I ' .. ~ ORDINANCE NO. 7061 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta- Richmond County Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta-Richmond County Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by changing the zoning from Zone A (Agriculture) to Zone R-3B (Multiple-family Re&idential) affecting property located on the northeast right-of-way line of Flowing Wells Road, 148 feet, more or less, northwest of Elm A venue; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA-RICHMOND COUNTY COMMISSION HEREBY ORDAINS: SECTION 1. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map from Zone A (Agriculture) to Zone R-3B (Multiple-family Residential) affecting property as follows: Beginning at a point located on the northeast right-of- way line of Flowing Wells Road, 148 feet, more or less, northwest of Elm Avenue; thence, in a northerly direction along the northeast right-of-way line of Flowing Wells Road a distance of 1,900 feet, more or less, to a poirit; thence, N 85058' 52" E a distance of 700.00 feet to a point; thence, N 53039'33" E a distance of 600.00 feet to a point located on the southwest right-of-way line of Interstate Parkway; thence, in an easterly direction along the southwest right-of-way line of Interstate Parkway a distance of 685 feet, more or less, to a point; thence, in a southeasterly direction a distance of 1,350 feet, more or less, to a point; thence, in a southwesterly direction a distance of 1,750 feet, more or less, to the point of beginning. This property contains approximately 70 acres and is known i- .. .. under the present numbering system as 1304, 1314, and 1320 Flowing Wells Road. (Tax Map 029-0-045-00-0, 029- 0-045-01-0, 029-0-046-00-0 and part of 029-0-044-00-0) SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta-Richmond County is subject to the followings stipulations: 1. Only development permitted other than uses allowed in the A (Agriculture) zone to be a luxury apartment or condominium complex; 2. Development of the property must substantially conform to the site plan as submitted except that any entrance south of the intersection of Maddox Road and Flowing Wells Road shall be gated and locked and for emergency use only; 3. If the clients of the petitioner do not close on the property within one year of zoning approval, then the zoning classification shall revert to Zone A (Agriculture); 4. The development shall meet or exceed the requirements of the Augusta-Richmond Tree Ordinance and contain all amenities expected of a luxury apartment complex in this area. SECTION III. All Ordinances or parts of Ordinances in :;onflict with this Ordinance are hereby repealed. Done in Open Meeting under the Common Seal thereof this ~ day of June ,2008.
