ORDINANCE NO. 6941 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta- Richmond County Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta-Richmond County Commission as authorized under the Home Rule provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by changing the zoning from Zone A (Agriculture) and Zone R-lB (One-family Residential) and Zone R-IC (One-family Residential) to Zone LI (Light Industry) affeCting property located on the west side of Barton Chapel Road, 125 feet, south of the southwest comer of Eidson Drive and Barton Chapel Road; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA-RICHMOND COUNTY COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map from Zone A (Agriculture) and Zone R-lB (One-family Residential) and Zone R-IC (One-family Residential) to Zone LI (Light Industry) affecting property as follows: Zro~-l~a .1. Beginning at a point located on the west side of Barton Chapel Road, 125 feet, south of the southwest corner of Eidson Drive and Barton Chapel Road; thence, S 23027'28" E along the west right-of-way line of Barton Chapel Road a distance of 442.38 feet to a point; thence, S 72056'05" W a distance of 913.01 feet to a point; thence, N 17025' 13" W a distance of 437.52 feet to a point; thence, in an easterly direction a distance of 866.48 feet to the point of beginning. This property contains 8.98 acres. (Part of Tax Map 053-2 Parcel 113) SECTION II. This amendment to the Comprehensive zoning Maps for Augusta- Richmond County is subject to the following conditions: 1. 20 foot buffer on all sides of the property 2. Signage limited to what would be permitted in the B-1 (Neighborhood Business) zone 3. The only uses of the property shall be the following: . Any use permitted in the R-1C (One-family Residential) zone .. Mini warehouses, 22-1 (b )-(9) . Business park, 22-1 (b) (11) . Wholesale, storage and warehouse facilities, 23-1 (b)(1) . Lumber, feed and other similar storage yards, but not salvage yards, coal yards, or junk yards, 23-1 (b )(2) . Uses of alight industrial nature... .., 23-1 (b) (3) . Storage of construction equipment and other heavy equipment and trucks in excess of one ton capacity and having three or more axles, 23-1 (b) (5) 4. A substantial conformance to a preliminary site plan with purchaser having the option to change the driveway to realign with Sharon Road. 5. Purchaser agrees to provide circular driveway for egress/ingress at 1715 Barton Chapel Road as long as property remains residential. 6. Purchaser will develop property whereas any existing water runoff will be corrected. Site plan approval will address water run off concerns of adjacent property owners. 7. Dirt berm will be installed with agreeable planting by all parties. 8. Purchaser will adamantly pursue the BEST mosquito control for the area. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. Done in Open Meeting under the Common Seal thereof this 1 ~ day of J an ,2006.
