An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County and the City Council of Augusta effective November 15, 1983, entitled "An Ordinance to Readopt and Reconfirm the Comprehensive Zoning Ordinance adopted March 25, 1963, by the Board of Commissioners of Richmond County and the City Council of Augusta, by amending the Comprehensive Ordinance to provide for facilities for public or private assembly such as r conference centers, convention center, meeting rooms, and facilities used for similar events by Special Exception in professional zones and by right in commercial and industrial zones. THE AUGUSTA COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance is amended by deleting Section 5 20-1 (d), 20-2; and 20-3 in their entirety. SECTION II. That the Comprehensive Zoning Ordinance is amended by adding the following to Section 20: 20-2 Special Exceptions: The following Specials Exceptions shall apply in a P-l Zone and may be permitted upon approval of the location by the Augusta-Richmond County Commission: (a) Facilities for public or private assembly such as conference center, convention centers, meeting rooms, hospitality facilities (if utilized for more than fourteen total days per calendar year), and facilities utilized for similar social events. Applications for special exceptions pursuant to this subsection shall be accompanied by supportive documentation which describes in detail the services to be provided and the proposed use and development of the site. This supporting documentation shall illustrate conformity to the following objective and subjective criteria. Special exceptions granted pursuant to this subsection shall be specifically for the use described, and they shall be invalid and automatically rescinded if the use changes substantially or ceases to exist for a period of one year: (3) --(4) (5) (6) (7) (8) (9) (1) Exterior lighting shall be designed so that the light is reflected away from adjacent properties; If there are any single-family residences on adjoining properties then all outdoor activities shall cease at II :00 P.M.; Only one sign per street front shall be permitted. Such sign may identify the business only, not to exceed 24 square feet in area, and extend not higher than six feet above the ground. No such sign may be internally lighted; Alcoholic beverages may not be sold on the premises. An open bar where guests are not charged for drinks may be provided; The volume of amplified sound shall be kept at such a level that it is not audible from any single-family residence; Parking facilities shall be provided as the staff deems necessary; The design and scale of any improvements shall be consistent with the surrounding area; . Improvements shall conforn1 to all appropriate provisions of the Tree Ordinance; and Additional conditions may be imposed if deemed appropriate to the proposed use and location. '/ .~/' ~. ....,_... ....-w .; ~ 1 \. 20-3 Height: Not to exceed three (3) stories nor higher than forty-five(45) feet. 20-4 Setbacks (a) Front Yard: The front setback provisions for the P-l Zone shall be the same as for the R-3C Zone; (b) Side Yard: The side setback provisions of the P-l Zone shall be the same as for the R-3C Zone. ( c) Rear Yard: The rear setback provisions of the P-l Zone shall be the same as for the R-3C Zone. SECTION III. That the Comprehensive Zoning Ordinance is amended by deleting the following from Section 21-1(b): (28) Churches, parochial and private schools, transitional housing, family day care homes, adult day care facilities, private hospitals, clubs (public and private), and nursing homes. These uses are also permitted by Special Exception in other zones discussed in Section 26-1 of this Ordinance. SECTION IV. That the Comprehensive Zoning Ordinance is amended by adding the following as the new Section 21-1 (b): (28) Churches, parochial and private schools, transitional housing, family day care homes, adult day care facilities, private hospitals, clubs, (public and private), nursing homes, and facilities for public or private assembly such as conference centers, convention centers, meeting rooms, and hospitality facilities. Some of these uses are also permitted by Special Exception in other zones discussed in Section 26-1 of this Ordinance. SECTION V. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. 7th Done in Open Meeting under the Common Seal thereof this day of November ,2000.
