ORDINANCE 6621
An Ordinance to amend the Comprehensive Zoning Ordinance adopted by
the Augusta-Richmond County Commission effective September 16, 1997
by amending Sections 2, 21, and 26 to provide that inert landfills be
referenced as inert fill areas.
THE AUGUSTA COMMISSION HEREBY ORDAINS:
SECTION I. That the Comprehensive Zoning Ordinance is amended by deleting from
Section 2, Definitions, the current definition of "Inert Landfill" in its entirety and
replacing it with the following definition of "Inert Fill Area".
"INERT FILL AREA" shall mean a disposal facility accepting only non-
contaminated materials limited to earth, earth-like products, concrete, cured asphalt
rock, bricks, yard trimmings, stumps, limbs, and leaves. This definition excludes
industrial and demolition waste not specifically listed above. For the purpose of this
ordinance, filling of land which is not specifically related to a subdivision
development plan or a site plan which has been filed with the Planning Commission
shall be defined as an inert fill area if the volume of fill is expected to exceed 5,000
cubic yards
SECTION II. That the Comprehensive Zoning Ordinance is amended by replacing the
term "Inert Landfill" with the term "Inert Fill Area" in Subsection 24-2 (18) as follows:
(18) Inert Fill Area - Where there are residences or residentially zoned properties
located within 1000 feet of the boundary of the property upon which the inert fill
area would be located, or where the finished grade of the inert fill area would be
greater than 10 feet in elevation above the highest elevation of any adjoining
property.
SECTION III. That the Comprehensive Zoning Ordinance is amended by replacing the
term "Inert Landfill" with the term "Inert Fill Area" in Subsection 26-(0) as follows:

SECTION IV. All Ordinances or parts of Ordinances in conflict with this Ordinance are
hereby repealed.
