YEAR: OL1 BOX NUMBER: 23 FILE NUMBER: \ 1 t-i L-{ 2 NUMBER OF PAGES: (g ..., ORDINANCE 6729 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by Augusta Richmond County Commission effective September 16, 1997 by amending Sections 7, 8,9,10,11,15,16,17,18,20,21,22,24, and 26 to provide for time limits for the initiation and reestablishment of uses permitted by Special Exception and to invalidate certain Special Exceptions previously granted. THE AUGUSTA COMMISSION HEREBY ORDAINS: \ SECTION I. That the Comprehensive Zoning Ordinance IS amended by adding the following new Subsection 7-3 in the A (Agricultural) zone: Subsection 7-3 Any use established as a result of a Special Exception granted per Subsection 7-2 must be initiated within six (6) months of the granting, or the Special Exception shall no longer be valid. The initiation of a use is established by the issuance of a valid business license by the Augusta License and Inspections Department or by other reasonable proof of the establishment of vested rights. If a Special Exception is granted and the use is initiated but later ceases to operate for a period of one (1) year, then the Special Exception shall no longer be valid. SECTION II. That the Comprehensive Zoning Ordinance is amended by adding the following new Subsection 8-10 in the R-l (Single-family Residential) zone: Subsection 8-10 Any use established as a result of a Special Exception granted per Subsection 8-2 must be initiated within six (6) months of the granting, or the Special Exception shall no longer be valid. The initiation of a use is established by the issuance of a valid business license by the Augusta License and Inspections Department or by other reasonable proof of the establishment of vested rights. If a Special Exception is granted and the use is initiated but later ceases to operate for a period of one (1) year, then the Special Exception shall no longer be valid. 2AwK-/~~ " SECTION III. The initiation of a use is established by the issuance of a valid business license by the Augusta License and Inspections Department or by other reasonable proof of the establishment of vested rights. If a Special Exception is granted and the use is initiated but later ceases to operate for a period of one (1) year, then the Special Exception shall no longer be valid. SECTION V. That the Comprehensive Zoning Ordinance is amended by adding the following new Subsection 11-3 to the R-l C (Single-family Residential) zone: Subsection 11-3 Any use established as a result of a Special Exception granted per Subsection 11- 2 must be initiated within six (6) months of the granting, or the Special Exception shall no longer be valid. The initiation of a use is established by the issuance of a valid business license by the Augusta License and Inspections Department or by other reasonable proof of the establishment of vested rights. If a Special Exception is granted and the use is initiated but later ceases to operate for a period of one (1) year, then the Special Exception shall no longer be valid. SECTION VI. That the Comprehensive Zoning Ordinance is amended by adding the following,new Subsection 15-5 to the R-2 (Two-family Residential) zone: Subsection 15-5 Any use established as a result of a Special Exception granted per Subsection 15- 2 must be initiated within six (6) months of the granting, or the Special Exception shall no longer be valid. The initiation of a use is established by the issuance of a valid business license by the Augusta License and Inspections Department or by other reasonable proof of the establishment of vested rights. If a Special Exception is granted and the use is initiated but later ceases to operate for a period of one (1) year, then the Special Exception shall no longer be valid. SECTION VII. That the Comprehensive Zoning Ordinance is amended by adding the following new Subsection 16-8 to the R-3A (Multiple-family Residential) zone: Subsection 16-8 Any use established as a result of a Special Exception granted per Subsection 16- 2 must be initiated within six (6) months of the granting, or the Special Exception shall no longer be valid. The initiation of a use is established by the issuance of a valid business license by the Augusta License and Inspections Department or by other reasonable proof of the establishment of vested rights. If a Special Exception is granted and the use is initiated but later ceases to operate for a period of one (1) year, then the Special Exception shall no longer be valid. SECTION VIII. That the Comprehensive Zoning Ordinance is amended by adding the following new Subsection 17-8 to the R-3B (Multiple-family Residential) zone: Subsection 17-8 Any use established as a result of a Special Exception granted per Subsection 17- 2 must be initiated within six (6) months of the granting, or the Special Exception shall no longer be valid. The initiation of a use is established by the issuance of a valid business license by the Augusta License and Inspections Department or by other reasonable proof of the establishment of vested rights. If a Special Exception is granted and the use is initiated but later ceases to operate for a period of one (1) year, then the Special Exception shall no longer be valid. SECTION IX. That the Comprehensive Zoning Ordinance is amended by adding the following new Subsection 18-8 to the R-3C (Multiple-family Residential) zone: Subsection 18-8 