AN ORDINANCE TO AMEND AUGUSTA-RICHMOND COUNTY CODE
BY DELETING THE FORMER SECTION 1-9-4 IN ITS ENTIRETY
WHICH PROHIBITS SWIMMING IN THE CANAL AND SAVANNAH
RIVER AND REPLACING THE SAME; TO ALLOW SWIMMING IN
THE SA V ANNAB RIVER EXCEPT IN DESIGNATED AREAS; TO BAN
SWIMMING OR BATHING IN THE CANAL; TO PROVIDE AN
EFFECTIVE DATE; TO REPEAL CONFLICTING ORDINANCES; AND
FOR OTHER LAWFUL PURPOSES.
BE IT ORDAINED BY THE AUGUSTA-RICHMOND COUNTY COMMISSION,
AND HEREBY ORDAINDED BY THE AUTHORITY OF THE SAME AS
FOLLOWS:
Section 1. The Augusta Richmond County Code, Section 1-9-4, is hereby amended
to allow swimming in certain portions of the Savannah River, by deleting in its entirety
Section 1-9-4, which now reads as follows:
"91-9-4.
BATHING OR SWIMMING IN THE RIVER OR CANAL
It shall be unlawful for any person to swim or bathe in the canal or the Savannah
River."
and substituting in lieu thereof the following:
"91-9-4.
BATHING OR SWIMMING IN THE RIVER OR CANAL
It shall be unlawful for any person to swim or bathe in the canal. Further, it shall
be unlawful for any person to swim or bathe in the Savannah River

within 100 feet of either side of the city's raw water intake site;
within 100 yards of the city's diversion dam; or
along Georgia's shoreline between 5th Street and 13th Street.

Section 2.
This ordinance shall become effective upon adoption.
Section 3. All Ordinances or parts of ordinances in conflict with this Ordinance are
hereby repealed.
Section 4. If any section, provision, or clause of any part of this Ordinance be
declared invalid or unconstitutional, or if the provisions of any part of this Ordinance as
applied to any particular situation, or set of circumstances be declared invalid or
unconstitutional, such invalidity shall not be construed to affect the portions of this
Ordinance not so held to be invalid, or the application of this Ordinance to other

circumstances not so held to be invalid. It is hereby declared as the intent that this
Ordinance would have been adopted had such invalid portion not be included herein.
