Home My WebLink AboutORD 6863 RESALE OF WATER Ordinance No. 6863 AN ORDINANCE TO AMEND AND RESTATE TITLE 5 CHAPTER 2 SECTION 8 OF THE AUGUSTA-RICHMOND COUNTY CODE SO AS TO REPEAL AUGUSTA'S PRESENT POLICY PROHIBITING THE RESELLING OR REDISTRIBUTION OF WATER; AND TO ESTABLISH A NEW POLICY AUTHORIZING AND REGULATING THE RESALE OF WATER; TO PROVIDE FOR SEVERABILITY; TO PROVIDE AN EFFECTIVE DATE AND FOR OTHER LAWFUL PURPOSES NOW, THEREFORE, BE IT ORDAINED BY THE AUGUSTA-RICHMOND COUNTY COMMISSION AND IT IS HEREBY ORDAINED BY THE AUTHORITY OF THE SAME, as follows: SECTION 1. The purpose ofthis ordin ance is to encourage water conservation. SECTION 2. Owners or operators of property which is provided with water and/or sewer service by the Augusta water and sewer system, and which contain residential or commercial units not billed directly by the City may on and after separately charge the tenants or occupants of those units for the costs of providing water and wastewater service provided the conditions hereinafter set forth are met: a) The total amount charged to the tenants or occupants (customers) shall not exceed the amount charged by the City to the property owner or operator for the same period and equivalent usage, plus an administrative fee for servicing the account. b) The administrative fee for water and sewer service must be separately itemized on each bill to the customer. c) The administrative fee for water and sewer service shall not exceed $5.00 per invoice or bill to any customer unless the fee rate has been first approved by the Augusta Utilities Department Director and the Augusta Administrator. d) The full terms of service and a description of all charges shall be clearly disclosed to the customer in a contractual agreement prior to billing. e) The owner or operator shall provide customers with a toll-free customer service phone number. f) An electronic or written copy of all rates and customer bills issued for the previous 24 months shall be maintained and such records shall be made available upon request to the City and/or to the customer billed. g) The owner or operator shall remain solely responsible for timely payment of all City water and sewer charges. Payment to the City shall not be dependent upon collections from the tenants or occupants. h) If individual meters are installed, they shall be of a type and quality approved for such use by the Augusta Utilities Department. SECTION 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 4. I f any section, provision or clause of any part of this ordinance be declared invalid or unconstitutional or if the provisions of any part of this ordinance as applied to any particular situation or set of circumstances be declared invalid or unconstitutional such invalidity shall not be construed to affect portions of this ordinance not so held to be invalid or the application of this ordinance to other ordinances not so held and be invalid. It is hereby declared as the intent that this ordinance would have been adopted had such invalid portion not be included herein.
