ORDINANCE NO. 7046
A resolution by the Augusta-Richmond County Planning Commission recommending that the
Site Plan Regulations be amended as follows:
AN ORDINANCE TO AMEND A PORTION OF SECTION 301 OF THE SITE PLAN
REGULATIONS, ADOPTED BY THE AUGUSTA COMMISSION ON OCTOBER 20,
1998 PERTAINING TO WETLAND IDEMNIFICATION
THE AUGUSTA COMMISSION HEREBY ORDAINS:
SECTION I. That the Ordinance regulating site plans in Augusta, Georgia, is amended by
deleting a portion of Section 301 as follows:
For any Site Plan that includes wetlands shown on the National Wetlands
Inventory maps or subject to permitting by the US Army Corps of Engineers
under Section 404 of the Clean Water Act of 1977, the following must be
submitted:
· The orientation and distance from the boundaries of the proposed site to the
nearest bank of an affected perennial stream or water body.
· A delineation of any wetland areas shown on the National Wetlands Inventory
Maps as subject to permitting by the U.S. Army Corps of Engineers under
Section 404 of the Clean Water Act of 1977. Evidence that proper permits have
been granted by the Corps shall be required before a Site Plan may be approved.
National Wetland Inventory Maps are available at the office of the Planning
Commission to assist in making this determination.
SECTION II. That the Ordinance regulating site plans in Augusta, Georgia, is amended by
adding a new portion of Section 301 as follows:
An executed wetland indemnification form provided by the Planning Commission
accepting responsibility for activities that would be affected by Section 404 of the
Clean Water Act of 1977 and require permitting by the U.S. Army Corps of
Engineers;
A delineation of any wetland areas that are shown on the National Wetland
Inventory Maps or identified through field studies. Evidence that a
preconstruction notification with the Corp. has been filed pursuant to Section 404
of the Clean Water Act, or statements from properly accredited professionals in
wetland identification as to why they are not needed must be provided before a
development plan/site plan may be approved.
SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby
repealed.
