The Augusta-Richmond County Code Section 3-8-11 is hereby amended by striking 3-8- 11 in its entirety, which provides: 93-8-11. OBSTRUCTING SIDEWALKS, ETC., WITH BOXES, COOPS, ETC. Any person doing business in Augusta-Richmond County who shall occupy the outer side of the sidewalk or pavement with, or place over the street drains, any counters, shelves, coops, signs, boxes or any other articles or impediments, except so far as may be necessary in receiving and delivering goods with reasonable promptness, or who shall occupy more than four feet of the inner side of the sidewalk in the display of goods (or that much, unless at least five feet of the sidewalk be left clear), shall be punished as provided in 91-6-1. and, in lieu thereof, substituting the following: 93-8-11 SIDEWALK ENCROACHMENTS (a) There shall be no physical encroachments or conduct of business on public sidewalks in Augusta-Richmond County, except where buildings on lots which adjoin such public sidewalks are set back ten feet or less from the right-of-way line upon which such sidewalks are located. On the sidewalks in front of such lots there is hereby designated a sidewalk encroachment zone defined as follows: No more than five feet, or 1/3 of the distance from the front property line provided, however, a minimwn of five feet shall be provided at all times for ;;,.4 -:<'"....-'f h ...... of - . -.. . L ,- ... Section 2. Section 3. Duly adopted this ,;.... ,~. .- -', " continuous, unobstructed pedestrian traffic on the sidewalk between the sidewalk encroachments and the curb or nearest obstacle. The following items may be placed within the sidewalk encroachment zone directly in front of such lots, subject to the other provisions of this section: sandwich board type signs (not to exceed 12 square feet in area nor five feet in height, nor be less than three feet in height); tables and chairs; planters; benches; trash receptacles; and merchandise which, by local community standards, is not deemed to be objectionable, vulgar, distasteful, obscene or offensive. (b) All items placed on public sidewalks except large planters and trash receptacles shall be removed daily from the sidewalk after normal business hours. No items may be placed on public sidewalks that have not been approved by the Augusta-Richmond County Planning Commission. Such approval shall be in the form of an annual permit obtained from the Planning Commission. This ordinance shall become effective upon adoption.
