ORDINANCE NO. 6575
An Ordinance to amend the Comprehensive Zoning Ordinance adopted by
the Board of Commissioners of Richmond County and the City, Council of
Augusta effective November 15, 1983, entitled "An Ordinance to Readopt
and Reconfirm the Comprehensive Zoning Ordinance adopted March 25,
1963, by the Board of Commissioners of Richmond County and the City
Council of Augusta, by amending Section 3 of the Comprehensive Zoning
Ordinance.
THE AUGUSTA-RICHMOND COUNTY COMMISSION-COUNCIL HEREBY
ORDAINS:
SECTION 1. That the Comprehensive Zoning Ordinance is amended by deleting the
following from Section 2 (General Definitions):
"BOOKSTORE, ADULT" shall mean a regulated use which contains or is
used for the display or sale of books, magazines, movies, novelties, devices
and related sundry items, which are distinguished or characterized by their
emphasis on matters depicting, describing or relating to "Specified Sexual
Activities" or "Specified Anatomical Areas" as defined herein, or an
establishment with a segment or section devoted to the sale or display of
such material constituting a majority of its retail value of stock displayed for
sale or a majority of the monthly gross receipts of the business.
"ENTERTAINMENT ESTABLISHMENT, ADULT" shall mean a
regulated use which contains or is used for commercial entertainment where
the patron directly or indirectly is charged a fee to engage in personal
-*- contact by employees, devices, equipment, 'Or by personnel provided by
the establishment; or where the patron views a series of dance routines,
strip performances, or other gyrational choreography provided by the
establishment which appeals to the prurient interests of the patron.
"REGULATED USE" shall mean any building or structure or portion of
any building or structure used or propo'sed to be used for any adult
bookstore, adult entertainment, or adult theater.

"SPECIFIED ANATOMICAL AREA" shall mean:
a) less than complete and opaquely covered:
i) human genitals, pubic region,
ii) buttock and
iii) female breast below a point immediately above the top of
the areola; and
b) human male genitals in a discernibly turgid state, even if
completely and opaquely covered.
"SPECIFIED SEXUAL ACTIVITIES" shall mean:
a) acts of human masturbation, sexual intercourse, sodomy, or any
acts of bestiality;
b) fondling or other erotic touching of human genitals, pubic region,
buttock, or breast of either male or female; and
c) human genitals in a state of sexual stimulation or arousal.
"THEATER, ADULT" shall mean a regulated use for the viewing of
performances or activities by others, whether such performances are in the
form of live shows, motion pictures, slide shows or other forms of photo-
graphics or visual display, which are distinguished or characterized by their
emphasis on matters depicting, describing, or relating to "Specified Sexual
Activities" or "Specified Anatomical Area", as defined, or an establishment
with a segment or section devoted to the sale or display of such material.
SECTION II. All Ordinance,s or parts of Ordinances in conflict with this Ordinance are
hereby repealed.
