AN ORDINANCE TO AMEND AUGUSTA-
RICHMOND COUNTY CODE SECTION 6-6-
45(a)(3) SO AS TO DEFINE AN ARCADE; TO
PROVIDE AN EFFECTIVE DATE; AND FOR
OTHER PURPOSES.
BE IT ORDAINED BY THE AUGUSTA-RICHMOND COUNTY
COMMISSION, AND IT IS HEREBY ORDAINED BY AUTHORITY OF SAME AS
FOLLOWS:
Section 1.
Augusta-Richmond County Code S 6-6-45(a)(3) is hereby amended by
deleting said section in its entirety and substituting in lieu thereof the following subparagraph (3)
so as to define an "arcade", to wit:
(3) Arcade. "Arcade" means any location where three or more
bona fide coin-operated amusement machines are operated which
permit non-cash redemption as provided in O.C.G.A. S 16-12-35,
or a location where ten or more bona fide coin-operated
amusement machines are located, whether or not non-cash
redemption for any machine is allowed.
Section 2.
This ordinance shall become effective upon adoption.
Section 3.
If any section, provision, or clause of any part of this Ordinance
shall be declared invalid or unconstitutional, or if the provision of any part of this Ordinance as
applied in a particular situation or set of circumstances shall be declared invalid or
unconstitutional, such invalidity shall not be construed to effect portions of this Ordinance not so
held to be invalid, or the application of this Ordinance to other circumstances not so held to be
invalid. It is hereby declared as the intent that this Ordinance would have been adopted had such
invalid portion not been included herein.
