Ll )..; , .., '... - ~ I ORDINANCE NO. 6351 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County and the City Council of Augusta effective November 15, 1983, entitled "An Ordinance to Readopt and Reconfinn the Comprehensive Zoning Ordinance adopted March 25, 1963, by the Board of Commissioners of Richmond County and the City Council of Augusta, by amending Section 8 of the Comprehensive Zoning Ordinance. THE AUGUSTA COMMISSION HEREBY ORDAINS: SECTION 1. That the Comprehensive Zoning Ordinance is amended by deleting the current language from Section 8-8-(a) as follows: Front Setback: There shall be a front setback in an R-l Zone of not less than thirty (30) feet from any structure to the front lot line on minor or local streets and a front setback of forty (40) feet from any structure to the front lot line on all other streets and highways. Where a lot is situated in a block face with non-uniform front setbacks the minimum front setback requirement on such lot shall be the average of the front yards of the existing structures on the block face. In the event the average front setbacks of the block face exceed fifty (50) feet, there shall be no setback requirement greater than a distance of fifty (50) feet from the front of the building to the front lot line, If there are less than two existing structures on either side of the lot in question, then the provisions regarding non-unifonn lots shall not apply. SECTION II. That the Comprehensive Zoning Ordinance is amended by adding the following language to 2 as follows: Front Setback: There shall be a front setback in an R-l Zone of not less than thirty (30) feet from any structure to the front lot line on minor or local streets and a front setback of forty (40) feet from any structure to the front lot line on all other streets and highways. For lots in Residential Subdivisions, approved after adoption of this Section, where a sixty (60) foot or greater right-of-way is utilized and such lots are approved by the Augusta-Richmond County Planning Commission and the Augusta Commission, there shall be a front setback of not less than twenty-five (25) from any structure to the front lot line on minor or local streets, ". Where a lot is situated in a block face with non-uniform front setbacks, the minimum front setback requirement on such lot shall be the average of the front yards of the existing structures on the block face. In the event the average front setbacks of the block face exceed fifty (50) feet, there shall be no setback requirement greater than a distance of fifty (50) feet from the front of the building to the front lot line. If there are less than two (2) existing structures on either side of the lot in question, then the provisions regarding non-uniform lots shall not apply. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed.
