WHEREAS, Congress passed the Public Utilities Regulatory Policies Act in 1978 for the purpose of greater diversity in the supply of electric power by encouraging co-generation resources that would conserve energy, optimize the efficient use of electric utility facilities and natural resources, and provide equitable electric rates to consumers; and WHEREAS, Augusta desires to establish a classification of users of re-use water in the co-generation facilities; and WHEREAS, the use of re-use water in the co-generation facilities, and the resulting reduction of wastewater therefrom, will conserve natural resources; NOW, THEREFORE, BE IT ORDAINED BY THE AUGUST A-RICHMOND COUNTY COMMISSION AND IT IS HEREBY ORDAINED BY THE AUTHORITY OF SAME AS FOLLOWS: Section 1. The Augusta-Richmond County Code, Section 5-2-45 is hereby amended by adding a new subparagraph (d) to read as follows: (d) The rate for wastewater from co-generation facilities is established at the rate of $1.25/kgal. Effective April 1, 2002, and annually thereafter, the rate for wastewater from co-generation facilities as set forth in this section shall be adjusted equal to the percentage increase in the Consumer Price Index (CPI) for all Urban r .... ,;. ;;( . . .' Consumers for the South Region. Section 2. This ordinance shall become effective immediately upon adoption. Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. Section 4. Should any section, provision, or clause of any part of this Ordinance be declared invalid or unconstitutional, or if the provisions of any part of this Ordinance as applied to any particular situation or set of circumstances be declared invalid or unconstitutional, such invalidity shall not be construed to affect portions of this Ordinance not so held to be invalid, or the application of this Ordinance to other circumstances not so held to be invalid. It is hereby declared as the intent that this Ordinance would have been adopted had such invalid portion not been included herein.
