HomeMy WebLinkAboutORD 7033 BAYVALE ROAD SIBLEY ROAD -'j ORDINANCE NO.~.3 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta- Richmond County Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta-Richmond County Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by changing the zoning from Zone B-2 (General Business) with conditions and Zone R-3B (Multiple-family Residential) to Zone R-3B affecting property located on the southwest right-of-way line of Bayvale Road, 970 feet, more or less, southeast of Sibley Road; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA-RICHMOND COUNTY COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map from Zone B-2 (General Business) with conditions and Zone R-3B (Multiple-family Residential) to Zone R-3B affecting property as follows: Beginning at a point located on the southwest right-of- way line of Bayvale Road, 970 feet, more or less, southeast of Sibley Road; thence, in a southeasterly direction along the southwest right-of-way line of Bayvale Road a distance of 75 feet, more or less, to a point; thence, in a southwesterly direction a distance of 175 feet, more or less, to a point; thence, in a southeasterly direction a distance of 75 feet, more or less, to' a point; thence, in a southwesterly direction a distance of 340 feet, more or less, to a point; thence, in a northwesterly direction a distance of 450 feet, more or less, to a point; thence, in an easterly direction a distance of 20 feet, more or less, to a point; thence, in a northerly direction a distance of 640 feet, more or less, to a point ;thence, in a southeasterly direction a distance of 755 feet, more or less, to a point; thence in a northeasterly direction a distance of 175 feet to the point of beginning. This property contains approximately 6.7 acres and is known as 2125 Bayvale Road (Part of Tax Map 05S Parcel 006-01) z~ 08-)' .. . ~ SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta-Richmond County is subject to the following conditions: That a 20 foot buffer conforming with the Augusta-Richmond County Tree Ordinance rear yard requirements be constructed and maintained along the northeast property line adjacent to the rear property lines of the Bayvale Road residents. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. Done in Open Meeting under the Common Seal thereofthis !- 9 day of j~, 2008.