Any use established as a result of a Special Exception granted per Subsection 18- 2 must be initiated within six (6) months of the granting, or the Special Exception shall no longer be valid. The initiation of a use is established by the issuance of a valid business license by the Augusta License and Inspections Department or by other reasonable proof of the establishment of vested rights. If a Special Exception is granted and the use is initiated but later ceases to operate for a period of one (1) year, then the Special Exception shall no longer be valid. SECTION X. That the Comprehensive Zoning Ordinance is amended by adding the following new Subsection 20-6 to the P-l (Professional) zone: Subsection 20-6 Any use established as a result of a Special Exception granted per Subsection 20- 2 must be initiated within six (6) months of the granting, or the Special Exception shall no longer be valid. The initiation of a use is established by the issuance of a valid business license by the Augusta License and Inspections Department or by other reasonable proof of the establishment of vested rights. If a Special Exception is granted and the use is initiated but later ceases to operate for a period of one (1) year, then the Special Exception shall no longer be valid. SECTION XI. That the Comprehensive Zoning Ordinance is amended by adding the following new Subsection 21-8 to the B-1 (Neighborhood Business) zone: Subsection 21-8 Any use established as a result of a Special Exception granted per Subsection 21- 2 must be initiated within six (6) months of the granting, or the Special Exception shall no longer be valid. The initiation of a use is established by the issuance of a valid business license by the Augusta License and Inspections Department or by other reasonable proof of the establishment of vested rights. If a Special Exception is granted and the use is initiated but later ceases to operate for a period of one (1) year, then the Special Exception shall no longer be valid. SECTION XII. That the Comprehensive Zoning Ordinance is amended by adding the following new Subsection 22-6 to the B-2 (General Business) zone: Subsection 22-6 Any use established as a result of a Special Exception granted per Subsection 22- 2 must be initiated within six (6) months of the granting, or the Special Exception shall no longer be valid. The initiation of a use is established by the issuance of a valid business license by the Augusta License and. Inspections Department or by other reasonable proof of the establishment of vested rights. If a Special Exception is granted and the use is initiated but later ceases to operate for a period of one (1) year, then the Special Exception shall no longer be valid. SECTION XIII. That the Comprehensive Zoning Ordinance is amended by adding the following new Subsection 24-7 to the H-l (Heavy Industry) zone: Subsection 24-7 Any use established as a result of a Special Exception granted per Subsection 24- 2 must be initiated within six (6) months of the granting, or the Special Exception shall no longer be valid. The initiation of a use is established by the issuance of a valid business license by the Augusta License and Inspections Department or by other reasonable proof of the establishment of vested rights. If a Special Exception is granted and the use is initiated but later ceases to operate for a period of one (1) year, then the Special Exception shall no longer be valid. SECTION XIV. That Subsection 26-2 of the Comprehensive Zoning Ordinance IS deleted in its entirety as follows: Subsection 26-2 Any Special Exception use granted per 26-1 (e), (f), (g) or (h) must be initiated within six (6) months of the granting, or the Special Exception shall no longer be valid. The validity of these uses is established by the issuance of a valid business license by the Augusta License and Inspections Department. If a Special Exception is granted and one of these uses listed above is initiated but later ceases to operate for a period of one (1) year, then the Special Exception shall no longer be valid. The one-year time period shall begin at the expiration of the business license. SECTION XV. That a new Subsection 26-2 is added to the Comprehensive Zoning as follows: Subsection 26-2 Any use established as a result of a Special Exception granted per Subsection 26- 1 must be initiated within six (6) months of the granting, or the Special Exception shall no longer be valid. The initiation of a use is established by the issuance of a valid business license by the Augusta License and Inspections Department or by other reasonable proof of the establishment of vested rights. If a Special Exception is granted and the use is initiated but later ceases to operate for a period of one (1) year, then the Special Exception shall no longer be valid. . SECTION XVI. FUTHER, BE IT ALSO ORDAINED BY THE AUGUSTA COMMISSION: That all Special Exceptions which were granted pursuant to the Comprehensive Zoning Ordinance more than six months prior to the adoption of this amendment but which were not subsequently initiated, and all uses established by Special Exception pursuant to the Comprehensive Zoning Ordinance but which later ceased to operate more than one year prior to this amendment are hereby invalid. SECTION XVII. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. Done III Open Meeting under the Common Seal thereof this day of ,2004.
