';,L.- II (AUGUSTA-RICHMOND COllNTY COMMISSION) i (IJ~I!~IjS!A~R~Gj;'''~''~ :~[iHnr!C~w"'~!q~\l ~ ORDINANCE 6449 , -~,,~i. ;' ,r 1: An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County and the City Council of I ~ Augusta effective November 15, 1983. entitled "An Ordinance to Readopt and Reconfirm the Comprehensive Zoning Ordinance adopted March 25, 1963, by the Board of Commissioners of Ricr.mond County and'the City Council of Augusta, by amending the Comprehensive Zoning Ordinance, Section 8-2, Pertaining to Ponds. THE; AUGUST A COMMISSION HEREBY ORDAINS: i ~ " I i SEC~ION 1. That the, Comprehensive Zoning Ordinance IS amended by adding the 1 foll~'wing to Section 8: i 8-2 Special Exceptions (C) . ~ Ponds, whether impoundment or excavations, in excess of the following maximum pond area to lot area ratios may be pemlitted by Special Exception: J: LOT AREA MAXIMUM PONTI/LOT AREA RA T10 " Less than 2 acres 2 - 5 acres Over 5 acres 2%, 20% 40% ~ : Ponds smaller than the maximum ratios shall be pennitted uses by right. Retention or detention ponds approved as part of a Site Plan or Subdivision Development Plan shall also be permitted uses by right. A Grading Plan or a Soil Erosion Plan, depending on the size of the disturbed area shall be submitted and approved before construction of a pond requiring Special Exception commences. Such plan shall include the following statement: : ~ " 1: ~ ~ h " "The pond as shown hereon is the private property of the owner, who has full and perpetual responsibility for the maintenance and repair. The owner releases Augusta, Georgia, from any and all claims, damages, or demands I' .. " i: i. ;i " 1; \ ~ I = I .~t' ~~ ....., '.~ I -~ I .~ I ... Augusta, Georgia, assumes no liability or duty related thereto, and in no manner approves or assumes liability for the design of the pond as shown hereon." SECTION II. All Ordinances or parts of Ordinances in conflict with this Ordinance are Done in Open Meeting under the Common Seal thereof this ~IJ~ hereby repealed.
