ORDINANCE NO. 6835 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta- Richmond County Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta- Richmond County Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by changing the zoning from Zone A (Agriculture) and Zone B-2 (General Business) to zone HI (Heavy Industry with a Special Exception to operate an inert fill area affecting property located 165 feet south of the southeast right-of-way line of Gordon Highway and ~lso being 1,080 feet, more or less, southwest of Madrid Drive North; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA-RICHMOND COUNTY COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above; is amended by changing the Comprehensive Zoning Map from Zone A (Agriculture) and Zone B-2 (General Business) to zone HI (Heavy Industry with a Special Exception to operate an inert fill area affecting property as follows: Beginning at a point located 165 feet south of the southeast right-of-way line of Gordon Highway and also being 1,080 feet, more or less, southwest of Madrid Drive North; thence, in a southeasterly direction a distance of 400 feet to a point; thence, in a southwesterly direction a distance of 787 feet, more or less, to a point; thence, in a northerly direction a distance of 400 feet to a point; thence, in a northeasterly direction a distance of 730 feet, more or less, to the point of beginning. This property contains approximately 7 acres and is the rear portion of 2338 Gordon Highway. (Part of Tax Map 67 ParcellS) z. C~ ... \.OJ J. . SECTION II . This amendment to the Comprehensive Zoning Maps is subject to the following stipulations: 1) that if the wood mulching operation should cease the zoning shall revert to the former zoning, 2) that a 200 foot natural buffer between this property and the residents of Madrid Drive North (the buffer would not be located within the area to be rezoned but shall be binding so long as the wood mulching operation exists) 3) hours of operation shall be daylight to dusk and 4) the only HI (Heavy Industry) Zone use of the property shall be a wood mulching operation with no inert fill area. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. Done in Open Meeting under the Common Seal thereof this 18 _ day of ,2005.
