7055
AN ORDINANCE TO AMEND TITLE 7, CHAPTER 1, ARTICLE 4 OF THE
AUGUSTA-RICHMOND COUNTY CODE TO MODIFY THE COMPOSITION
OF THE CONSTRUCTION ADVISORY BOARD; TO PROVIDE AN
EFFECTIVE DATE; TO REPEAL CONFLICTING ORDINANCES; AND FOR
OTHER PURPOSES.
WHEREAS, O.C.G.A.S43-4-1 et.al. provides that Residential-Basic Contractors and
General Contractors are to obtain a license from the State Licensing Board of the Georgia
Secretary of State's Office;
WHEREAS, The Governor of Georgia and the Georgia General Assembly, in the interest
of public safety, public health and to provide safeguards for homeowners, passed a bill
requiring Residential-Light Commercial Contractors to obtain a license from the State
Licensing Board of the Georgia Secretary of State's Office beginning July 1,2008,
WHEREAS, The Augusta-Richmond County Construction Advisory Board desires to
have equal representation in its body to reflect all classifications of contractors required
to have contractor licenses in Georgia;
THE AUGUSTA-RICHMOND COUNTY COMMISSION amends the Augusta-
Richmond County Code as follows:
Section 1. Sections 7-1-46 and 7-1-47 of Title 7, Chapter 1, Article 4, shall be stricken
its entirety relating to the creation and composition and inserting in lieu thereof section 7-
1-46 and 7-1-47 as restated and set forth in "Exhibit A" hereto:
Section 2. This ordinance shall become effective upon adoption in accordance with
applicable laws.

Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereTJy
repealed.

There is hereby created the "^~l:1gusta Richmond Count)' Construction "^~d'lisory Board
'.vhich shall consist of ten (10) members. The Board shall serve in an advisory and
mediation capaeity only, and all members shall be appointed by the Augusta Richmond
County Commission and shall serve at the pleasure thereof.
See. 7 1 47. Composition.
The board shall be composed of the follo'Ning:
a. One (1) licensed electrical contractor;
b. One (1) master plumber;
e. One (1) licensed H'I}~C contractor;
d. One (1) commercial contractor;
e. One (1) residential contractor;
f. One (1) architect;
g. One (1) electrioal engineer;
h. One (1) consulting engineer;
i. One (1) consumer member Super Distriet 9; and
j. One (1) consumer member Super District 10.
Members, other than the initial members, shall be appointed for terms of four (1) years.
Yacancies shall be filled for an unexpired term in the amount of which the original
appointments are reql:1ired to be made. CoHtinl:1ed absence of any member from reg1:llar
meetings of the Board shall, at the discretion of the Commission, render any such
member liable to immediate removal from office.
The Augusta Richmond County employee holding the position of Director Building
Official of the License and Inspection Department shall be responsible for all
administrative duties and support to the "^~dyisory Board. The Director Building Official,
Building Inspectors, Planning Commission Director, Utilities Department Director,
Public 'Works Director, and Fire Chief, employed by }~ugusta Richmond County shall
ser;e in an advisory capacity as non voting, ex officio members of the }~dvisory Board.
At its first meeting of each calendar year, the Construction ..^~d'fisory Board shall elect
one (1) of its members as Chairman and one (1) of its members as Vice Chairman to
ser';e during the calendar year and until his/her successor has been elected and qualified
for office. The Chairman shall preside at meeti8gs of the Ad'lisory Board. In the absence
of the Chairma8, the Vice Chairman shall preside at the meetings. In order to take any
action, a qUOfl:lm of at least a majority of the voting members of the }..dvisory Board must
be present at the duly called meeting. "^~ 'lote of a majority of the 'foting members present
at the duly called meeting at '.vhich a quorum is present shall be required to adopt or
approve any proposed action by the Board. The Construction Advisory Board shall meet
