HomeMy WebLinkAboutORD 7048 MARKS CHURCH ROAD ORDINANCE NO. 7048 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta-Richmond County Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta-Richmond County Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by changing the conditions resulting from change of zoning in 2006 (Z- 06-30) to Zone B-2 (General Business) with conditions affecting property located on the southeast right-of-way line of Marks Church Road, 470 feet, more or less, southwest of Wheeler Road; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA-RICHMOND COUNTY COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map by modifying the conditions resulting from change of zoning in 2006 (Z-06-30) to Zone B-2 (General Business) affecting property as follows: Beginning at a point located on the southeast right-of- way line of Marks Church Road, 470 feet, more or less, southwest of Wheeler Road; thence, in a southeasterly direction a distance of 459 feet, more or less, to a point; thence, in a southwesterly direction a distance of 1,274 feet, more or less, to a point; thence, in a northwesterly direction a distance of 300 feet, more or less, to a point located on the southeast right-of-way line of Marks Church Road; thence, in a northeasterly direction along the southeast right-of-way line of Marks Church Road a distance of 1,199 feet, more or less, to the point of beginning. This property contains approximately 11.4 acres and is known under the present numbering system as 1128 Marks Church Road. (Tax Map 31 Parcel 4.1) SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta-Richmond County is subject to the following conditions: 1. Use of property shall be limited to uses permitted under the present zoning (B-1; with conditions) or the following uses permitted in the B-2 (General Business) zone: . Hotel . Golf driving range . Boat dealership . Funeral home . New car dealership with incidental functions; parts sales, service, repair and used . car sales . Mini-warehouses 2. A 50 foot undisturbed natural buffer adjoining Kingston Subdivision with an 8 foot wooden; 3. No access to Dominica Drive; 4. The maximum height of any sign on the property shall be 50 feet; 5. Developer to pay for any improvements within the right of way deemed necessary to accommodate development that are not part of the GA DOT project; and 6. Illumination: . All building wall lighting on walls facing Kingston Subdivision shall be directed down the building, not outward; . All freestanding lighting located within 100 feet of Kingston Subdivision shall be full cutoff lighting that does not shine onto Kingston properties. There shall be no more than 5 freestanding lights within 100 feet of Kingston Subdivision; . All other lighting shall be directed away from the area within 100 feet from Kingston Subdivision. 7. The maximum height of any structure shall be 55 feet. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed.
