THE AUGUST A COMMISSION HEREBY ORDAINS: SECTION 1. That the Comprehensive Zoning Ordinance is amended by deleting the following from Section 16, R-3A (Multiple-family Residential) Zone: Section 16-2: Special Exceptions: The following may be permitted in the R-3A Zone by Special Exception. (a) Lodging house or tourist house. (b) Family personal care homes and group personal care homes subject to the criteria established in Section 26 of this Ordinance. (c) Fraternity or Sorority house. Section 16-7 Setbacks: (c) Rear Setbacks: The rear setback provisions of Sections 8- 11 of this Ordinance shall apply to the R-3A Zone, provided, however, when a rear yard abuts a zone described in Sections 8-11 of this Ordinance, no structure may be constructed within twenty-five (25) feet of that zone boundary. If a six (6) foot brick or stucco wall is constructed along the entire rear property line adjacent to a zone described in Sections 8-.11 of this Ordinance, the minimum setback shall be fifteen (15) feet. SECTION II. That the Comprehensive Zoning Ordinance is amending by adding the following to Section 16, R-3A (Multiple-family Residential) Zone: Co "1: "~ . . # . Section 16-2: Special Exceptions: The following may be permitted in the R-3A Zone by Special Exception. (a) Lodging house or tourist house. (b) Single-family attached dwellings and condominiums developed in accordance with Section 13, provided that the density of dwellings shall not exceed ten (10) units per acre. (c) Family personal care ho~nes subject to the criteria established in Section 26 ofthis Ordinance. (d) Group personal care homes. (e) Fraternity or Sorority houses. (f) Public parking areas, when located and developed as in Section 4 and where the atea adjoins a use other than provided for in the R-1 Zone, pn?vided such transitional use does not extend more than one hundred (100) feet from the boundary of the less restricted zone. Section 16-7 Setbacks: (c) The rear setback shall be the greater of twenty-five (25) feet or twenty (20) percent of the depth of the lot, but such yard need not exceed fifty (50) feet. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. Done in Open Meeting under the Common Seal thereof this 1st day of May ,2001. APPROVED THIS 1st ,2001.
