ORDINANCE NO. 6821 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta- Richmond County Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta-Richmond County Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by changing the zoning from Zone R-l (One-family Residential) to Zone A (Agriculture) with a Special Exception to reactivate and expand an existing dirt/sand mine per Section 7-2 (a) affecting property located on the northwest right-of- way line of Duncan Drive (dirt), a distance of3,150 feet, more or less, northeast of Brown Road; and for the repeal of ordinances in conflict herewith and for other purposes: ( \0 THE AUGUSTA-RICHMOND COUNTY COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map from Zone R-l (One-family Residential) to Zone A (Agriculture) with a Special Exception to reactivate and expand an existing dirt/sand mine per Section 7-2 (a) affecting property as follows: Tract A Beginning at a point located 1,500 feet, more or less, southeast of the northwest right-of-way line of Duncan Drive (dirt) and also being 3,150 feet, more or less, northeast of Brown Road; thence, S 78008'05" E a distance of 518.41 feet to a point; thence, S 02025'36" W a distance of 155.10 feet to a point; thence, S 65000' 11 " W a distance of 588.23 feet to a point; thence, N 03038'05" E a distance of 511.45 feet to the point of beginning. This property contains approximately 3.9 acres and is a southeastern portion of 4060 Duncan Drive. (Part of Tax Map 181 Parcel 4) Tract B Beginning at a point located 1,530 feet, more or less, south of the northwest right-of-way line of Duncan Drive (dirt) and also being 3,150 feet, more or less, northeast of Brown Road; thence, S 57042'25" E a distance of593.34 feet to a point; thence, S 65000'4" W a distance of 500.68 feet to a point; thence, N 02033 '25" E a distance of 660.52 feet to the point of beginning. This property contains approximately 3.26 acres and is a portion of 4060 Duncan Drive. (Part of Tax Map 181 Parcel 4) Z_oS-"8~ -;< . /.1 .-' SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta- Richmond County is subject to the following stipulations: 1) the mining operation shall be limited to a term of not more than 5 years, 2) only the petitioner, family members or employees of the family may haul from the site, no outside companies may haul from the site. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. Done in qpen Meeting under the Common Seal thereof this 2L day ofSeptembe~2005.
