AN ORDINANCE TO AMEND ORDINANCE NO. 6875 SO AS TO AMEND ~ 7-1-19.2
OF THE AUGUSTA CODE SO AS TO ADD AN ADDITIONAL SECTION THERETO
TO BE KNOWN AS ~ (c) SO AS TO PROVIDE FOR A TERM OF ONE (1) YEAR THE
MOTHBALLING PERMITS AUTHORIZED BY SAID ORDINANCE; TO PROVIDE
FOR A ONE (1) YEAR RENEWAL OF SAID PERMIT; TO PROVIDE AN EFFECTIVE
DATE; TO PROVIDE FOR SEVERABILITY; AND FOR OTHER LAWFUL PURPOSES
NOW, THEREFORE, be it ordained by the Augusta-Richmond County Commission and
is hereby ordained by the authority of the same, as follows:
SECTION 1. PURPOSE
The purpose of this ordinance is to amend the "mothballing" ordinance so as to set forth a
term and renewal term for the mothballing permit authorized in Augusta Code S 7-1-19.
This ordinance recognizes that the goal of mothballing is to temporarily protect a
property and any improvements thereon to allow an owner to plan the property's future, or
acquire lands for preservation, rehabilitation or restoration.
SECTION 2. The Augusta-Richmond County Code, Title 7, Chapter 1, Section 19.2 is hereby
amended by adding thereto at the end of Subsection (b) hereof a new subsection to be known as
Section 7-1-19.2(c) which provides as follows:
(c) Term of permit, one year; option to renew for one year.
A mothballing permit shall be valid for one year next following the date of the
registration of the property and may be renewed for one year next following the first anniversary
of the date of the issuance of said permit. The fee for the renewal term shall be $20.00 and shall
be paid when application is made for renewal.
SECTION 3. This ordinance shall become effective upon adoption
SECTION 4. All ordinances or parts of ordinances in conflict with this ordinance are hereby
repealed.
SECTION 5. If any section, provision or clause of any part of this ordinance be declared invalid.
or unconstitutional or if the provisions of any part of this ordinance as applied to any particular
situation or set of circumstances be declared invalid or unconstitutional such invalidity shall not
be construed to affect portions of this ordinance not so held to be invalid or the application of
this ordinance to other ordinances not so held and be invalid. It is hereby declared as the intent
that this ordinance would have been adopted had such invalid portion not be included herein.
