' ORDINANCE NO. 6773 AN ORDINANCE TO RESCIND THE DESIGNA TION OF BETHLEHEM AS A LOCAL HISTORIC DISTRICT. WHEREAS, on April 5, 1993, the City Council of Augusta approved a Resolution designating Bethlehem as a local historic district pursuant to Ordinance No. 5648 passed on February 3, 1992, which sets forth the required components of an Ordinance designating any property or district as historic; and WHEREAS, the City Council of Augusta consolidated with Richmond County on January 1, 1996, and a new political subdivision known as Augusta, Georgia, was created by Act of the Georgia General Assembly (1995 laws, p 3648 as amended by 1996 GA Laws, P. 360, 1997 GA Laws p 4690, 1997 GA Laws P 4024, and others, Act No. 134 (S.B. 167), governed by the Augusta-Richmond County Commission. WHEREAS, the Historic Preservation Ordinance, as presently included in the Augusta-Richmond County Code at 7-4-15 (j), provides a procedure under which the Augusta-Richmond County Commission may rescind an Ordinance designating an historic district or an historic property; and WHEREAS, said procedure including a public hearing as described at 7-4-15 (c), and a recommendation from the Historic Preservation, has been followed; NOW, THEREFORE BE IT ORDAINED BY THE AUGUSTA-RICHMOND COUNTY COM:M:ISSION, and it is hereby ordained by authority of same as follows: Section I. The Resolution approved by the City Council of Augusta on April 5, 1993, designating the Bethlehem neighborhood as an historic district, is hereby rescinded; Section II. All actions of the Historic Preservation Commission with respect to the Bethlehem District taken prior to the effective date of this Ordinance are ratified and confirmed, without regard to any alleged irregularities in the method of designation. Section III. In the event that any section, subsection, sentence, clause or phrase of this Ordinance shall be declared or adjudged invalid or unconstitutional, such declaration or adjudication shall in no manner affect the other sections, sentences, clauses, or phrases of this Ordinance, which shall remain in full force and effect, as if the section, subsection, sentence, clause or phrase so declared or adjudged invalid or unconstitutional was not originally a part thereof. 1 - . --. i1,~. , ... . .
