ORDINANCE NO.~ An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta- Richmond County Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta- Richmond County Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by changing the zoning from R-IB (One-family Residential) to Zone B-2 (General Business) affecting property located on the northeast comer of the intersection of Barton Chapel Road and Sharon Road; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA-RICHMOND COUNTY COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map from R-IB (One-family Residential) to Zone B-2 (General Business) affecting property as follows: Beginning at a point located on the northeast corner of the intersection of Barton Chapel Road and Sharon Road; thence, in a northerly direction along the northeast right-of-way line of Barton Chapel Road a distance of 129 feet, more or less, to a point; thence, in an easterly direction a distance of 282 feet, more or less, to a point; thence, in a southeasterly direction a distance of 104 feet, more or less, to a point; thence, in a southwesterly direction a distance of 145 feet, more or less, to a point located on the north right-of-way line of Sharon Road; thence, in a westerly direction along the nort~ right-of-way line of Sharon Road a distance of 170 feet, more or less, to the point of beginning. This property contains approximately 1.1 acres and is known as 1650 Barton Chapel Road. (Tax Map 054 Parcel 028) V ,I: SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta-Richmond County is subject to the following stipulations: 1) no access to Sharon Road; 2) no freestanding signage wi thin 100 feet of the right- of-way of Sharon Road; 3) a 10 foot buffer conforming with the Augusta-Richmond County Tree Ordinance side bufferyard requirements including a 6 foot solid board fence along Sharon Road right-of-way with no gate except as required by fire codes; 4) buildings shall not exceed 2 ~ stories or 45 feet in height and 5) the use shall be limited to a landscape service business or those uses allowed in a B-1 (Neighborhood Business) Zone SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. Done in Open Meeting under the Common Seal thereofthis 5t~ day of Feb', 2008.
