ORDINANCE NO. 6735 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta- Richmond County Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta- Richmond County Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by changing the zoning from Zone R-l (One-family Residential) to Zone R-IC (One-family Residential) affecting property located located on the east right-of-way line of Monte Sano Avenue, 290 feet north of the northeast comer of the intersection of Walton Way; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA-RICHMOND COUNTY COMMISSION HEREBY ORDAINS: SECTION 1. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map from Zone R-l (One-family Residential) to Zone R-IC (One-family Residential) affecting property as follows: 2-oH- g 1 I I .' I Beginning at a point located on the east right-of-way line of Monte Sano A venue, 290 feet north of the northeast comer of the intersection of Walton Way; thence, N 05038'47" E along the east right-of-way line of Monte Sano Avenue a distance of 67.49 feet to a point; thence, S 84038'09" E a distance of 110.38 feet to a point; thence, S 05038'47" W a distance of 67.44 feet to a point; thence, N 84040'42" W a distance of 110.38 feet to the point of beginning. This property contains .17 acres and has recently been assigned the address of 1010 Monte Sano Avenue. (part of Tax Map 34-3 Parcel 68) SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta-Richmond County are subject to the following stipulations: The petitioner must receive design approval from Historic Preservation Commission and obtain a Board of Zoning Appeals variance for the front setback or build within the existing front setback within one year or the zoning reverts back to R-1 (One-family Residential) . SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. Done in Open Meeting under the Common Seal thereof this ~ day of Oct ,2004.
