THE AUGUSTA COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance 1S amended by deleting the following definitions from Section 2: HOTEL II shall mean any building containing sleeping rooms for the more or less temporary occupancy of individuals who are lodged with or without meals, with no provision made for any cooking in any individual room or suite. "HOTEL, APARTMENT II shall mean any building which satisfied both the definition of a multiple-dwelling house and that of a hotel as defined by this section. "MOTEL" shall mean any building containing sleeping rooms for more or less temporary occupancy of individuals who are lodged with or without meals and where the design favors a direct vehicular approach to each sleeping or living room. Any building or structure exceeding two stories in height shall be classified as a Hotel rather than a Motel. SECTION II. The Comprehensive Zoning Ordinance is amended by adding the following definitions in their proper alphabetical order to Section 2: II HOTEL II - a building containing guest rooms rented for temporary lodging where guest rooms are accessed through a central area or main lobby and where less than half of the rooms have kitchenettes or some kitchen facilities "HOTEL - EXTENDED STAY" - a building containing guest rooms rented for temporary lodging where guest rooms are accessed through a central area or main lobby and where half or more than half of the rooms have kitchenettes or some kitchen facilities. "MOTEL" - a building containing guest rooms rented for temporary lodging where the design favors a direct vehicular approach to each room and where there are no more than two rooms with kitchenettes or some kitchen faci~ities. lIMOTEL - EXTENDED STAY" - a building containing guest rooms rented for temporary lodging where the design favors a direct vehicular approach to each room and where more than two rooms have kitchenettes or some kitchen facilities. "\: ., r , SECTION III. That the Comprehensive Zoning Ordinance 1S amended by deleting the following from Section 4-2(a) (4) Hotels and Motels one space for each room plus additional spaces as required for other functions such as bar, restaurant, etc. SECTION IV. The Comprehensive Zoning Ordinance is amended by adding the following to Section 4-2(a): (4) Hotels, Hotels Extended Stay, Motels and Motels Extended Stay - one space for each room plus one space for each two employees, plus additional spaces as needed for other functions such as bar, restaurant, etc. SECTION V. That the Comprehensive Zoning Ordinance is amended by deleting the following from Section 21-1 (b): (16) Motel SECTION VI. The Comprehensi ve Zoning Ordinance is amended by adding the following to Section 21-1(b): (16) Motel subj ect 'to the following restrictions and regulations: (a) There shall be staff or management on duty 24 hours per day 7 days per week; (b) Each guest room shall have a minimum area of 280 square feet; (c) No business license shall be issued for any business operated from any guest room; (d) No more than two guest rooms shall have kitchenettes or any kitchen facilities; and (e) The gross density of development shall be no more than 40 rooms per acre. SECTION VII. That the Comprehensive Zoning Ordinance is amended by adding the following to Section 22-1(b): (18) Hotel subject to the following restrictions and regulations: a) There shall be no direct vehicular access to any guest room; b) There shall be staff or management on duty 24 hours per day seven days per week; c) Each guest room shall have a minimum of 280 square feet; d) No business license shall be issued for any business operated from any guest room; and e) No more than ha1 f of the total number of guest rooms shall have kitchenettes or any kitchen facilities. SECTION VIII. The Comprehensive Zoning Ordinance is amended by adding the following to Section 22-2: d) Hotel, Extended Stay subject to the following restrictions and regulations: 1) There shall be no direct vehicular access to any guest room; 2) There shall be staff or management on duty 24 ..,.. ... I hours per day seven days per week; 3) Each guest room shall have a minimum of 280 square feet; 4) No business license shall be issued for any business operated from any guest room; 5) No outside storage or permanent parking of equipment or vehicles shall be permitted; 6) No buildings constructed under this section may be converted to or used as apartments or condominiums; and 7) A preliminary plan" shall be submitted showing the proposed layout of buildings, ingress/egress, buffers and landscaping, amenities, and the density of development. This preliminary plan shall be a consideration in granting the special exception. e) Motel, Extended Stay subject to the following restrictions and regulations: 1) There shall be no direct vehicular access to any guest room; 2) There shall be staff or management on duty 24 hours per day seven days per week; 3) Each guest room shall have a minimum of 280 square feet; 4) No business license shall be issued for any business operated from any guest room; 5) A preliminary plan shall be submitted showing the proposed layout of buildings, ingress/egress, buffers and landscaping, amenities, and the densi ty of development. This preliminary plan shall be a consideration in granting the special exception; 6) No vehicle storage or permanent parking of equipment or vehicles shall be permitted; and 7) No building constructed under this section may be converted to or used as apartments or condominiums. SECTION IX. All Ordinances or parts of Ordinances in conflict with this Or4inance are hereby repealed. day of Done in Open Meeting under the Common Seal thereof this 5th (October , 1999.
