor- ized carts and regular vehicular traffic as provided herein: and. (2) All that portion of Tenth Street located between Broad Street and the Savannah River. provided that such use may occur only on the "First Friday" of each month. between the hours of 5:00pm and 8:00pm. or at such other timers) authorized by the Mayor of Augusta. (3) All that portion of Heath Drive beginning at the 300 block of Berckmans Road leading to the 400 block of Berckmans Road: All that portion Cherry Lane from the 300 block ofBerckman's Road to the 300 block of Heath Drive: All that portion of Hemlock Hill Road from 300 block of Heath Drive to 2000 Block of Cherry Lane: All that portion of Hillside lane from the 300 Berckman's Road to the dead end. All that portion of Stan lev Drive from 300 block of Heath Drive to 2700 block of Washington Road. (c) Appropriate signs giving notice of the combined use of motorized carts and regular vehicular traffic shall be posted on said roads as directed by the Traffic Engineer. (d) No motorized carts shall operate on said streets except between the hours of 30 minutes following sunrise and 30 minutes prior to sunset. except as otherwise provided herein.
